Nevada Republican State Delegates File Suit Against State Party

RENO, NV, July 18, 2008—Nevada State Republican delegates have filed a complaint in Second Judicial District Court late this evening, contending that the Nevada Republican Executive Committee’s decision to appoint national delegates is in violation of State law. The complaint alleges that the GOP’s decision to appoint delegates to the Republican National Convention violates NRS 293 because state delegates have been deprived of their ability to select national delegates at a convention. “The State Executive Committee announced yesterday that they won’t bring the Nevada State Republican Convention out of recess,” said Wayne Terhune, a Republican activist in Washoe County. “They shut down the Convention in April, and now they aren’t giving delegates a chance to have their voices heard. This is a violation of the law.” The complaint alleges that the State Executive Committee’s decision is in violation of NRS 293, which states: “In addition to such powers granted it, the state convention shall select the necessary delegates and alternates to the national convention of the party”. The complaint has been filed by local attorney Mark Goodman on behalf of several Nevada State Republican delegates. Mike Weber, a local Republican who has served on the National Republican Rules Committee, announced early today that he is shifting the focus of his State Assembly race to make sure that the state delegates have their voices heard. “Most Republicans are getting fed up with party leaders because of underhanded tactics instead of principled leadership,” he said in a press release. “The announcement that national delegates will be appointed by a small group behind closed doors only reinforces this distrust.”

“The actions of the State Party are taking away the voice of every state delegate,” said Terhune. “Over a thousand delegates attended the convention in April, and the State Executive party officials are attempting to silence all of them. This is completely against the traditions of the Republican Party and the United States of America.”

Paul got a very good showing in Nevada which is why they shut down the convention. Regardless of party or nominee, any illegal voting activity must be addressed and we should be vigilant to expose it. Our country is supposed to have free elections, whether that actually happens or not. Too many good people have died for that right.

AND IMO where this ought to be resolved, as it's not LAW but RULES that governs....

Hearing Set For Republican Convention Lawsuit

Washoe District Judge Jerry Polaha has scheduled a hearing at 10 a.m. Friday on the lawsuit filed by the Republican delegates fighting the party's decision to cancel its state convention before electing national delegates. The party's executive board is scheduled to appoint delegates to the national convention in a private conference call Friday evening. More than 20 delegates from an insurgent convention in June have sued to stop the board from doing so.

In a brief meeting with lawyers for both sides this afternoon, Polaha rejected a request from the breakaway Republicans for a temporary restraining order against the party. Instead, he will decide the injunction (which does essentially the same thing) several hours ahead the party's scheduled conference call.

Let me tell you something, I was a delegate to the Rep state convention here in my state; and let me just say that I was absolutely appalled by what I experienced.
  • Members with McCain buttons physically restraining properly elected delegates from addressing the floor via the microphones
  • Even though one of our jobs at the convention was to elect delegates for the national convention, two huge (must have been 50 feet by 50 feet) banners were already hanging from the rafters, the opening morning of the state convention, listing the national delegates and alternates from our state (hmm, how could they have known BEFORE WE VOTED exactly who the national delegates were going to be?!?!?)
  • The floor being forcefully closed for discussion while there were still delegates waiting in line at the microphones (including one who wanted to call a vote of no confidense in the current state party chairman, and another who wanted to call a vote for (can't remember the leagal term he used) a complete closure and 're-do' of the convention - both of which got a HUGE round of applause by the general delegates at first mention, but they were silenced).
  • A man wearing a McCain hat and button sitting in the balcony in front of the crowd with a 'yes' and 'no' sign - which he displayed for every vote to help 'queue' or 'school' any delegates who may have been naive or new and unsure of what to do.
  • Etc.

I believe that the floor (the delegates) for the most part were/are honest and well-intentioned citizens who want to be involved in the political process of these united states . . . however, the party chair and the main party leaders (whether they know it or not) are either managing the state party them selves - to their wishes and desires, or being manipulated from even higher personel to their wishes and desires.

I have to tell you, I was disillusioned in the whole political process before I got deeply involved last year . . . and now that I've actually been involved to a deeper level than an ordinary sheeple/citizen . . . I'm even MORE dissillusioned! What an entirely complete and absolute sham!

At this point, the only viable solution is what Jefferson suggested we do every 20 years.

UPDATE: NV Delegates vs. State GOP Court Case
July 24, 2008Dear Nevada Patriots,
A hearing has been scheduled for this Friday, July 25th, at the Washoe County Courthouse in Reno, Nevada (75 Court Street). The hearing will begin at 10 am.
This will probably be when the final decision is made (excluding appeals); the Judge wants to decide the matter on that day. Our suit is asking the Judge to stop the GOP in their attempt to bypass the delegates and appoint a slate to go to national.
As you are probably aware, Ron Paul supporters around the country are watching this case. The implications of this decision could be very important.
We are determined that we will do all we can to assure the rights of Nevada State delegates are represented, not trumped by a small cadre of GOP executives. This court case is one part of that battle.
We are aware that there has been talk of a rally/demonstration outside the Courthouse. IF anyone wants to show their support for our cause by showing up outside the Courthouse on Friday morning, PLEASE be respectful of the court and please don't cause any disturbances/disruptions.
Media will most likely be present as well.

Would like to understand the reasoning that the court used to negate the complaint -- as it stands now, and with little supporting info, one COULD interpret this ruling to mean that national political party organs can monopolize the candidate selection process, de facto freezing out the citizenry in the process.

OWNED comes to mind.

Judge Lets NV GOP Appoint Convention Delegates

A Nevada judge says he won't stop the state Republican Party from appointing delegates to the GOP National Convention.

Washoe County District Judge Jerry Polaha said Friday the court has no jurisdiction to hear a lawsuit challenging the state's party's decision to appoint delegates.

The judge sided with David O'Mara, an attorney for the Nevada GOP.

He argued that political party disputes should be settled by the parties, not the courts.

More than two dozen delegates who attended the Nevada GOP convention in April filed a lawsuit contending that state law requires state convention delegates to select national delegates.

Plaintiffs say they haven't decided yet whether to appeal to the Nevada Supreme Court.

Publis: The Judge is full of BS - the issue at hand is the State Republican Party's violation of NRS 293, a STATE law. He clearly DOES have jurisdiction, but doesn't want to rule against the fatcats that probably put him in office in the first place, so he rules (illegally) that he doesn't have jurisdiction, and the Citizens of NV get Screwed!

Hopefully the Plaintiffs will file an emergency appeal citing reversable Judicial Error - Judge deciding he doesn't have jurisdiction over violations of State Law!
