Because I'm a realist.
We KNOW that the interstate commerce clause has been twisted out of its original intent. But that ship has sailed. Once something becomes established law at the SCOTUS level it's very difficult to undo. Not impossible, but very very difficult. The odds of Montana prevailing here are vanishingly slim.
But let's say Montana does go ahead and attempt to keep federal laws regarding firearms from being enforced. Does anyone REALLY think the FedGov is going to allow that to happen unchecked? They won't do anything like swoop in with helicopters or send in the army. Nothing that will make the news.
They'll just go in with the EPA and start designating millions of acres as "protected" for endangered species.
They'll cut off federal highway funding (this is how they "made" the drinking age 21 nationwide).
They'll pull military bases, cut off Govt. contracts from firms in the state, come up with new water restrictions, impose a new punitive federal tax on any firearms manufacturers who don't "comply" with "Federal Regulations"...the list is infinite.
They couldn't pull that crap with California regarding pot (too large, generates too much revenue) but Montana?? Not to insult the good people of that state, but the rest of the country simply won't care what the FedGov does to them.
And that's a fact...
