Report – OSHA Sends Worker Vaccine Mandate Rule to White House for Review

Several news outlets (Bloomberg below) are noting the Department of Labor, Occupational Safety and Health Administration (OSHA), has submitted the worker vaccine rule to the White House for review prior to publishing as an ’emergency temporary standard’.

While this may be seen as disappointing by many, the moment the rule hits the federal register, it will be subject to lawsuits before implementation. Until the DoL/OSHA rule hits the books, the mandate is nothing except a statement of intent.

Once the emergency rule is put into the register, then various state attorneys general and private sector employers or employees will be able to seek injunctions and challenge the legality. Florida Governor Ron DeSantis stated yesterday his legal team is awaiting the rule to be published to trigger his state’s legal challenge.

(Bloomberg) […] The standard implements the president’s Sept. 9 order for a regulation requiring businesses with at least 100 employees to mandate workers get fully vaccinated or be tested weekly for Covid-19. Biden also asked for the rule to provide paid time off for workers to get vaccinated and to recover from any side effects.

An emergency standard bypasses what is normally a years-long regulatory process. To do so, OSHA must establish that the vaccination or testing requirement was necessary to protect workers from a “grave danger.”

“The Occupational Safety and Health Administration has been working expeditiously to develop an emergency temporary standard that covers employers with 100 or more employees to ensure their workers are fully vaccinated or undergo weekly testing to protect employees from the spread of coronavirus in the workplace,” a DOL spokesperson said in an email. “On Tuesday, October 12, as part of the regulatory review process, the agency submitted the initial text of the emergency temporary standard to the Office of Management and Budget.” (read more)

Maybe someone here can chime in because I sat through osha classes over 20 years ago.
I don't remember the wording so my Googlefu is failing.

Isn't it against osha regulations to create more of a hazard to the worker than the original threat posed?
Ie. You cannot make someone were fireman's turnouts outside in the heat just because something might catch fire.

My daughter needed a job! So I hired her to help me in our family business. She was only 14 years old granted. But I put her on my payroll anyway, and worked her.

Then my CPA calls me up and says I can't work her! Because of OSHA and child labor laws!

He didn't use any "fighting words" he simply made an observation. This is what he posted:

It was a very fitting observation at that. Why show such disdain for the man simply because he gave an opinion?

Nobody needs to go to war... just sit home. You better have a very large wood pile. The whole system will implode... already is in many areas, people just refuse to let go of their normalcy bias.

just today I was talking to a fellow unvaxxed employee... he was trying to locate a new part for a liquid hydrocarbon line. 8 to 12 weeks out.... no promises on that though!

No spares on hand and the boss won't let him order more than 1. So that unit will sit idle for at least few days in the hopes that a rebuild kit can be sourced.

sounds like they will need to source a new mechanic to install the part if it ever arrives.

if you use propane in the southwestern states, this stupidity effects you directly!

Multiply this by every industry and you start to get the picture.

Anecdotally...my vaxxed school teacher MIL was in the hospital for clots last month and is now on a 500 per month blood thinner med. Vaxxed FIL is currently in the hospital on anti clot meds and my vaxxed SIL dropped dead at 43 on Monday.... BIL is saying heart attack at this time.

Come on OSHA let's do this!

citizens for just being outside Congress who never went in on Jan 6, and holding them without trial for 9 months or more, on misdemeanor trumped up charges, helen is correct, they are Crazy and could read that post to sound like OSAMA BIN LADEN. COMMON SENSE AND LOGIC AND THE CONSTITUTION, AND RULE OF LAW DON'T APPLY TO THEM ANY MORE.

They are lawless men with power and .authority but no accountability.

Add incorporation by reference to the list.
They write some big safety standard. Say, for argument sake, about safety standards for crane use.
With that simple phrase they have the power to reference some big, cumbersome industry trade group recommendations. Asme & Ansi are two for example.

I see no reason cdc & American trade group recommendations won't be deployed as well, jmo.

You know, like fauxi's wear no mask, wear a mask, wear two masks recommendations. Just forget the niosh rulings already on the respirator boxes...

Eta: peruse the distinctions between, respirators, comfort masks, comfort Shields, face coverings.

I wonder how clearly bioNtech & comirnaty will be described. Or visiting foreign workers jabbed with foreign vaxxes....

For instance, at what time frame does a twice jabbed worker fall out of favor if they don't take the 3rd booster?

No consensus at this time for boosters of Moderna or Janssen. (To my knowledge)

These dudes live in black&white minutia, not talking points and narratives.

Until the DoL/OSHA rule hits the books, the mandate is nothing except a statement of intent.
Really? As of this morning, I have until November 1st to submit a request for a religious exemption (to be reviewed by a Woke HR panel), or, provide proof of being "Fully Vaccinated" by December 8th... No provision is given for a positive antibody test.

Brandon's "intent" is actively putting my job at risk.

Anecdotally...my vaxxed school teacher MIL was in the hospital for clots last month and is now on a 500 per month blood thinner med. Vaxxed FIL is currently in the hospital on anti clot meds and my vaxxed SIL dropped dead at 43 on Monday.... BIL is saying heart attack at this time.

and i can bet the drugs they are on for the clots are made by pfizer. convenient huh?

You know... One way to go about filing suit is "Equal protection under the law". If you work for a company with 101 employees you lost your right to make a health care decision for yourself, but another human works for a company with 99 employees and was not forced to make a decision. The directive from the Executive, is being placed as a law, based on previous legislation that allows OSHA to write work place safety regulations as part of a broad law. This places undue burden and hardship on an individual based on how many employees a company decides to keep on the payroll.

Based in part on the past thinking of SCOTUS, this route would probably get their attention.

Months ago the Brits put in a larger order than usual for Anti-Clotting drugs.

Reading an article I came across early this morning I found out there have only been 56 "Covid" related deaths in the entire Military since Covid started. Yet we are going to jab every single military member with this non-vaccine to protect them?

Control is the word most often used to explain this, and nothing is more accurate.
