Subject: Trouble in Paradise....

My name is Edgar J. Steele. I am an attorney with an office in Sandpoint, Idaho. I have been asked by JoAn McGuckin to provide representation to her where her court-appointed attorney's representation ends, as well as for her six children, now the subject of the highly publicized "standoff" in Sagle, Idaho, which is the rural township where I maintain my personal residence. Here is the statement I released to the press this afternoon:

Edgar J. Steele

Attorney at Law

102 South Fourth Avenue, Suite C

Sandpoint, Idaho 83864

Admitted in Idaho, Oregon, Washington & California

Facsimile: (208) 265-5329 Telephone: (208) 265-4153

PRESS RELEASE - IMMEDIATE May 31, 2001, 4:00 p.m., Sagle, Idaho

Contact: Edgar J. Steele, attorney for JoAnn McGuckin and her children

Sandpoint, Idaho. A modern American tragedy in the making. That’s what the Sagle, Idaho, McGuckin family “standoff” represents.

The McGuckin family home and the 40 acres upon which it stands were recently sold for a pittance by the county government for past-due taxes. It brought only $50,000, while the property is in prime territory, with fully half of Beaver Lake on its eastern edge.

Dad died recently, after a long and valiant struggle with multiple sclerosis, not of “malnutrition and dehydration,” which has widely and falsely been reported as the cause of death. Just a couple days after this tight-knit family buried Dad, county government lured her out with a promise of money and free groceries, then arrested her, leaving them only to have to deal with the kids. That was a mistake, of course, but not their first.

Rather than allow this tightly-knit family a decent period to grieve the loss of their beloved husband and father, the county government instead is doing its best to make the family’s worst nightmare come true.

For years, Mrs. McGuckin has been fearful of the government taking her property and her kids. Today, that fear is realized, with the issuance of an order through Child Protection Services, making the six children its wards. Of course, the Sheriff can’t get near the house to make good on that order.

She has been jailed on a charge of felony child endangerment, allegedly for not providing a proper home for the children, including food, hygiene and education.

Well, admittedly the running water is off temporarily, because the well pump broke and, what with Dad’s severe condition as his days drew to a close, they just didn’t have the time or the money to deal with it properly. So, they drew water from the crystal-clear lake on their property for washing and to flush their toilets with. And, yes, the laundry did pile up, but what family doesn’t have a few domestic backlogs when it loses its patriarch?

And the children are home schooled, fact which makes them politically incorrect, even by North Idaho standards.

But, they do have food, contrary to reports, and the power was hooked up and paid for when Mrs. McGuckin was arrested.

Are they armed? Who knows? Nobody has seen any weapons and no gunshots have been fired. Sheriff Jarvis has shown great prudence in executing the orders he is lawfully obligated to follow. He did not cut off any essential services, as has been reported. He has vowed to keep his men well away from the house and allow us time to effect a peaceful resolution to this crisis.

That resolution must begin with the release from custody of JoAnn McGuckin and the rescission of the order giving custody of her children over to the government. Friends and family stand ready to accept responsibility for the children while Mrs. McGuckin puts her life in order and proves the outrageous charges against herself to be false. However, the demand by the county Prosecuting Attorney that the bail, initially set for $10,000, be elevated to $100,000, effectively guarantees that Mrs. McGuckin will not be given that opportunity.

We are now asking the court for a reduction in the bond requirement and will then seek a modification to the CPS order, whereby the children are given over, as a single unit, to the custody of a trusted family friend. Then, we will take on these outlandish charges and give them the ignominious end that they deserve. We are also investigating this highly-questionable attempted seizure of the McGuckin family home.

Donations to the family can be made to:

McGuckin Family Trust, PO Box 1255, Sagle, ID 83860.

I missed the post office, which closes at five. But that will give me time to roll some coins tonight.

Kath, can you fix the width on this.

I plan so do some e-mailing with hopes of finding other sympathizers.

This is one of those lines in the sand, IMHO.

Kath--

It’s a “double-wide” on my screen. I have to scroll over to read it.

This is too important a post to leave it difficult to read by those who are seeing what I am seeing.

Thre’s also a lot of code showing.

thread looks OK here, SO, but if vipper were to edit out the unneeded stuff, it might be wise.

i believe i'll wait until they've had the weekend to sort things out before i send a contribution. i'd bet mom will be out on bail pretty soon the way this thing has caught fire. JMO, others might want to take a different course.

let's just hope nobody does anything stupid (or should i say any more stupid things) in the interim.

i get the feeling the kids are more adept at adapting to adverse conditions than are the goons who were sent to "protect" them.

I think you're right, bigwavedave. TPTB just want them eating 3 meals a day at McDonalds and watching TV sewage all day. I'm sending them some $$...

Well, at the VERY least, this does fall into the "widows and orphans" category. Donation will go out Monday, (God willing) since everything within reach of me is closed now for the weekend. - Jesse.

nnnnaahh. it's one of those agenda thingies.

Dave,

The way I see it is that no matter what the details turn out to be, this family needs help. They will need money, if not for legal representation, then for sustenance. Thre is no question that they are the victims in this situation, regardless of their collective mindset. My prayer is that they receive enough to recover their property somehow, and to be able to derive a sustainable, government-free living off the annual interest. I know that probably won’t happen. But it is an admiral goal to aim for, and my drop in the bucket goes out in the next mail.

And I will continue to pray for that outcome.

They'll get my tithe this week - will go in the mail Monday. This whole episode just sickens and saddens me. At times I just can't believe how low our society has sunk. It also brought home to me how vulnerable we all are. Most of us on this forum are thought to be "mentally ill" or just plain crazy by other people.

your concern and efforts are admirable. all of us should do what we think is right here. however, i do make a distinction between her immediate needs (posting bail) and her long term needs (everything else).

getting her out of custody where she has no business being and serves only to prolong the standoff, is my primary concern. beyond that, well, it's a big, impoverished world out there. i'd prefer that this be an adequate wake up call for their community, all communities, for each to provide more to others in many different ways. otherwise, we may as well become democrats.

who knows if JM has any interest in outside aid? she hasn't up til now. clearly, though, the system has abused her with bad moves at bad times. truly shameful behavior. that much we should try and fix.

i hope she gets what you envision, but first things first.

Don't wanna throw a snag in this but does anyone know who has management over this fund? Steel? Wasn't he just fired by the lady?

Hi synap! I hadn't heard that she fired Steele; good grief, I hope not. The way I see it, these folks have been through a really bad time with the prolonged illness and death of the father, then the mother being grief-stricken, and not knowing what to do. Hey, I'm like that to a fault - if I don't know what to do about something, I don't do anything! I seem to wait until something forces a decision. Could be the same case here.

Anyway, I think they need major help right now - get the place cleaned up, get food in the house, get a garden planted, make sure the well is fixed, etc. Then what about the prospects of the Mom working in town part time, the oldest boy starting a firewood or taxidermy business, something like that.

The important thing to remember is that these people have committed NO crime! I'd sure like to get in the truck and go up there and help them myself. Blessings, Stormy

In other developments, attorney Edgar Steele of Sandpoint, who recently represented Aryan Nations founder Richard Butler in a lawsuit and volunteered to represent the McGuckin family for free, was fired Friday by JoAnn McGuckin for unknown reasons, Robinson said.

Could be she doesn't in any way want to be associated with the Aryan Nation...as the majors are repeating with every broadcast. Guilt by association they don't need. But I think the damage has already been done.
