Sen. Johnson for The Washington Times: Mandates are Exacerbating Social Divisions and Will Only Increase Pandemic Harms

Recently, The Washington Times published an op-ed by U.S. Sen. Ron Johnson (R-Wis.) regarding President Biden’s disregard for individual freedom and his unlawful vaccine mandates for working Americans.

Sen. Johnson sent a letter on September 15 to Dr. Anthony Fauci, Director of National Institute of Allergy and Infectious Diseases (NIAID), Dr. Rochelle Walensky, Director of the Centers for Disease Control and Prevention (CDC), and Dr. Janet Woodcock, Acting Commissioner of the Food and Drug Administration (FDA) regarding President Biden’s announcement of vaccine mandates in both the public and private sectors without making any exceptions for those who have been previously infected with COVID-19 and have natural immunity.

The COVID-19 pandemic has been the most disruptive and costly global event since World War II. The human toll and economic devastation are incalculable. The extent of the damage will not be fully felt or known for years. Much of the human toll and cost was self-inflicted and avoidable. The loss of freedom has been breathtaking, with too many accepting this loss without question and little resistance.

Those who have asked questions have been vilified, scorned, suppressed, and censored. There is so much about how governments and societies have responded to the pandemic that simply makes no sense, so legitimate questions and public skepticism continue to grow.

Well before President Joe Biden’s ill-advised and divisive vaccine mandate announcement, I had been hearing from doctors, nurses, first responders, college students, and others facing the life-altering decision of having to choose between losing their job or enrollment or being coerced into taking a vaccine they do not want. Many of these individuals have already been infected and recovered from COVID-19 and have natural immunity, which, unfortunately, is not being recognized in lieu of a vaccine.

Significant practical problems exist. We are already suffering severe worker shortages throughout our economy, especially in health care. Vaccine mandates will increase these shortages, leading to disastrous consequences. There have already been reports on how mandates could weaken military readiness. I have been inundated with testimonials from health care professionals that paint a dire picture of current shortages and an even more dire future if mandates are enforced.

There continues to be much we don’t know about the coronavirus, COVID-19, and COVID-19 vaccines. A little modesty on the part of those in authority admitting they don’t possess perfect knowledge or policy prescriptions would be welcome. We have all faced fear, doubt, isolation, and stress throughout the pandemic. We have been forced to make crucial decisions with partial, imperfect, and often conflicting information. With this in mind, it would also be nice if everyone would afford each other much more respect as we all make difficult, personal choices regarding vaccination. Too much freedom and personal health autonomy have already been lost during the pandemic. Let’s not compound that loss with unnecessary vaccine mandates.

So, St. Anthony Fauci has come down from his mountain top with a new list of “thou-shall-nots” and the news that it is “too early” to say whether he will allow families and friends to congregate for Christmas.



It is not too early for the body politic to engage in one gigantic spasm of retroperistalsis and expel that tyrannical medical pest from the community.

After all, Dr. Fauci is the chap who tells anyone who will listen that, when it comes to vaccine mandates, “There comes a time when you do have to give up what you consider your individual right of making your own decision for the greater good of society.”

Ah, yes, “greater good of society”—as defined, it goes without saying, by A. Fauci.

It is long past time for this fomenter of hysteria to go. He has being terrorizing the American populace for decades.

Give him a padded cell, a mirror, and a TV camera and he will be happy.

Back in the 1980s, Fauci was a superspreader of the myth that an important vector for the transmission of HIV was heterosexual intercourse.

For the last couple of years, he has been terrifying the public with tales from the crypt about the virus he helped develop with American taxpayer money for “gain of function” research in a Chinese virology lab in Wuhan.

The fact that this Bela Lugosi of the medical establishment is also a publicity addict who can’t pass a television camera without primping and dispensing contradictory but depressing dicta makes him a public nuisance.

You see his baneful influence everywhere.
In our former newspaper of record, for example, The New York Times.

On Oct. 1, the Times ran one of its long emetic specials on COVID, the Delta Diaries.

Deploying their signature mixture of nauseating human interest pabulum and tendentious statistics, they paid homage to the CCP virus for giving them something to write about now that Donald Trump is, for the time being, off the menu.

According to the Times, the fact that the deaths of 700,000 people in the United States have been attributed to the virus means that it is now officially more deadly than the Spanish ’flu epidemic of 1918, which killed about 675,000 people in the United States.

Remember the old saw about “lies, damned lies, and statistics”?

The Times specializes in that wheeze.

The CCP Virus can be serious, no doubt about it. But it represents a significant threat to a tiny part of the population, mostly the elderly, especially those with certain co-morbidities like diabetes and obesity.

The Spanish ’flu, by contrast, cut a wide swathe through the young and healthy.

The so-called Delta variant seems to be more infectious but less virulent than the original.

It has affected some younger people, much to the delight of the Times and other members of Fauci fan club.

But the Times story is just the Gray-Lady version of a domestic-strife story like those in the sensationalistic rags you see in the supermarket checkout line. “Betts and Andy on the Rocks: What Really Happened on Their Honeymoon.”

Now on to those numbers.

One critical distinction you won’t find mentioned in the Times cri-de-coeur is the difference between dying from the CCP virus and dying with it.

Millions upon millions are infected.

It is, after all, a very contagious virus.

But not only is it the case that many who are infected experience mild or no symptoms, it is also the case that many who are infected with the virus and happen to die in fact die from other things.

Remember the chap who was in fatal motorcycle accident, spread like jam across the highway, but had his death listed as due to COVID because the goo “tested positive”?

Another set of numbers you rarely see in the reporting about COVID fatalities is the age of the people who died.

The average life expectancy for males in the United States is around 78.

If Mr. Smith, who suffers from diabetes and high-blood pressure, comes down with COVID and dies at 87, is his death due to COVID?

You see why I like to say that the great thing about COVID is that it abolished death from old age.

It also essentially abolished death from influenza.

Generally there are anywhere from 20,000 to 40,000 deaths from the ’flu in this country per annum.

Last year there were some 700. Amazing.

The CCP virus is a seasonal respiratory virus. The key to public health regarding it is the achievement of herd immunity.

Masks, lockdowns, and “social distancing” impede achievement of herd immunity.

The Harvard epidemiologist Martin Kulldorff and Stanford’s Dr. Jay Bhattacharya got it exactly right when they wrote last spring that “The idea that everybody needs to be vaccinated is as scientifically baseless as the idea that nobody does.

COVID vaccines are essential for older, high-risk people and their caretakers and advisable for many others. But those who’ve been infected are already immune.”

At last, the clear voice of common sense—which is also, by the way, the voice of that “science” we’re supposed to be following.

Messrs. Kulldorff and Bhattacharya go on to offer these wise observations:

• “Vaccine passports are unjust and discriminatory.”
• “Most of those endorsing the idea belong to the laptop class—privileged professionals who worked safely and comfortably at home during the epidemic.”
• “Millions of Americans did essential jobs at their usual workplaces and became immune the hard way. Now they would be forced to risk adverse reactions from a vaccine they don’t need.”
• “Passports would entice young, low-risk professionals, in the West and the developing world, to get the vaccine before older, higher-risk but less affluent members of society. Many unnecessary deaths would result.”
• “The widespread use of vaccines against polio, measles, mumps, rubella, rabies and other pathogens has saved millions of lives. Vaccines are one of the most important inventions in human history—the reason that before last year many in the West had forgotten that infectious disease could pose a population wide threat.”
• “Those pushing for coercive COVID vaccination threaten all this progress by undermining public trust in vaccines. In this sense, they are more dangerous than the small group of so-called anti-vaxxers have ever been.”

What a pity that the media did not elevate experts like Martin Kulldorff and Jay Bhattacharya to the sacrosanct position it saved for Anthony Fauci.

We all would have been saved a great deal of irritation not to mention economic ruin and political despotism.

Patients with T2D had elevated blood glucose levels but there were no notable differences in levels between surviving and non-surviving patients with T2D.

Patients with diabetic nephropathy or a combination of diabetes and obesity have a substantially higher risk of COVID-19 mortality, a study published in the Journal of Community Hospital Internal Medicine Perspectives reported recently.

Diabetic nephropathy—also called diabetic kidney disease—is a serious kidney-related complication of type 1 diabetes (T1D) and type 2 diabetes (T2D).

“Various conditions have been reported as predictors of an unfavorable outcome in COVID-19 patients,” the study authors said, adding that the “most severe cases seem to occur in the elderly or in patients with distinct comorbidities including cardiovascular disease or diabetes.”

Besides COVID-19, the authors noted that T2D is also a risk factor in patients infected with other viruses such as influenza, respiratory syncytial virus, SARS-coronavirus, and MERS-coronavirus.

According to the study, diabetic nephropathy and the combination of T2D and obesity had the highest COVID-19-related death rate of all studied risk factors at more than 70%. “Prominent laboratory findings were an impaired kidney function and lymphocytopenia, which were significantly pronounced in the group of diabetes patients with a poor outcome,” the authors said.

Researchers analyzed laboratory and radiologic findings from 75 hospitalized COVID-19 patients and their respective comorbidities at the Kliniken Hochfranken Munchberg, a German community hospital. All 75 patients showed COVID-19 symptoms, including fever, cough, and shortness of breath, and were hospitalized at some point between March 2020 and August 2020.

The mean age was 74.2 years (22–99 years), with 40 male and 35 female patients.

Twenty-three patients did not survive (30.7%) and 11 patients were treated at the hospital’s intensive care unit (ICU), with 10 ICU patients requiring mechanical ventilation. The average age of patients who survived was 71 years while nonsurvivors were significantly older at 81.6 years (P < .0005); the death rate in male patients was higher than in female patients (37.5% vs 22.9%; P = .315).

In total, 26 patients with COVID-19 had T2D. Patients with T2D alone showed an increased death rate (46.2%), but patients with T2D and any diabetes-associated organ complication were at higher risk (57.9%). Specifically, patients with diabetic nephropathy had the highest percentage of non-survivors (73.3%, P = .0082), with obesity being the second highest risk factor (71.4%, P = .0155).

Patients with COVID-19 and congestive heart failure or chronic kidney disease also had an increased mortality risk, at 57.9% and 56%, respectively.
The study also showed that surviving patients with T2D required a significantly prolonged hospital treatment compared with patients without T2D (22.3 days vs 11 days; P = .0096).

Blood glucose was elevated in patients with T2D (P < .001), however there were no notable differences in blood glucose levels between surviving and non-surviving patients with T2D. Renal function was impaired in both surviving and non-surviving patients with T2D. Lymphocyte count and glomerular filtration rate were also notably impaired in non-surviving patients with COVID-19 and T2D.

“As an impact of blood glucose levels on radiologic findings in COVID-19 has been discussed previously, we analyzed and compared chest computed tomography (CT) images obtained from our patients,” the authors said. “We did not observe any striking differences comparing diabetes patients to the non-diabetes group.”

Kaiser Permanente suspends 2,200 of its employees nationwide over vaccine mandate

Kaiser Permanente has suspended more than 2,200 of its employees nationwide that have refused to get vaccinated against COVID-19. The health care company has more than 220,000 employees across the country. The suspensions impact about 1% of its workforce.

SACRAMENTO, Calif. - Kaiser Permanente has placed more than 2,200 of its employees nationwide, who have refused to get vaccinated against COVID-19, on unpaid administrative leave.

The health care care company announced its vaccine mandate on August 2 with a deadline of Sept. 30. It has more than 220,000 employees across the country.

The suspensions impact about 1% of its workforce.

"We will continue to work with this group of employees to allay concerns and educate them about the vaccines, their benefits, and risks," a Kaiser spokesperson said on Tuesday.

Kaiser said the number of unvaccinated workers is declining each day.

Employees have until December 1, 2022 to get vaccinated to be able to return to work or risk losing their jobs.

Any citizens caught protesting or violating these restrictions have often been subjected to violence from Australian law enforcement, who have seemingly become emboldened in their newfound role as government henchmen.

While Prime Minister Scott Morrison recently acknowledged the nation’s “covid zero” policy is “not a sustainable way to live,” he has also said Australia will only reopen its borders and end lockdowns when 80 percent of the population has been fully vaccinated. Judging by the tyrannical nature of Australia’s COVID restrictions thus far, the government’s vaccination push looks to be just as satanic.

According to News.com.au, Australia’s national government is set to announce the implementation of “new ‘no jab, no pay’ rules for all health workers,” which is set to include “public hospitals, ambulance services, private hospitals, GPs, private nurse offices and consulting offices.” Pharmacies and private pathology centers will also be covered by the new requirements, as well as “student nurses and doctors on work experience placements and Defence Department health services.”

States have also begun to gin up rules for how they plan to segregate society based on vaccination status, with New South Wales (NSW) government officials warning that individuals who choose not to get the jab will lose their recently granted freedoms when the state lifts restrictions later this month.

“So there will be individuals in regional and rural NSW who choose not to be vaccinated who will lose their freedoms on October 11,” said recently resigned NSW Deputy Premier John Barilaro.

“I think today is a very disappointing day for those who aren’t vaccinated. I think they assumed when we hit 80 per cent double dose they would have certain freedoms,” added recently resigned NSW Premier Gladys Berejiklian. “It is not too late. You have the option, go today, make your booking and get vaccinated not only to protect yourself and your loved ones but also the community.” NSW residents who opt out of getting the shot will be forced to remain in lockdown until Dec. 1.

While some U.S. politicians such as Florida Gov. Add to the mix White House chief medical advisor Dr. Anthony Fauci, who recently let the cat out of the bag during a lecture at McGill University when he told Canadians opposed to vaccine mandates and passports that “there comes a time when you do have to give up what you consider your individual right of making your own decision for the greater good of society.”

Time and again throughout the pandemic, Biden and company have routinely demonstrated that they aren’t the least bit concerned with preserving the constitutional liberties of the American people. According to a new report, there was a dramatic increase in PCR test orders in China during the second half of 2019, prior to the first reported case of COVID-19.

The study, conducted by Internet 2.0, concludes that based on the data analyzed, the virus was likely to be spreading in Wuhan, China as early as the summer of 2019 and most definitely by early fall of 2019.

The study also identified significant and abnormal purchases of PCR equipment in Wuhan by the People’s Liberation Army Airborne Army Hospital in May of 2019, the Wuhan Institute of Virology in November of 2019, the Wuhan University of Science and Technology in October of 2019 and the Hubei Province Districts Centers for Disease Control and Prevention from May until December of 2019.

In all, the total PCR procurement purchase price increased from 2015 to 2018, until a dramatic increase was identified in 2019: 10.1 million Yuan in 2015, 19.1 million Yuan in 2016, 29.1 million Yuan in 2017, 36.7 million Yuan in 2018 and a whopping 67.4 million Yuan in 2019.

Additionally, the total count of PCR procurement contracts year over year also saw similar increases: 52 contracts in 2015, 53 in 2016, 72 in 2017, 89 in 2018 and 135 in 2019. The Wuhan University of Science and Technology, Wuhan CDC, Hubei CDC and the Institute of Husbandry and Veterinary Medicine combined were the primary purchasers that drove the overall increase from 2018 to 2019.

“These findings challenge existing assumptions around when the pandemic began and support further investigation,” the study reads. “The study concludes that a significant increase in spending in PCR equipment correlates to the spread of COVID-19.”

“We assess with medium confidence the significant increase from 2018 to 2019 in Hubei province is due to an event like the emergence of COVID-19,” it continues. “We assess with high confidence that the pandemic began much earlier than China informed the WHO about COVID-19.”

Alex Jones of Infowars made a special broadcast on Monday night regarding an explosive video of Fauci with HHS officials and other health experts discussing how to enforce Universal Flu Vaccination in a summit organized by Milken Institute in Washington, DC last October 2019.

Alex Jones highlighted three clips from the hour-long video of the summit from C-SPAN which proved the COVID-19 pandemic was planned and the Big Pharma worked with the UN and other corrupt government officials to develop and release the COVID-19 virus ahead of ‘Great Reset’.

The first clip featured Michael Specter, a journalist from The New Yorker and also an adjunct professor of bioengineering at Stanford University, Anthony Fauci, the director of the National Institute of Allergy and Infectious Diseases, and Rick Bright, the director of HHS Biomedical Advanced Research and Development Authority (BARDA).

In this video, they conceptualized having a new outbreak of novel avian flu virus from China so they can bypass the method of FDA approval and enforce mRNA vaccine to the masses.

Here’s the transcript:

Michael Specter: Why don’t we blow the system up? I mean obviously, we can’t just turn off the spigot on the system. We have and then say, hey everyone in the world should get this new vaccine that we haven’t given to anyone yet. But there must be some way that we grow vaccines mostly in eggs the way we did in 1947.

Fauci: In order to make the transition from getting out of the tried-and-true egg growing which we know gives us results that can be beneficial, I mean we’ve done well with that. There must be something that has to be much better. You have to prove that this works and then you’ve got to go through all of the clinical trials: phase 1, phase 2, phase 3, and then show that this particular product is going to be good over a period of years. That alone, if it works perfectly, it’s going to take a decade.

Bright: There might be a need or even an urgent call for an entity of excitement out there that’s completely disruptive, that’s not beholden to bureaucratic strings and processes.

Fauci: So we really do have a problem of how the world perceives influenza and it’s going to be very difficult to change that unless you do it from within and save.. I don’t care what your perception is, we’re going to address the problem in a disruptive and in an iterative way because she does need both.

Bright: But it is not too crazy to think that an outbreak of novel avian virus could occur in China somewhere. We could get the RNA sequence from that.. to a number of regional centers if not local, if not even in your home at some point, and print those vaccines on a patch of self-administer.

Joining Fauci, Rick Bright, and Michael Specter at this event were: Margaret Hamburg, Foreign Secretary, National Academy of Medicine, Bruce Gellin, President, Global Immunization, Sabin Vaccine Institute, Casey Wright, CEO, FluLab.

In short, this panel discussion focused on what they perceived as the need for a universal flu vaccine, but they admitted that the old way of producing vaccines was not sufficient for their purposes, and that they needed some kind of global event where many people were dying to be able to roll out a new mRNA vaccine to be tested on the public.

They all agreed that the annual flu virus was not scary enough to create an event that would convince people to get a universal vaccine. And as we now know today, about 2 years after this event, that “terrifying virus” that was introduced was the COVID-19 Sars virus.

And so now we know why the flu just “disappeared” in the 2020-21 flu season. It was simply replaced by COVID-19, in a worldwide cleverly planned “pandemic” to roll out the world’s first universal mRNA vaccines.

This was always the goal, and previous efforts through various influenzas, AIDS, Ebola, and other “viruses” were all unsuccessful in leading to the development of a universal vaccine to inject into the entire world’s population.

Margaret Hamburg stated regarding getting a “Universal Vaccine” into the market: “It’s time to stop talking, and it’s time to act… I think it is also because we haven’t had a sense of urgency.”

Michael Specter asked: “Do we need lots of people to die for that sense of urgency to occur?”

Hamburg replied that: “There are already lots of people dying” from the flu each year.

Bruce Gellin stated that basically people just are not afraid enough of the term “the flu.”

There are so many things that are revealed about how Big Pharma and government health authorities think in this panel discussion. For example, they bemoan the fact that if they do too good of a job in public health, then they lose funding to develop products that fight viruses.

Michael Specter states: “It seems to me that one of the curses of the public health world is, if you guys do your job well, everyone goes along well and healthy.”

Hamburg: “And they cut your funding.”

Rick Bright complains that the yearly distribution of flu vaccines is inefficient in terms of collecting data, and in the process actually admits that some vaccines just don’t work well:

“We distribute 150 million doses of the seasonal (flu) vaccines every year, we don’t even know how many people are being vaccinated from the doses that are delivered to the people, which doses they got, and what the real outcome was, so that we can learn from that knowledge base on how to optimize or improve our vaccine. So there are opportunities that we have today…

I think if we uncloaked the poorest performing vaccines in the market place today, it might be very revealing to tell us which of the technologies we have, and allow us to go deeper into those technologies to determine why they are more effective. There are vaccines licenses today that are more effective. I think that we’re just afraid to admit the truth.”

What a surprise!
The mainstream fake news media hailed the news last week that Merck Corporation had discovered a drug treatment for the COVID virus.

This comes over a year after the discovery that hydroxychloroquine was successful in treating the coronavirus in its early stages and months after it was discovered the Ivermectin had amazing success in treating the coronavirus, especially in India.

Merck is not just giving their new drug away. The company is charging the US government 40 times what it costs to produce their new wonder drug.
It’s another win for Big Pharma

The Intercept reported:

A FIVE-DAY COURSE of molnupiravir, the new medicine being hailed as a “huge advance” in the treatment of Covid-19, costs $17.74 to produce, according to a report issued last week by drug pricing experts at the Harvard School of Public Health and King’s College Hospital in London. Merck is charging the U.S. government $712 for the same amount of medicine, or 40 times the price.

Last Friday’s announcement that the new medicine cut the risk of hospitalization among clinical trial participants with moderate or mild illness in half could have huge implications for the course of the coronavirus pandemic. Because it’s a pill — as opposed to monoclonal antibodies, a comparable antiviral treatment that is administered intravenously — molnupiravir is expected to be more widely used and, hopefully, will cut the death rate. In the first 29 days of the trial, no deaths were reported among the 385 patients who received the drug, while eight of the people who received a placebo died, according to the statement put out by Merck and Ridgeback Biotherapeutics, the two companies that are jointly launching it.

In addition to having huge implications for health, the pill could bring staggering profits to both Merck and Ridgeback Biotherapeutics. A small Miami-based company, Ridgeback licensed the medicine from Emory University in 2020 and two months later sold the worldwide rights to the drug to Merck for an undisclosed sum. Although Ridgeback remains involved in the development of the drug, some have described the deal as “flipping.”

The Los Angeles City Council on Wednesday passed a Covid vaccine mandate for all indoor restaurants, bars, shopping malls, theaters and more.

People in Los Angeles will have to show proof of Covid vaccination in order to enter most indoor venues starting November 6.

Grocery stores and pharmacies were not included in the new sweeping ordinance.

Enforcement will begin November 29 and businesses that violate the mandate will be fined up to $5,000.

Businesses will be fined $1,000 fine for its second violation, $2,000 fine for a third violation and a $5,000 fine for a fourth violation, CBS Los Angeles reported.

CBS Los Angeles reported:

The Los Angeles City Council Wednesday approved a sweeping ordinance that will require proof of a COVID-19 vaccination to enter restaurants, bars, shopping centers and other establishments.
The ordinance will apply to:

• Restaurants, bars, fast food establishments, coffee shops, tasting rooms, cafeterias, food courts, breweries, wineries, distilleries banquet halls and hotel ballrooms.
• Gyms and fitness venues, including recreation facilities, fitness studios (including for yoga, pilates, dance, and barre), boxing gyms, fitness boot camps and facilities that hold indoor group fitness classes.
• Entertainment and recreation venues including movie theaters, shopping centers, concert venues, performance venues, adult entertainment venues, commercial event and party venues, sports arenas, convention centers, exhibition halls, museums, malls, performing arts theaters, bowling alleys, arcades, card rooms, family entertainment centers, pool and billiard halls, play areas and game centers.
• Personal care establishments, including spas, nail salons, hair salons, barbershops, tanning salons, estheticians, skin care, tattoo shops, piercing shops and massage therapy locations, unless medically required.
• People will be exempt from the mandate if they have medical conditions that restrict their ability to get vaccinated or a “sincerely held religious belief,” which will be reviewed by the location the person is trying to enter. People who are exempt would be able to use outdoor areas of the location, but if unavailable, they may be allowed to enter the indoor area by providing proof of a negative COVID-19 test.The ordinance will also require people to show proof of vaccination or a negative COVID-19 test to attend outdoor events with 5,000 or more people.

An unvaccinated Wisconsin high school freshman was targeted with a court order to quarantine at home under guard last week because she refused to stay home from school after exposure to a COVID infected person because the student had natural immunity from a COVID infection earlier this year.

Mikaila Spiess, a 14-year-old Eau Claire high school freshman, fought back against a health department order to stay home by showing up to school for classes. The school responded by placing Spiess in an empty room with the principal.

The health department then sought and obtained a quarantine order, enforceable by guards, which Spiess obeyed, however the guards were not deployed to her home.

This past weekend Spiess tested negative for COVID and was allowed to return to school.

Spiess’ mother, Kita Busse made her case public on Facebook, and the stunning story was reported by Wisconsin Right Now (excerpt):

An Eau Claire County judge, Sarah Harless, has ordered a 14-year-old Eau Claire teenager – Mikaila Spiess – temporarily quarantined, and the county is seeking her confinement for longer, after the girl refused to stay home from school after being labeled a “close contact” with someone who had COVID-19, court records show. The judge’s order even says “guards may be posted” at the girl’s home to make sure she doesn’t leave.

The school district obtained a “court order by the end of the day with four armed police officers ready to remove her from school,” the girl’s mother, Kita Busse, says. Now the teenager and school district are engaged in a civil court battle over the matter, she confirmed. The girl is quarantined at her home, Busse says.

Court records show that the judge, having reviewed the petition of the Eau Claire City-County Health Officer, ordered Mikaila Spiess temporarily confined “for the purposes of quarantine” pending a hearing held within 72 hours, excluding weekends and legal holidays.

The Eau Claire County Sheriff’s Department or City of Eau Claire Police Department were authorized to detain and transport Mikaila Spiess to her home in Eau Claire if necessary.

Empower Wisconsin reported that even after her negative COVID test on Sunday, the government barred her return to classes Monday while waiting on the court order to be resolved (excerpt):

After being locked out by an overzealous health director, Mikaila Spiess can finally go back to school.

An Eau Claire County judge today dismissed a public health court order requiring the 14-year-old Eau Claire high school freshman to remain in quarantine at home. A hearing slated for Tuesday has been canceled.

On Sunday afternoon, Mikaila tested negative for COVID-19, as she and her mother Kita Busse suspected she would.

But Eau Claire City-County Health Department Director Elizabeth “Lieske” demanded the girl stay home Monday until the judge resolved the case. It was the latest vindictive act from an overreaching unelected health bureaucrat, Busse said.

“Lieske (Giese) told me that she was prepared to remove (Mikaila) today if she shows up to school,” the mother said. The health czar truculently pushed her power trip even as the county attorney assured Busse the case would be dismissed upon the negative test result, Busse said…

Wisconsin radio host Dan O’Donnell wrote about Spiess’ battle, calling her Joan of Eau Claire (excerpt):

Fortunately, the spark of rebellion is still flickering and in Wisconsin it lies in a teenaged girl whose civil disobedience has exposed the absurdity of her city’s quarantine rules and made her into something of the state’s Joan of Arc.

Last week, Mikaila Spiess, a freshman at Eau Claire Memorial High School, was notified that she came into close contact with a classmate who tested positive for COVID-19. As a result, she would have to be quarantined for 14 days, or seven days if she tests negative.

Mikaila, who goes by the nickname Pixie, immediately recognized that this was unfair. Vaccinated students who show no COVID symptoms don’t need to quarantine at all, and although she is unvaccinated, she had contracted the disease earlier this year and has natural immunity…

When Jynaia Badie, a registered nurse and mother of five, dropped her son off at Durham Highschool to begin 9th grade in September, she happened to drive around the campus moments later to find him sitting outside, alone, at a desk in front of the school.

No one from the school called to notify her about her son, Jeremiah Badie, being punished.

“My son, without my knowledge, was sat – for the whole neighborhood to see – that he is wearing a scarlet letter because he’s choosing freedom,” Badie told the Gateway Pundit in an exclusive interview.

Prepared to torpedo truth at a wall of lies, Jynaia immediately demanded answers.

Unaware that the Badie family was surreptitiously recording him, Durham Unified School District Superintendent John Bohannon lashed out at Badie, warning the concerned mom that Jeremiah was no longer allowed in the classroom unless he “conforms” and complies with the COVID policy and agenda.

Jynaia wasn’t “allowing it to be” a good morning upon discovering her son is being deprived of school attendance because she has “a lot of – a couple of kids who are not following the mandate,” Bohannon scoffs.

Pressed on the legality of segregating, shaming, penalizing and isolating her sons, who claim religious exemption from the mandate, Bohannon instructed Badie to find her non-compliant children another school to attend.

“I encourage you, if you don’t like the rules here to go find a school in your home district where you can take your kids.” the superintendent continued. “We’re not going to argue. you need to leave. You are not allowed to be on campus.”

Pressed on the legality of segregating, shaming and isolating Jeremiah, the only non-white student enrolled in Durham High who claims religious exemption, Bohannon resorted to threatened to criminally hold Jynaiah accountable for trespassing on school grounds.

“Your son was perfectly safe, right here being supervised by staff. You guys need to leave. I’m going to go call the police right now,” he admonished. “Let me make this very clear. I will not call the cops on a student, but I will on adults who are not allowed on campus if you are interrupting education you are not allowed to be here.

“You are interrupting the work of my staff that’s here.”

Durham Highschool principal Robbin Perdett assured Jeremiah on Sept. 7, the first day of school, that he would only have to sit outside for the day after claiming a religious exemption from the mask mandate and that he would be marked “present” for attending the Jim Crow era-like “classroom.”

Yet, on Wednesday, Jeremiah attended school to sit outside by himself in front of the school as he has for the past five weeks later, while enduring intimidation and condescension from the school officials who mark him as absent each day.
“We are being segregated,” Jeremiah contends in an exchange he secretly recorded with the principal. “We’re not wearing the masks because we have an exemption.”

“You need to follow the policy. We’re not accepting those. You have to wear a mask,” the principal shot back, after warning Jeremiah to wear a mask or complete his freshman year alone on the lawn. “I really don’t want you here. So, everything that you want, is what I want.”

Meanwhile, Jynaia received notice on Wednesday morning that her five-year-old daughter is now banned from attending school in the Durham school district.

The nurse suspects Bohannon and the Durham school districts staff are eager to target her Trump-supporting family with the modern-day Jim Crow mandates.
“Racial slurs have been used. Someone called my son a f**ing n**ger. [Bohannon] told [my son] he’s not allowed to be upset,” she explained. “My son had a Trump sticker on his truck and the teacher told him a black man voting for Trump is like a chicken walking themselves to KFC.

Durham High School physics teacher David Atkinson: “A black man voting for Trump is like a chicken walking themselves to KFC.”

“This same teacher is a teacher who locked my son out of the classroom – telling children in the classroom you better wear your ****ing masks. Being the only black parent in the Durham Unified school district and it’s really hard because I am teaching my children to love beyond color.”

Jynaia is urging all parents in her district to join her in filing a class-action lawsuit against the school district as she seeks legal representation and begins mounting the case on her own.

“We are all under attack but we are more strongly united. United we stand, divided we fall – we have to stand for what’s right even if we are standing alone. Right now, it feels like I am standing alone in my community, but I am willing to fight this fight,” she said. “I’ve called 200 attorneys trying to find a civil rights attorney is very hard in this day and age.

“I know there is someone who is going to fight and if not, I’ve got a God and a mouth big enough to make this fight myself. I am an American and I will stand on my God-given freedoms and my constitution. Give me liberty or give me death.”

• Early findings suggest that the coronavirus could be prompting the pancreas to self-destruct.

The coronavirus could be harming vital cells in the pancreas and leaving people with diabetes, according to new research being pursued by scientists.

The relationship between COVID-19 and diabetes is poorly understood and scientists don't yet have definitive answers.

But as the pandemic progressed, a growing number of reports suggested that people who caught COVID-19 were noticing diabetes symptoms for the first time. It is too soon to say whether the condition is permanent.

"Clearly there's a link, there's some sort of mechanism that makes the diseases fuel one another," Francesco Rubino chair of metabolic surgery at King's College London, told Insider. "The question is whether new-onset diabetes could be caused by this virus."

Diabetes is an excess of blood sugar, caused when the body is either not producing enough insulin, the hormone which lowers the blood sugar, or is becoming resistant to it.

One theory was that the body could be confusing pancreas cells for the coronavirus, and trying to destroy them. This would disrupt insulin supply and cause diabetes, the scientists thought.

But research suggests something else could be going on: the virus might be altering the pancreas, prompting it to destroy itself.

Pancreas malfunction
A hallmark of diabetes seen after COVID-19 is the extremely high levels of blood sugar people produce.

These, in turn, need high doses of insulin to counteract, Shiubing Chen, a researcher at the Department of Surgery, Weill Cornell Medicine, told Insider.
"This suggests there may be some acute damage of the pancreas," Chen said.
To understand what is happening in the pancreas, Chen and her team looked at autopsy samples from five donors with COVID-19. They also gave the coronavirus to cells taken from healthy human pancreases in a laboratory.
Their findings were published in the peer-reviewed journal Cell Metabolism on August 3.

The researchers found that after infection, the insulin-producing cells of the pancreas started acting strangely.

They made much less insulin and instead started making glucagon — the chemical which has the opposite effect.

The cells also started making trypsin, a digestive enzyme, and chemokines, a type of substance that tells the immune system cells are sick and should be destroyed.

Whether this effect is severe enough to cause diabetes to develop where before there was none is something "we don't know yet," Chen said.

It is not clear how COVID-19 interacts with diabetes
It is plausible that the coronavirus could change the function of the beta cells, said Rubino, the metabolic surgery expert.

But there could be other reasons, he said. It is possible, for instance, that some of the people already had diabetes before catching COVID-19, but were never aware of it.

Rubino has helped put together a registry for cases of new-onset diabetes he hopes will shed light on the issue.

It is not clear how long symptoms of diabetes will last after infection, Rubino and Chen said. Both advised that it is best to avoid getting COVID-19 altogether by getting vaccinated.

Ellume is recalling nearly 200,000 rapid at-home COVID-19 antigen tests out of concerns over an abnormally high rate of false positives observed from certain lots of its tests.

Roughly 427,000 test kits, including thousands sent to retailers and some provided to the Department of Defense, have been impacted by the issue.

About 195,000 of these kits are still unused and subject to the recall. About 202,000 have already been used, the company said. Of those, there have been around 42,000 positive results, of which as many as a quarter of those positives could have been inaccurate. However, the company said it's difficult to determine an exact ratio.

Ellume is removing the affected product from store shelves and said distributors should cease distribution and quarantine those products immediately.

This recall yanks hundreds of thousands of rapid COVID-19 tests off the shelves at a time when demand for these tests has already skyrocketed. Amid shortages, many of the major retail pharmacy stores announced they are limiting purchases to contend with supply constraints.

Meanwhile, Ellume is notifying consumers, retailers and distributors affected by the recall. It's warning those consumers who have tested positive to take confirmatory tests, as their initial Ellume results may have been incorrect.

Ellume CEO Sean Parsons apologized for the incident, acknowledging how much rides on accurate test results during this pandemic.

"We understand that trust is central to fulfilling our purpose as a company, and we recognize that this incident may have shaken the confidence of some of those who trusted Ellume to help them manage their health and to take back a bit of control of their lives during this pandemic," Parsons said in a statement. "To those individuals, I offer my sincere apologies – and the apologies of our entire company – for any stress or difficulties they may have experienced because of a false-positive result."

"You have my personal commitment that we have learned from this experience, we have implemented additional controls to ensure our product meets our high quality standards and we are going to do everything in our power to regain your trust," Parsons said in the statement.

Ellume said it has identified the root cause as an issue in variation with one of its test kit's components, and said it has "implemented additional controls" and are "continuing to work on resolving the issue that led to this recall."

While the recall was triggered by false positives, the company said the reliability of negative results from its kits is unaffected by this issue: approximately 160,000 tests from affected lots produced negative results.

Merck Charging US 40 Times What It Costs To Make Govt-Financed COVID Pill

Merck's new 'not Ivermectin' Covid-19 treatment, molnupiravir, costs $17.74 to produce - yet the company is charging the US government $712 for the treatment - a 40x markup, according to The Intercept, citing a report issued last week by the Harvard School of Public Health and King’s College Hospital in London.

The pill, originally developed using US government funds as a possible treatment for Venezuelan equine encephalitis, cut the risk of hospitalization and death in half in a randomized trial of 775 adults with mild/moderate Covid who were considered at high risk for disease due to comorbidities such as obesity, diabetes and heart disease. The trial was stopped early so the company could apply for and emergency use authorization (EUA). The drug did not benefit patients who were already hospitalized with severe disease.

News of the oral 'wonder drug' sent shares of Merck higher last week, as the company says it can deliver 10MM doses by the end of the year.

Clearly, the pill could bring in massive profits to Merck and its partner on the drug, Ridgeback Biotherapeutics - which licensed the drug from Emory University in 2020 and then sold the worldwide rights to the drug to Merck for a sum which has not been disclosed.

Meanwhile, the Defense Threat Reduction Agency, a division of the Department of Defense, funded development of the drug by Emory University to the tune of $10 million between 2013 and 2015, according to nonprofit group Knowledge Ecology International discovered.



Yet, as Quartz points out, only Merck and Ridgeback will profit from the new antiviral - which they say "could be one of the most lucrative drugs ever," bringing in as much as $7 billion by the end of this year alone.

Despite its initial investment, the U.S. government seems to be facing a steep markup in prices. In June, the government signed a $1.2 billion contract with Merck to supply 1.7 million courses of the medication at the $712 price. The transaction is due to take place as soon as molnupiravir receives emergency use authorization from the Food and Drug Administration.

Good government advocates are pointing out that because federal agencies spent at least $29 million on the drug’s development, the government has the obligation to ensure that the medicine is affordable.

“The public funded this drug, and therefore the public has some rights, including the rights you have it available under reasonable terms,” said Luis Gil Abinader, senior researcher at Knowledge Ecology International. -The Intercept

Pushing back
Ridgeback co-founder Wendy Holman told CNBC in an interview last week that they asked for, but "never got government funding" for the manufacture of molnupiravir. The company also claimed in a press release touting the study that "since licensed by Ridgeback, all funds used for the development of molnupiravir have been provided by Merck and by Wayne and Wendy Holman of Ridgeback."

Critics, meanwhile, say the $700+ price point is absurd - with health advocates concerned that people some countries will not be able to afford the new drug.

"Offering someone a $700 treatment when they don’t yet feel that ill is going to mean that a lot of people are not going to take it," said King's College Hospital physician Dzintars Gotham, co-author of the report - which suggests that Merck would still reap a 10% profit margin if they priced molnupiravir at $19.99.

"If you can’t afford medicine because it’s 1,000 times more than you can afford, or because it’s 100 times more than you can afford, it doesn’t matter," said Melissa Barber, a doctoral candidate at the Harvard School of Public Health and co-author of the report on molnupiravir, adding "those are both bad."

Barber and Gotham acknowledge that the $17.74 cost of producing a five-day course of the antiviral pills is an estimate but said that the algorithm they used, and have employed to estimate the production costs for hundreds of drugs, tends to result in overestimates in the long run.

Meanwhile, the prices that private companies charge for drugs tend to go up rather than down. “For all these deals that have happened for therapeutics or vaccines, the price has only increased as uncertainty has decreased,” she said. “One price is given and then, for the next sale, the price goes up. The price went up for other drugs and vaccines, so I would be very surprised if this price didn’t go up, too.” -The Intercept

If only there were another option for mild-moderate Covid-19 cases that was inexpensive and used around the world for decades with an extremely positive drug safety profile.

Widely prescribed anti-parasitic Ivermectin (also made by Merck) has shown massive efficacy worldwide in the treatment of mild and moderate cases of Covid-19, plus as a prophylactic. India's Uttar Pradesh province, with a population of over 200 million, says that widespread early use of Ivermectin 'helped keep positivity [and] deaths low.'

Separately, there have been several studies funded by the Indian government, primarily conducted through their largest govt. public medical university (AIIMS).

• Role of ivermectin in the prevention of SARS-CoV-2 infection among healthcare workers in India: A matched case-control study (source)

Conclusion: Two-dose ivermectin prophylaxis at a dose of 300 μg/kg with a gap of 72 hours was associated with a 73% reduction of SARS-CoV-2 infection among healthcare workers for the following month.

• Ivermectin as a potential treatment for mild to moderate COVID-19 – A double blind randomized placebo-controlled trial (source)

Conclusion: There was no difference in the primary outcome i.e. negative RT-PCR status on day 6 of admission with the use of ivermectin. However, a significantly higher proportion of patients were discharged alive from the hospital when they received ivermectin.

• Clinical Research Report Ivermectin in combination with doxycycline for treating COVID-19 symptoms: a randomized trial (source, double-blind randomized, peer-reviewed)

Discussion: In the present study, patients with mild or moderate COVID-19 infection treated with ivermectin in combination with doxycycline generally recovered 2 days earlier than those treated with placebo. The proportion of patients responding within 7 days of treatment was significantly higher in the treatment group than in the placebo group. The proportions of patients who remained symptomatic after 12 days of illness and who experienced disease progression were significantly lower in the treatment group than in the placebo group.

Here are more human studies from other countries on the 'horse dewormer':

Peru:

• Sharp Reductions in COVID-19 Case Fatalities and Excess Deaths in Peru in Close Time Conjunction, State-By-State, with Ivermectin Treatments (source, peer-reviewed, University of Toronto, Universidad EAFIT)

For the 24 states with early IVM treatment (and Lima), excess deaths dropped 59% (25%) at +30 days and 75% (25%) at +45 days after day of peak deaths. Case fatalities likewise dropped sharply in all states but Lima

Spain:

• The effect of early treatment with ivermectin on viral load, symptoms and humoral response in patients with non-severe COVID-19: A pilot, double-blind, placebo-controlled, randomized clinical trial (source, University of Barcelona, peer-reviewed)

Findings: Patients in the ivermectin group recovered earlier from hyposmia/anosmia (76 vs 158 patient-days; p < 0.001).

Bengladesh:

• A Comparative Study on Ivermectin-Doxycycline and Hydroxychloroquine-Azithromycin Therapy on COVID-19 Patients (source - peer reviewed, though not govt funded)

Conclusion: According to our study, the Ivermectin-Doxycycline combination therapy has better symptomatic relief, shortened recovery duration, fewer adverse effects, and superior patient compliance compared to the Hydroxychloroquine-Azithromycin combination. Based on this study's outcomes, the Ivermectin-Doxycycline combination is a superior choice for treating patients with mild to moderate COVID-19 disease.

• A five-day course of ivermectin for the treatment of COVID-19 may reduce the duration of illness (source, peer-reviewed double blind randomized, though small sample size)

Discussion: A 5-day course of ivermectin resulted in an earlier clearance of the virus compared to placebo (p = 0.005), thus indicating that early intervention with this agent may limit viral replication within the host. In the 5-day ivermectin group, there was a significant drop in CRP and LDH by day 7, which are indicators of disease severity.

White House Plans To Quadruple COVID Rapid Testing Despite Decline In Cases

As more rapid at-home COVID tests are approved by American regulators, the Biden Administration is reportedly preparing another "investment" in rapid at-home tests (despite lingering criticisms about the frequency of false positives produced by these tests, helping to contribute to America's COVID "casedemic").

According to Bloomberg, the Biden Administration is preparing to announce a $1 billion purchase of rapid at-home COVID tests with the intention of "expanding the availability of such products in the coming months".
Of course, as we have reported time and time again, the more testing, the more cases. With this latest investment (which has yet to be officially announced) the US will be on track to 4x rapid testing capacity by December. The plan will involve distributing the free tests to an additional 10K US pharmacies, bringing the total number of free testing sites to 30K (including 20K pharmacies).


So far, rapid at-home testing has proven less reliable than lab testing. Despite this, the Biden Administration is still planning to pour billions of dollars into its effort to quadruple the level of COVID testing by December, according to BBG. According to an administration official who spoke with BBG, the US has been producing roughly 30MM rapid at-home tests a month - a figure that's expected to grow to more than 200MM a month by the end of the year.

The Administration is justifying the decision to increase testing with the fact that not enough American adults have been vaccinated (even though scientists now believe "herd immunity" is essentially out of reach for humanity, even if 90%+ of the population has been fully vaccinated).

Furthermore, this latest $1 billion commitment comes on the heels of a $2 billion investment in rapid testing announced by the administration last month (that order included buying tests from pharma giants Abbott Labs and Celltrion).

Biden is also using the Defense Production Act to help bolster production.
The FDA just cleared a rapid at-home test from Acon Labs. The agency says that test could double rapid at-home testing capacity in the weeks ahead as the company says it can produce more than 100MM tests a month by year's end.

Other manufacturers of rapid at-home tests include Abbott, Quidel Corp, Becton DIckinson, Access Bio and OraSure.

With cases finally declining in the US, authorities this week have praised Merck's new "miracle drug" that purports to successfully treat COVID if taken within 5 days of infection for both vaccinated and unvaccinated cases (if a patient can afford it).

But all of this isn't enough for the Biden Administration. Case numbers are falling, yet the White House continues to try and coerce unvaccinated Americans to accept the jab.

Bottom line: if you're excited to see COVID cases declining, just wait a few weeks until the White House can ramp up testing again and revive the "casedemic", triggering a new wave of media scaremongering, even if hospitalizations and deaths continue to wane.

President Joe Biden on Wednesday hoped relief was coming for Americans still suffering from the coronavirus pandemic, even as the country passed a grim milestone for deaths from the virus in 2021.

“God willing, I think we’re just about to turn the corner again on the pandemic,” Biden said during an event on the White House complex.

Biden spoke about the pandemic as more than 353,000 coronavirus deaths have been reported since January 1, 2020, according to an ABC News story citing data from Johns Hopkins University, which is more than the 352,000 deaths in 2020.

The news breaks as fewer Americans trust Biden’s leadership on the pandemic than when he first took office.

A Morning Consult/Politico poll released Wednesday shows that only 43 percent of Americans say that Biden’s handling of the coronavirus is excellent or good.

The majority of Americans, 52 percent, say Biden’s handling of the pandemic is either poor or fair.

The poll was conducted between Oct. 2-4 among a sample of 1998 registered voters.

Biden spent most of 2020 criticizing then-President Donald Trump’s handling of the pandemic, promising to do a better job protecting Americans from the virus.
He repeatedly mocked Trump’s claim that the country was “turning the corner” in the war against the virus.

“We’re not learning to live with it. We’re learning to die with it,” Biden said.
After he took office, Biden repeatedly promised to “follow the science” and lead the nation out of the pandemic as he worked to distribute the newly approved coronavirus vaccines across the country.

By July 4th, Biden shared his optimistic view that the worst of the pandemic was behind him.

“Thanks to our heroic vaccine effort, we’ve gained the upper hand against this virus,” he said, even while warning that it was not “vanquished.”

The spread of the Delta variant of the coronavirus, however, led to rising death tolls again, prompting the Centers for Disease Controls to reinstate masking and social distancing guidance.

Biden continues struggling to get the country fully vaccinated, announcing in September a plan to make businesses with fewer than 100 employees issue vaccine mandates for their workers.

“This is not about freedom or personal choice,” Biden said. “It’s about protecting yourself and those around you.”

During a successful bail hearing last month, Mr Pulkownik’s lawyers claimed he did not instigate any act of violence against the horse and that he was fending it off as it moved towards him amid the scuffle between police and protesters.

He was held at Parklea Correctional Centre for two-and-a-half weeks after his bail application was held up because he refused a Covid test in jail and was put in isolation for a fortnight.

But Nikolic is more famous for his phrase #HoldTheLine that he made famous and for his letter to Australian New South Wales Minister for Health and Medical Research, Minister Brad Hazzard. Nikolic’s letter is provided below.

Nikolic told us that COVID mandates in beautiful Sydney have closed down numerous businesses, sounding similar to large cities across the US. Nikolic also shared that Aussies are fed up and standing up. The idea of mandated vaccines by executive order has never happened before in the country’s history.

Nikolic took much of his work from individuals across the US. He calls the vaccines the ‘World’s Biggest Clinical Trial’. He also claims you cannot be experimenting on people with vaccines that have not been fully vetted, which is what is going on now and goes against the Nuremberg Code.

A vaccine is a novel selection pressure placed on a pathogen, and if the vaccine does not eradicate its target completely, then the remaining pathogens with the greatest fitness — those able to survive, somehow, in an immunized world — will become more common.

One can think about vaccination as a kind of sieve, argues Troy Day, a mathematical evolutionary biologist at Queen’s University in Ontario, Canada.

This sieve prevents many pathogens from passing through and surviving, but if a few squeeze by, those in that nonrandom sample will preferentially survive, replicate and ultimately shift the composition of the pathogen population.

The ones squeezing through might be escape mutants with genetic differences that allow them to shrug off or hide from vaccine-primed antibodies.

Most of the vaccines we get in childhood prevent pathogens from replicating inside us and thereby also prevent us from transmitting the infections to others.

But scientists have so far been unable to make these kinds of sterilizing vaccines for complicated pathogens like HIV, anthrax and malaria.

To conquer these diseases, some researchers have been developing immunizations that prevent disease without actually preventing infections — what are called “leaky” vaccines. And these new vaccines may incite a different, and potentially scarier, kind of microbial evolution.

The problem with leaky vaccines, Read says, is that they enable pathogens to replicate unchecked while also protecting hosts from illness and death, thereby removing the costs associated with increased virulence.

Over time, then, in a world of leaky vaccinations, a pathogen might evolve to become deadlier to unvaccinated hosts because it can reap the benefits of virulence without the costs — much as Marek’s disease has slowly become more lethal to unvaccinated chickens.

This virulence can also cause the vaccine to start failing by causing illness in vaccinated hosts.

Here is the latest move by the University of California in response to my lawsuit in Federal court challenging their vaccine mandate on behalf of Covid-recovered individuals with natural immunity. Last Thursday Sept 30th at 5:03 PM I received this letter from the University informing me that, as of the following morning, I was being placed on “Investigatory Leave” for my failure to comply with the vaccine mandate. I was given no opportunity to contact my patients, students, residents, or colleagues and let them know I would disappear for a month. Rather than waiting for the court to make a ruling on my case, the University has taken preemptive action:

You might be thinking, a month of paid leave doesn’t sound so bad. But the language is misleading here, since half of my income from the University comes from clinical revenues generated from seeing my patients, supervising resident clinics, and engaging in weekend and holiday on-call duties. So while on leave my salary is significantly cut. Furthermore, my contract stipulates that I am not able to conduct any patient care outside the University: to see my current patients, or to recoup my losses by moonlighting as a physician elsewhere, would violate the terms of my contract.
It came as no surprise that, since my request for a preliminary injunction was not granted by the court, the University would immediately begin procedures to dismiss me. However, in the complicated legal game of three-dimensional chess I did not anticipate this particular development: the current administrative designation, where I am neither able to work at the University nor permitted to pursue work elsewhere, was not a development I had anticipated. The University may be hoping this pressure will lead me to resign “voluntarily,” which would remove grounds for my lawsuit: if I resign prior to being terminated by the University, I have no legal claim of harm.

I have no intention at this time of resigning, withdrawing my lawsuit, or having an unnecessary medical intervention forced on me, in spite of these challenging circumstances. You may be wondering about the CA Department of Public Health vaccine mandate mentioned in the University’s letter above: yes, I am subject to two mandates, the UC mandate as a faculty member and the CA State mandate as a healthcare provider. Regarding the latter mandate, I filed a similar lawsuit in Federal court last Friday against the State Public Health Department. I will post more later on that case as it develops.
Although this is a challenging time for me and my family, at this time I remain convinced that this course of action is worthwhile. I am grateful for your ongoing encouragement, prayers, and support. I want my readers to know that am taking legal action not primarily for myself, but for all those who have no voice and whose Constitutional rights are being steamrolled by these mandates. As I wrote in my first post:

In my position, I came to see the importance of representing those whose voices were silenced, and to insist upon the right of informed consent and informed refusal. I have nothing personal to gain by this lawsuit and a lot to lose professionally. In the end, my decision to challenge these mandates came down to this question: How can I continue to call myself a medical ethicist if I fail to do what I am convinced is morally right under pressure?

BREAKING: Defending The Republic Sues DOD, FDA & others on behalf of our military who decline vaccination

Today, Defending the Republic, through our local counsel, filed a lawsuit against the U.S. government – including Secretary of Defense Lloyd Austin, III, HHS Secretary Xavier Becerra, and FDA Acting Commissioner Janet Woodcock – on behalf of 16 active-duty military service members in support of their right to refuse the unconstitutional and unlawful COVID-19 vaccine mandate. These service members, which include those with natural immunity to COVID-19, women who wish to become pregnant, or who have medical conditions for which no clinical trial data is available, face severe punishment, including dishonorable discharge, the loss of their constitutional rights, and potential imprisonment if they do not get these experimental vaccines that they have every right to refuse.

The core claims raised in the lawsuit ask the court to bar the FDA and DOD from using deceptive “bait and switch” tactics and to uphold the constitutional right of every citizen to refuse an unwanted, unnecessary and unproven vaccine. The “bait and switch” involves the FDA’s approval of the Comirnaty vaccine, which is not available, while the FDA and DOD instead seek to administer the experimental, unapproved version of the vaccine (which cannot be mandated) to trick service members to forfeit their rights to informed consent and to refuse an experimental vaccine.

This lawsuit also challenges the FDA’s unlawful “approval” of the Comirnaty Vaccine. This approval violated the Administrative Procedure Act, contradicted the FDA’s own rules, was based on flawed and incomplete scientific studies, and was made despite unprecedented numbers of adverse events – including deaths – related to the vaccine. The FDA also acted in an arbitrary and capricious manner, in that it excluded certain groups from clinical trials, including those with previous COVID-19 infection and pregnant women.

Through the filing of this lawsuit, we make clear that these service members – those who serve their country with honor – are not the property of the U.S. government, and the Constitution does not allow them to be treated as such.
