Texas balks at Hollywood take on Waco tragedy
Saying movie twists facts, Film Commission denies it a state rebate, but filming will go on

Movie producer Emilio Ferrari vowed last week to move ahead with his $30 million screen depiction of the deadly 1993 clash between federal agents and Branch Davidian cultists, even though the Texas Film Commission says the project could taint Texas’ image and is unworthy of taxpayer support.

The movie, Waco, would be the first feature-film treatment of the 51-day federal siege of David Koresh’s Central Texas compound that led to the death of four federal agents and more than 80 cult members.

Ferrari, whose production credits include Baby on Board, starring Heather Graham, called the incident the “nation’s biggest tragedy, after 9/11.”

“And this was by Americans against Americans,” he said. “It’s been completely swept under the rug. I think people have a right to know what happened. I’m not a political guy at all. I’m making a story from every point of view.”

The Texas Film Commission’s director, Bob Hudgins, said the movie would not be eligible for a state rebate of up to 15 percent on in-state production costs because the movie doesn’t “accurately portray Texans.” In language creating the stipend, lawmakers specified that Film Commission grants should be denied movies that distort facts to make Texas look bad.

Hudgins said he consulted media and law enforcement sources and determined that the movie’s script compresses and simplifies the historic event. Actions that were taken by several individuals during the standoff are attributed to a single character in the movie, he said.

Dispute over facts

The extent of a movie’s factual distortion isn’t a factor in determining its eligibility for funding, Hudgins said. “Either it is (accurate), or it isn’t,” he said.

“Show me where in the script there is anything against Texas,” Ferrari said. “Those are his two points: It’s against Texans, and it’s inaccurate. Neither is correct.”

Among production staff, he said, is Mike McNulty, who co-wrote the 1997 Oscar-nominated documentary, Waco: The Rules of Engagement. “Thousands of hours of research went into this project,” Ferrari said. “Every expert on Waco worked for me.”

Hudgins’ decision, Ferrari said, “affects my credibility and the credibility of everyone involved.”

The producer said he had planned to begin filming the movie near Houston in August.

Now, he said, he is scouting for a new location, but — if the state would modify its stance — he still would like to film in the Lone Star State.

“The movie should be filmed in Texas, where it actually happened,” Ferrari said.

Other exemptions

Hudgins said Ferrari’s movie, though not eligible for the production rebate, still could receive assorted tax exemptions granted in-state movie, television, commercial or video game productions.

Hudgins said Ferrari and his associates never formally applied for the production rebate, but if they had, the application would have been rejected.

Then-Gov. Preston Smith created the Texas Film Commission in 1971, but money for in-state productions was not provided until 2007. Since then, one movie and two television series have received grants. Most Texas productions are commercials, Hudgins said.

The Branch Davidian standoff began on Feb. 28, 1993, when federal agents attempted to serve search and arrest warrants at the group’s Waco-area compound. It concluded in a disastrous fire on April 19 as authorities fired gas canisters into the compound.

Cult leader Koresh died on the final day, as did more than 20 children.

I really need to learn more about what happened at Waco, what BATFE did, and what the BD's did to bring on the govt's wrath. I remember when it went down, but my mindset and worldview has changed since then and I would like to reevaluate it from my new point of view. Just being honest with myself, dontcha know.

Any able to point me to any good and factual references?

Sorry, don't have the facts.

What I remember hearing back then is that the Texans detested the federals' actions, that the Texans thought the man should just be arrested on one of his regular trips to town, but that the federals insisted on the course they took. I heard the Texas Rangers and the local county police were nearly ballistic about the whole course of federal action.

The truth has never come out, as far as I know, about why Koresh and his band were treated this way. I always figured he either angered some rich man or some bureaucrat up to and including that dyke bitch.

Remember now that Holder worked for Reno. Something like this could now happen again. It is good timing for any movie about Waco to come out now. Maybe Emilio Ferrari will do a movie about Ruby Ridge next.

Yes, McNulty's involvement is crucial. First I've heard of this project. I'm very excited at the prospect. The 82 dead deserve a fair telling.

I would and will fruit loop. This was the event that revealed the darker side of the federal government to many of us. Whatever legal problems Mr. Koresh/Howell had the residents of Mt. Carmel did not deserve the evil cast upon them with the full force of the US government. Waco was naked, arrogant power delivered to people who did not fit the mold. You of all people should see the injustice of this episode. The term 'never forget' doesn't apply solely to those who endured Auschwitz, Treblinka, Dachau, Sobibor, etc. A lot of us will never forget April 19th, 1993. The worm turned that day.

Waco went by with hardly a bat of the American eye.

Well, I have noticed that we are agreeing a lot this week. It could be because we both have good heads on our shoulders. But, I think others might take issue with that, in my case, anyway. So, it must be because I have tapped your phone, bugged your home and car, and installed video cameras throughout your property and at work. Just joking... I would never spy on you at work... LOL

He should shoot in Utah- Utah has every possible scenic location- even looks like NZ in places.

Waco:Rules of Engagement is a very well done documentary that shows both sides of the incident but when all is said and done proves that those people were executed, down to every last woman and child by setting them on fire using military equipment. The Feds literally terrorized them for days and then finally murdered them. The evidence speaks for itself.

Just a side thought I'm sure FL will enjoy is that this atrocity was done during Clinton's rule with Janet Reno. You know the pacifists with all the good intentions. Just like our new White House resident.

It also seems to me that David Koresh was in the process of writing a book about our fine ruling class and those same fine people for some reason did not want it published or any record remaining of it. Hence they burned men, women, and children. IFRC.

THEY WERE GIVEN MULTIPLE OPPORTUNITIES TO LEAVE. They chose to remain with Koresh, insisting to the end that he was their all-wise prophet. I have zero sympathy. Follow a false prophet, and you deserve what you get.

Slain children? Blame their stupid parents for remaining there, and insisting that the kids stay too. Why not release them to relatives on the outside? Plenty of them offered.

Koresh? He could have surrendered himself at any time, and spared his people. Instead he stayed inside, issuing periodic statements that removed all doubt that he was a nut job.


I'd rather watch "Gettysburg" or "Gods and Generals." Now there are real examples of federal tyranny at work.

I am, as I type, watching "Waco: Rules of Engagement". As I read this part of your post, a person was testifying to a congressional hearing that Koresh, before the raid, had invited ATF to come in and inspect his arms cache. This invitation was verified by an ATF director (former or in-house at the time, I'm not sure) and also noted that the raid occurred just before ATF's budget was due to be discussed by congress. In other words, the raid never had to happen in the first place.

Thanks. It was a real blow to learn all that, way back when. We were a lot more innocent and the idea such things could happen- and then be dismissed- was a real shock.

They keep talking about this "concrete bunker" that was actually a tornado shelter originally constructed back in the 1930s or so. The Davidians built that great big ramshackle building over it, when they tore down the smaller houses that had originally been there. That's where many of the women and children were hiding.

It looks as if someone placed a breaching charge on the roof, and blew it. There's a perfect round hole in the concrete, with the rebar left in place, and autopsy results indicate overpressure and blast injuries to those who were sheltering there. That's one of the worst things, to me.
