I work with this person, and they are positively evil.
I am just going to describe the situation as I understand it, as I don't presume to be any kind of expert, and to be honest the whole process is a mystery to me.
She had some sort of guest worker status here in America. She was issued a social security number, but her husband was not, as he is not allowed to work. Her children have been given ss # as they are born in America. She needed an employer to "sponsor" her, and take on the responsibility doing a lot of legal work on her be half, and take on the expense of that legal work for her to get some sort of citizen track. Our employer does not sponsor these type of workers period, but her she is still working and I know for a fact her guest worker status expired about 2 years, and maybe 4 or 5 months ago. As I understand it the "Old Visa" expires after three years. She may have gotten a "Old Visa" status to satify our employ her termination. Our employer does not sponsor these people and to get Old Visa she needed a HUman Resources Director to sign her documentation, and I know for a fact he did not sign it. So I am thinking she fraudulated something, possibly forged his name, or possibly got someone else to sign the paper work, the latter of which I believe to the truth.
I have had problems with this woman and her husband harassing me in a multitude of ways, and I am hopeful they will forced to move back their nation of origin, or maybe just out of my area. I reported them to INS, and called the State Trooper, who confirmed they are here illegally, but he can't do anything about them until INS tells him.
So I have these questions. Do "Old Visas" expire and if so when? Can they be renewed or transformed into another legal document that would allow her to stay legally?
Could she possibly have any other document that would allow her to stay legally?
The last time a person in our work place was found to be "Out of Status" on their "guest worker status" our employer was fined 50,000 bucks, and they seem to be vigilant about not being put into that situation again, as they have refused to hire any more of them.
I am just kinda sick of dealing with it all, as it has dragged on for years. Any information to help me better understand all of this would help me. Thanks
