U.S. immigration raids are about to get ugly

The Immigration and Customs Enforcement agency personnel are trained and ready. Buses and vans are standing by for raids. Detention facilities have expanded.

All that is lacking is clearance from the courts.

Employers should be prepared in the coming months for immigration raids on scales never before staged by the federal government. The stakes for employers will be especially high if the courts give a green light to the mailing of Social Security no-match letters.

ICE already has stepped up its worksite enforcement program in recent years, even without the new kind of no- match letters that were held up by a court injunction last fall.

Social Security will not provide ICE with a list of employers receiving the possible new round of no-match letters. The letters would establish new grounds to nail employers with criminal charges.

Austin lawyers Kevin Lashus and Robert Loughran compare the federal government's preparations for increased worksite enforcement to an army practicing for battle.

“The government expects a massive disruption of the work force,” Loughran said. “A climate of fear is the strategy of this administration.”

Employers receiving the new no-match letters would have 93 days to resolve discrepancies, said Lashus and Loughran of Tindall & Foster's Austin office.

Employers could find themselves trapped by federal laws that on the one hand prohibit unauthorized workers and, on the other hand, ban discrimination. Employers cannot look beyond the employees' documents. If they do, they face federal discrimination lawsuits. If employers have not followed steps listed in the no-match letters or are determined to knowingly employ unauthorized workers, they will face criminal charges.

Lashus, a former ICE official, has been involved in some of the agency's previous workplace raids. Loughran is a longtime specialist in employer sanctions law.

Whereas ICE has routinely conducted about 10 raids a month, the lawyers expect the pace to rise significantly once the Social Security Administration mails the letters. ICE could strike workplaces 20 to 30 at a time in any given city. The agency would pause to process the cases, then begin new rounds of raids, Lashus said.

Homeland Security wanted to implement its plan last fall, but a U.S. district judge blocked Social Security's no-match letters after labor unions and other organizations contended the plan would disrupt companies and harm innocent workers.

Social Security's own inspector general already estimates that about 17.8 million of 435 million records contain errors that could generate a no-match letter. An estimated 70 percent of the erroneous records belong to U.S. citizens.

Homeland Security appealed the judge's decision but in March proposed to go ahead on its plan. Any day now, the Arizona judge must decide whether to lift the injunction or make it permanent.

If the injunction becomes permanent, Social Security will hold the letters while Homeland Security again appeals. If the injunction is lifted, the no-match letters could be mailed within days.

“The government is deadly serious about these cases,” Loughran said. “The difference is that the federal government is eager to enforce the laws now, whereas they couldn't be bothered 15 years ago.”

Especially vulnerable would be businesses 10 to 15 years old that haven't strictly monitored their new employees' documentation. “They have no understanding where the lines are,” Loughran said.

The damage would go beyond that. A sudden explosion of enforcement could victimize legal workers, either directly or indirectly. Businesses would close, throwing innocent workers out of work amid a weak economy. Families would be torn apart.

It could end up being an ugly chapter in American history.

I will believe it when I see it, and a fence to permanently keep them out. Otherwise this is just make-work to keep the folks who complain about illegals happy....

Without a fence and our border patrol armed with something other than paint guns, it's a joke.....the employer will pay huge fines, the gov will collect those monies the the game will continue.......

These A$$holes have had decades to do something. Every business knows the deal when they hire someone. Some do it legally, others choose to gamble and cheat.

As for the breaking up of illegal families.............that happens to all criminals who get busted and sent away for their crimes. Why should they be special?

I can handle the ugliness of this chapter of US history...................we could call it "A New Beginning", or "Enforcing our Sovereignty..........at last".

In Rexberg, ID they have arrested an illegal alien that has raped several little girls the youngest just 10 years old she gave birth to a baby yesterday she is the youngest person to ever give birth in the state of Idaho. This town is about 50 miles from where I live, we are over run with illegals and the crime they cause.

Actually, it looks like they have already started rounding a few of them up with the new raids. We just had this one here in Richmond yesterday. Caught 33 of the little borderjumpers, with them all scurrying and hiding as fast as possible. The parent company of the construction company IMMEDIATELY said that they had no knowledge of the illegals working there, and that it was the SUBCONTRACTOR's doing as far as they were concerned. Ready for the big shock... The illegals were working at the construction site of the NEW FEDERAL COURTHOUSE.

Immigration raid at federal courthouse in Richmond

Immigration agents raided the soon to be opened federal courthouse building in Richmond this morning. Witnesses say dozens of people were chased down and handcuffed at the construction site.

NBC12 got there just as the raid ended, but by all accounts, those who saw it, will never forget it.

It's supposed to open in a month, but no one was putting the finishing touches on Richmond's new federal courthouse today.

Construction worker David Richards says, "We were standing there working, next thing you know, one guy yelled, 'Police.' And then, everybody else just took off."

Federal agents raided the construction site, arresting 33 people -- 29 males and four females. Richards was working right across the street on the new performing arts center. He saw people jumping fences and running down the road.

Richards says, "They had a crane on the other side of the building that they were setting the I beams and the people who were welding the beams together, they just ran off the building, left the beam in the air."

Tompkins Building out of Washington, D.C., is the company constructing the seven-story courthouse. Company officials didn't want to talk.

The new federal courthouse cost $104 million to build and has been under construction for more than two years.

Some of those raids have already been going on here, & suddenly, Americans can get decent jobs at a certain chicken processing plant, where just a few weeks ago, no jobs were available.

Absolutely delicious! I have been ranting about this since Day One. The employer dare not profile (so Jose can't speak English, is that a reason not to hire?) so he has to harass everybody. (Yeah, Joe, I 've known you since the day you were born, but your SS is screwed up so I need a birth cert.)

Here in CO some of the more high profile raids at the meat processors have given the locals shots at jobs with decent wages, that didn't exist prior.

Sounds like Sherriff Davis needs a couse of the birds and bees! Any girl that has reached the age of menses can conceive. Some girls are starting at the age of 9 these days. But that is an irrelavant point. A ten year old isn't anywhere near the age of consent. So in my eyes, this is a case of rape and sexual abuse of a minor.

I say the uglier the raids get, the better.

The 'raids' here in AZ are going rather nicely. I know of one company that fired a bunch of its workers(illegals) just prior to the 'Employer Sanctions' bill coming into law in January. Companies do know who they hire are illegal most of the time. They are gambling and this company lost. Was it the end of the world and everybody lost their jobs at the company? No. They had to fill all those positions with Americans who 'wouldnt do it' before.

If I go off, I will rant beyond what I've ever ranted before. I don't know if anyone remembers my post from about 2 years ago, but remember that I got a phone call from some nitwit Republican Party rep wanting to raise money?!?!? Remember my rant--I DESTROYED her on the phone, and it was ALL about this illegal immigration.

Strangely--the wheels really started to turn in our favor AFTER that phone call.

Soy is worse than hormone laden milk, in my opinion.
I have a niece that fed her little boys soy milk from the day they were born, & both of them (8 & 10 years old) have breasts developing.
Soy is full of estrogen.

Tell you what, take the kid, feed it an inadequate diet in both quantity and quality so its hungry most of the time and malnourished nearly all of the time, no heating to speak of so it is cold most of the time, give it measles, mumps, chickenPox, diphtheria, with an occasional bout of pneumonia and such stuff thrown in and guess what?

No menses at 9 yrs.

Kids don't need much milk - go organic and restrict their milk intake. You also need to worry about growth hormones in meat.

Menses have a lot to do w/weight. Generally, a girl will start menses when she hits 100 lbs. As our kids get fatter and fatter their menses will start sooner.

I don't know the stats, but I used to have access to a data base looking up properties for a law firm. While searching owners I used SS numbers. I was pretty shocked to keep seeing hispanic names coming up over and over sometimes multiple hispanic names linked to the authentic owner's number, sometimes I would run the hispanic name and find 3-7 other SS numbers linked to that name.

So yeah, the problem is very pervasive. If the estimated 25 million illegals are sucking up and using 10-18 million American's SS numbers, yeah, the gubmint might have trouble sorting that out.

And yes, we NEED to put up a strong wall and patrol it just like the Roman's did.

Actually this is much better than a fence. This stuff they have planned will cause self-deportation en mass if it is done even on a 1-3% scale. I will scare the pants off employers who are not yet targeted and cause a domino effect. Think RIAA.

I was down in Alamogordo New Mexico this morning, its about an hour-1/2 south of me. Just outside of White Sands. I lost count after about 35 Border Patrol Vehilces AND saw 3 full-sized school type busses with Border Patrol symbols on them.

I was returning a bobcat I rented for a week, the rental company was empty - seems all the Mexican landscapers, etc have all but taken a complete leave. None to be seen anywhere. The rental equipment employee told me they also have a store in Las Cruces NM, same thing going on there, no Mexicans renting anything.

So those 70% are paying to someone ELSE'S retirement fund instead of their own??? Seems to me they'd be beating down the doors to get their SS# corrected and pay into their own retirement instead of giving away that money to benefit some stranger.

I have been ranting about this for years. Set up a system where the employer can check SS's, let him do it without being badgered about profiling etc., hold him responsible, jobs for illegals will disappear and so will the illegals.

Don't need no steenking fence.

One problem: The Illegals we got are here because they wanted to come. If things go South in Mexico, we may get a new bunch coming here because they dare not stay there.

And that could be a real problem. Over 10% fled Cuba, we could expect at least the same % from Mexico, if not more because it is easier.

first: the Republicans smell DOOOOM in the air. and they know exactly why because the People have been telling their fund raisers not a penny till they throw out the illegals. and elections are near.

second: get the illegals to get gone and suddenly the unemployment rate due to the collapsing economy starts to hit a ceiling as employers start looking for authentic Americans to employ.

third: the gov knows that race riots between blacks and hispanics and hispanics, blacks and whites are coming this summer, and the only way to BEGIN to deal with it is getting rid of the illegal hispanics NOW before the rivers of blood start to run.
