The Senate majority leader is moving quickly to confirm appointments to the Circuit and District Courts — likely leaving few vacancies for the next potential Democratic president.

Senate Majority Leader Mitch McConnell and his GOP caucus have long prioritized confirming conservative judges to lifetime appointments. But they’re about to accelerate their ability to unilaterally approve many nominees in dramatic fashion.

The Senate is on track to confirm the 34th Circuit Court judge of Trump’s presidency in the next week and the GOP has three more ready for floor action; that would give Trump roughly 20 percent of the Circuit Court seats in the country after just two years in office. At this rate, McConnell and Trump could leave few, if any, vacancies there for a potential Democratic president in 2021.

Even more alarming for Democrats, the GOP is also preparing to pull the trigger on the “nuclear option” and change Senate rules once again with a simple majority to allow much quicker confirmation of lower court judges in the coming months.

“The committee is working to put [judges] out on the floor and as soon as they come to the floor the leader’s making it a priority to move them,” said Sen. John Thune of South Dakota, McConnell’s top deputy. “It'll be a high priority for the foreseeable future. I mean, it’s one of the things we can do that we don’t need the House’s help with.”




With the House controlled by Democrats, stocking the judiciary is the most tangible way for Republicans to deliver conservative results during divided government.

It’s not that the Senate GOP has no legislative plans. There’s a budget deal to be had to lift stiff spending caps and an inevitable debt ceiling drama to address. But McConnell’s focus remains squarely on bending the arc of the courts to be more supportive of Trump and future GOP presidents, particularly as the fight over the direction of the country shifts increasingly to the courts.

Though Trump and McConnell have set an impressive pace at the Circuit Court level, they’ve lagged on District Court vacancies. But that is likely to change as Republicans prepare to sideline Democrats and shave debate time from 30 hours to just two hours for those judges and lower-level executive branch nominees.

Trump currently has 128 District Court vacancies to fill, and each one can take multiple days under current rules if any senator demands a delay; if Republicans change the rules, Trump could conceivably fill most of those over the next 20 months.

“What you could witness under Senator McConnell's leadership is a situation where an incoming president has very, very few open seats to fill,” added Leonard Leo, a conservative legal advocate who frequently advises Republicans on judicial nominations. Still, Democrats say some liberal judges will opt not to retire as long as Trump is president.

In an interview Tuesday, Senate Minority Leader Chuck Schumer (D-N.Y.) outlined a potential compromise to avoid a “nuclear” clash: Reinstate Democrats’ ability to weigh in on home state Circuit Court nominees via the “blue slip” practice in exchange for bipartisan support for shortening debate on Trump nominees.

“My answer to them is restore the blue slips and then maybe we can come to a compromise,” Schumer said, adding that he had spoken to several GOP senators about it. “They’re eroding democracy, they’re eroding bipartisanship and sooner or later, they’ll regret it.”

Republicans scoffed at Schumer’s offer.

“We can get what we need without giving Democratic senators a veto on home-state circuit judges, said Sen. John Cornyn (R-Texas).

Democrats are outraged that Republicans are preparing to change the Senate rules with a party-line vote, as the GOP did to get Supreme Court Justice Neil Gorsuch confirmed and as Democrats did for nominees in 2013.

McConnell “kind of prides himself on being a Senate institutionalist. But what he’s trying to do to the Senate is dramatic and historic,” said Senate Minority Whip Dick Durbin (D-Ill.).

The longtime GOP leader accused Democrats Tuesday of “mindless obstruction” and said he hopes to overhaul the rules under the regular procedure, which requires 67 votes. But McConnell also suggested he’s ready to move forward even if Democrats do not support the change: “In the absence of [bipartisanship], it’s still my desire to try to achieve that.”

Republicans believe they have the required 50 votes for the nuclear option but are hoping to achieve complete caucus unity, which might prove difficult. Sen. Roy Blunt (R-Mo.) could be seen trying to sway Sen. Susan Collins (R-Maine) on the Senate floor on Tuesday during a vote.

Sen. James Lankford (R-Okla.) said McConnell is likely to move soon, but won’t call up the rules change on its own. Instead, he’s likely to set up votes on a nomination and then move to change the rules when and if Democrats resist.

“It suddenly becomes: This is the time to be able to challenge it. I think it’s sooner rather than later. I would anticipate it happens in March,” Lankford said.

Despite Republicans holding a majority in the Senate since the start of the Trump presidency, judicial nominations have not always gone smoothly. The government shutdown last year made it impossible to continue confirmations into the lame duck session and Schumer refused to cut any deals with McConnell on confirming a bipartisan package of judges after the midterm elections.

That means most Republicans feel like they have some catching up to do on judges and unfilled executive nominations.

“The last thing I heard [is] it would take up to 32 years if we continue the current pace and get every one of the Trump nominees completed,” said Sen. Tim Scott (R-S.C.). “You’re forcing the government to work in a dysfunctional way and we don’t need any assistance in that.”

Senate Confirms 37-Year-Old To Lifetime Seat On U.S. Circuit Court
Every Democrat opposed Trump nominee Allison Jones Rushing, who is going to be a federal judge for a long, long time.

WASHINGTON ― The Senate voted Tuesday to confirm Allison Jones Rushing, 37, to the U.S. Court of Appeals for the 4th Circuit, making her the youngest federal judge in the country.

The Senate voted 53-44 to put Rushing into the lifetime court seat. Every Republican present voted for her. Every Democrat present opposed her.


Democrats raised a number of concerns with Rushing, who is a partner at the D.C.-based law firm Williams & Connolly. She worked for Alliance Defending Freedom, a conservative Christian organization that has been classified as a hate group by the Southern Poverty Law Center. She has argued that there were “moral and practical” reasons for banning same-sex marriage. And some lawmakers said she simply lacks the experience or legal ability to be a federal judge.

“She has practiced law for nine years. How many cases has she tried to verdict or judgment? Four. Has she been the lead attorney on any of those cases? No,” Sen. Dick Durbin (D-Ill.) said on the Senate floor. “That is the most scant, weakest legal resume imaginable for someone who’s seeking a lifetime appointment to the second-highest court of the land.”

Like most of President Donald Trump’s court picks, Rushing is also a member of the conservative Federalist Society, which has been driving Trump’s judicial selection process and funneling anti-abortion and anti-LGBTQ nominees to the White House.

Sen. Thom Tillis (R-N.C.), who helped usher Rushing through the Senate confirmation process, defended her credentials.

“She is really considered one of the fast-rising stars in the legal profession,” he said. “She is clearly qualified to do this job.”

The Senate is voting on two more circuit court nominees this week, both of whom, like Rushing, are young, ideological and Federalist Society members.

Eric Murphy, 40, is up for a seat on the U.S. Court of Appeals for the 6th Circuit. He has fought to make it easier to disenfranchise voters and argued against marriage equality in the landmark 2015 Obergefell v. Hodges case before the Supreme Court.

Chad Readler, 46, is up for a seat on the U.S. Court of Appeals for the 6th Circuit. He filed a brief on behalf of the Trump administration in favor of striking down the Affordable Care Act’s pre-existing coverage requirement. He has also defended efforts to weaken voting rights and defended Trump’s ban on transgender people serving in the military.

Both are expected to be confirmed along party lines, though Sen. Susan Collins (R-Maine) said Tuesday that she’ll oppose Readler. Sen. Lisa Murkowski (R-Alaska) said Tuesday that she’s undecided on her vote regarding Readler.

Trump is dramatically reshaping the nation’s federal courts. With Rushing’s confirmation, he has now gotten 32 circuit judges, 53 district judges and two Supreme Court justices confirmed. That’s so many circuit judges ― more than any other president confirmed by this point in his first term ― that 1 in 6 seats on U.S. circuit courts is now filled by a judge nominated by Trump.

I also think McConnel is getting some serious heat back home in Kentucky and is using the confirmation votes to protect himself.

THIS is crap. It is the only provision of the ACA that I fully agree with.

Unless you are blessed with the misfortune of having a disease placing you in a 'protected' class (in TN that would be women with breast cancer, a primary caretaker of a disabled child, or someone with HIV), OR have the resources to find your own insurance, OR, are able to be re-employed IMMEDIATELY, employers will literally be throwing sick employees out to die.

In TN, no Medicaid, and no subsidy unless you make $1100 / month, then you can buy a policy and try to pay the copays and deductibles. If you make $1000 / month you will spend $1000 / month on insurance. You make less than that...you are screwed.

TN has a scandal with contract doctors rubber-stamping SSDI denials. Add that to the mix and you have people that worked their entire lives without care for treatable conditions.

I am lucky to have been unlucky. But others like me, with 'only' cancer, or diabetes, etc...are dying in TN now.

The problem with Schumer’s “blue slip” compromise is Dem Senators will veto any and all nominees in their State. It is a veto, not compromise.

bump for the day crew. The Blue Slip is essentially a ban on any judge who fails to get them. It was never intended to block the nomination, but only as a statement from individual senators. Mitch the Bitch should have voided the blue slips back in the spring of 2017 when the Democrats started a stall campaign.

I understand that Mitch the Bitch is now prepping for a single burst of 12 judges over the next few days. Trump has now appointed 12 out of the 29 Federal Judges on the Marxist 9th CIRCUS COURT. Now if we ever get a conservative 9th Circus court, Be Well will be dancing in the streets.:kaid:

The move by Senate Majority Leader Mitch McConnell (R-Ky.) immediately paves the way for quicker confirmation of President Donald Trump’s judicial and executive branch picks and comes amid deep GOP frustration with Democratic delays. Future presidents will benefit too, though McConnell and Trump stand to gain inordinately as they seek to fill 130 District Court vacancies over the next 18 months before the 2020 election.

The nuclear option — a change of the Senate rules by a simple majority — gained its name because it was seen as an explosive maneuver that would leave political fallout for some time to come. But it’s now been deployed three times in just six years amid continuous partisan warfare over nominations.

McConnell first sought to cut debate time on executive nominees, with the Senate voting 51-48 to overrule existing precedent. Later on Wednesday, McConnell will do the same for the District Court positions.

McConnell trashed Democrats’ “systematic obstruction” as he stumped for his effort on the Senate floor. His move is particularly consequential in divided government when much of the Senate’s time is now spent confirming executive nominees and lifetime judicial appointments. Under the change, debate time on District Court nominees and subcabinet executive nominees is slashed from 30 hours to 2 hours, a shift that will allow Republicans to fill dozens more vacancies over the coming months.

Lots and lots of lies apparently, because when Mitch McConnell got up there, he ripped Schumer up one side and down the other with nothing more than facts. No yelling, no bad words, just facts and history. It was glorious. He was in good form, once again.

I have had serious objections to some ot the decisions by Sen. McConnell.
But it is now time for the Republicans to circle the wagons and defend Sen. McConnell.

The Liberals, Globalists, Soros creatures will be after Sen.MoConnell now, big time.
He needs all our help and support.

I really dislike on both a political and personal level. Waaaaay back in the 1980's I was watching NBC's Dateline I think. they had a segment on how four Democrat Senators were living together in an apartment in DC, since they couldn't afford to buy a house there. they took a camera into Schummer's bedroom and I have to say I have seen cleaner teenager's rooms. Whatever else he is, Schummer is a pig in his personal habbits. Piles of crap all over the place for starters. :lol:
