The Labor Department’s Occupational Safety and Health Administration (OSHA) has suspended the enforcement of the Biden administration’s COVID-19 vaccine mandate for private businesses.
The announcement came shortly after a U.S. appeals court rejected a challenge by the Biden administration on Nov. 12 and reaffirmed its decision to put on hold OSHA’s mandate, which requires that businesses with 100 employees or more ensure that workers either be vaccinated against COVID-19 by Jan. 4, 2022, or be tested weekly and wear a mask.
The Fifth Circuit Court of Appeals in New Orleans stated in an opinion that OSHA’s mandate is “staggeringly overbroad,” and ordered it to “take no steps to implement or enforce the Mandate until further court order.”
The court had previously issued a temporary halt to the mandate on Nov. 6 pending litigation.
“The court ordered that OSHA ‘take no steps to implement or enforce’ the ETS ‘until further court order.’ While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation,” the Labor Department affirmed in a statement in recognition of the court’s ruling.
At least 27 U.S. states, as well as private employers, religious organizations, and other groups, have sued the Biden administration, claiming that it’s exceeding its authority in issuing the mandate.
In the Fifth Circuit Court’s reaffirmation on Nov. 12, it stated that the Biden administration’s vaccine mandate “raises serious constitutional concerns” and “likely exceeds the federal government’s authority.”
The Epoch Times has contacted Biden administration officials for comment.
Meanwhile, White House officials have continued to call on employers to adhere to the vaccine mandate for private businesses after the initial Nov. 6 ruling.
“We think people should not wait,” White House principal deputy press secretary Karine Jean-Pierre told reporters on Nov. 8, responding to a question on whether employers should hold off on requiring employees to be vaccinated after the court put the mandate on hold.
“We say: do not wait to take actions that will keep your workplace safe,” Jean-Pierre said. “It is important and critical to do, and waiting to get more people vaccinated will lead to more outbreaks and sickness.”
Employers “should not wait” for legal matters to be resolved before adhering Biden’s vaccine requirement, Jean-Pierre added.
“They should continue to go—move forward and make sure that they’re getting their workplace vaccinated,” she said.

While that is true, they can. However to a lot of employers, to enforce a mandate on their own, would mean go woke, go broke. Employees walking off the job.
One of the things appearing now in our local paper is employment notices with the added line "No Vaccine Required."

AD Military. Our (.mil/DoD civ/ DoD contractor) decision is still pending. Liberty Counsel finished their brief 1500 on Monday. Now were just waiting on a ruling from the judge. I would guess that if a stay is issued on the DoD vax mandate, that one for the rest of the .gov will shortly follow.

They are consolidating all of the various lawsuits on the Mandate, and since there are Circuit disagreements, the 6th Circuit is going to run the class issue for the whole country.

Interesting what the ramifications of the invalidated mandate will be. People were faced with major coercion to take this drug to address 'workplace safety'. I suspect what will bubble up is the fact that this was a falsehood as spreading was not blocked and more negative data will be presented as the suits are addressed. Significant criminality in this mandate!

Good point. A few solid lawsuits will open up some discovery issues and people not informed may realize what’s really going on.

Personally I sincerely believe that this shot was developed before the COVID was released from the lab in China. If you go back and read all about Fauci's work in that lab and that Gates was developing the vax at the same time.

Yeah that is a different piece of pie. Mandating stuff for private companies through OSHA is seen as an over reach of the power of the executive branch.
They do have the authority on federal contractors. Like mandating 15.00 minimum wage, etc.....
However, the EO mandating the vax for medical personal/organizations that receive medicare and medicaid, has also come under a suit. I know of 12 states filing. Including as of yesterday MS.
I haven't kept up with federal contractors, but there may be suits in that vein as well.

Eleven states with Republican governors are challenging the Biden administration’s vaccine mandate for federal contractors between two lawsuits filed on Thursday and Friday.
The state of Florida filed a lawsuit in the U.S. District Court for the Middle District of Florida in the Tampa Division seeking an injunction on the mandate that has a December 8 deadline for millions of employees of federal contractors to get vaccinated against COVID-19. Then on Friday, Missouri, Nebraska, Alaska, Arkansas, Iowa, Montana, New Hampshire, North Dakota, South Dakota and Wyoming filed a similar lawsuit in the U.S. District Court for the Eastern District of Missouri also seeking an injunction.
“We cannot have the federal government coming in, exceeding their power,” said Florida Gov. Ron DeSantis, during a press conference on Thursday. “They’re really rewriting contracts and they’re transforming normal contracting into basically public health policy and that’s not anything Congress has ever authorized.” He noted there is “a very big footprint in Florida” in federal contracting, such as with NASA and the General Services Administration, and said he is worried about job losses for those who decline to get vaccinated.
“Florida expects to continue pursuing government contracts in the future,” said the lawsuit. “Because Florida’s employees are generally not required to be vaccinated, the challenged actions threaten Florida with the loss of millions of dollars in future contracting opportunities and put undue pressure on Florida to create new policies and change existing ones, each of which threatens Florida with imminent irreparable harm.”
The Florida lawsuit alleges 10 counts of violations of federal contracting and administrative procedure laws, taking issue with the executive order, guidance from the Safer Federal Workforce Task Force, the Office of Management and Budget rule approving the guidance and the Federal Acquisition Regulatory Council’s guidance.
“Other suits have preceded this one, though this new challenge puts more focus on federal procurement and administrative law than others we have reviewed to date,” Craig Smith, partner at the law firm Wiley Rein who specializes in government contractors, told Government Executive. The attorney general of Arizona filed a lawsuit in September taking aim at all three of Biden's vaccine mandates, so Florida was the first state to just target the mandate for contractors.
“President Biden has arrogated to the executive branch the unilateral power to mandate that all employees of federal contractors be vaccinated,” said the lawsuit from the 10 other states. “Employees of federal contractors constitute one-fifth of the total U.S. workforce. And the mandate goes so far as to demand vaccination even from employees who work entirely within their own home. That is unconstitutional, unlawful, and unwise.” Their lawsuit has 12 counts of alleged violations of law.
Attorneys general from eight of those 10 states were among the 21 AGs who sent a letter to Biden contesting the vaccine mandate for federal contractors, WLOX reported.
David Berteau, president and CEO of the Professional Services Council, which represents over 400 companies, told Government Executive the association is “watching [the cases] closely, but in the meantime, the important thing to note is that you have a signed contract, and ...you're going to comply with the clause. That’s the way contracts work.” This applies in other situations, such as government shutdowns, in which “just because the customer isn't open doesn't mean you stop working on your contract.”

The more the .gov ramps up the pressure, and the more I have prayed about it, the more sure I become that I'm doing the right thing by refusing their poison. That reassurance gives me strength for what will surely be a bigger fight to come. They're not going to get me. As someone else wrote recently, I also feel pretty cool about the fact that I survived the biggest psyop in world history.
