Alba is charged with second-degree murder after fatally stabbing 37-year-old career criminal, Austin Simon.

Video obtained by the New York Post reveals the bodega worker was trying to avoid confrontation with Simon in the minutes leading up to the July 1 stabbing.

Earlier Thursday, NYC Mayor Eric Adams visited the bodega to express his support for Alba.

'I'm a person that's there for people following the law. I saw from the video, I saw a voter here inside the store following the law...It's time for New Yorkers and Americans to start standing up for people who follow the law,' he said.

At a hearing on Thursday, prosecutors from Manhattan DA Alvin Bragg's office moved to lower Alba's bond from $250,000 to $50,000. He was only required to post $5,000 - 10 percent - which was paid by his family and boss.

Alba is barred from leaving New York City and had to surrender his passport, which means he will not be able to go on a previously planned trip to the Dominican Republic.

But Alba's release is a small victory for the 62-year-old who many say should never have been arrested in the first place.

Alba, who is beloved in the local community, has worked there for decades and has no criminal record.

The attack at the bodega happened when Simon's girlfriend's card was declined trying to buy a bag of chips. Her debit card was declined and Alba refused to give her the chips.

She then produced a knife from her purse and, according to Alba's family, attacked him before calling for her boyfriend for back-up.

Surveillance footage shows Simon charging into the store in a $350 dollar Amiri shirt, standing over Alba and then fighting with him.

Initially, Manhattan DA Alvin Bragg's office asked for a $500,000 bond - which the judge last week said was too high- $250,000 was then decided upon - which the family couldn't afford.

They set up a GoFundMe page to help raise bail and pay for his legal team but GoFundMe removed the account after it raised $20,000.

A GoFundMe spokesperson told DailyMail.com: 'Our terms of service prohibit fundraising for the legal defense of a violent crime.

its disgusting. this stuff has been happening for so long there, and this sudden backpeddling is because the outcry has been so great and from the whole country.

i stand by my earlier statement and i hope and pray that this man and his family are fully restored and set up so they will not have to worry about money for the rest of his life and the lives of his wife and kids.

and i hope that those responsible for this mess pay.

NEW YORK -- Calls are growing for charges to be dropped against a Hamilton Heights bodega worker accused of murder.

Jose Alba stabbed a man to death on July 1 after he came behind the counter to attack Alba.

Surveillance video shows the encounter inside the Blue Moon convenience store on West 139th Street.

Austin Simon was stabbed multiple times.

Alba, who was arrested on second-degree murder charges, says it was self-defense.

The group United Bodegas of America wants Manhattan District Attorney Alvin Bragg to drop the charges.

"Our city is in crisis, and at this point, we are just fed up with people robbing, looting, attacking, assaulting, killing our small business owners," said Fernando Mateo, with United Bodegas of America.

They plan to meet with Bragg on Tuesday to discuss Alba's case.

A spokesperson from the District Attorney's office released a comment saying, "We are continuing to review the evidence and the investigation is ongoing."

You may recall the story of Jose Alba, the New York City bodega worker who was attacked in his store by an ex-felon. Alba fought back, stabbing his attacker to death, but was in turn stabbed by the thug’s female accomplice.

For his trouble, Alba was tossed in prison at Rikers Island on $250,000 bail while the woman who stabbed him was released on her own recognizance. The charges were finally dropped and he was released, but now it turns out that the experience has soured him on life in the Big Apple. His friends tell reporters that he’s no longer working in the bodega and is currently packing up to move back to the Dominican Republic. This unfortunate tale says far more about the conditions in New York City (and most of America’s other large cities) than it does about Jose Alba. (NY Post)
The Manhattan bodega clerk who was infamously charged with murder for fatally stabbing an assailant has had it with the crime-ridden Big Apple and is leaving the US, at least for now, pals told The Post on Friday.
“He doesn’t work here anymore. He’s getting ready to move out of the country,” the manager of the Blue Moon convenient store, where the grisly stabbing happened July 1, said of Jose Alba, 61.
The store manager, who declined to identify himself, said Alba is headed to Santiago, a city in the Dominican Republic where the former worker is originally from.
Jose Alba came to the United States looking for the American dream, and for a while, it seemed as if he’d found it. But thank’s to New York City’s backward-facing court system, he wound up living out the American nightmare. His great opportunity to have a stable job and a home of his own was transformed in a single week to an “opportunity” to be abused by the legal system that was supposed to protect people like him from the dregs of society.

Consider what it means for someone like Alba to willingly choose to move back to Santiago. Our own government issues travel warnings about the Dominican Republic, citing “armed robbery, homicide, and sexual assault” as frequent dangers. The tourist resorts are safer than they used to be thanks to investments in law enforcement resources, but Santiago is simply a dangerous place.

Yet given a choice between New York City and Santiago, Jose Alba is choosing… Santiago. This is reminiscent of all of the Californians who have recently been relocating to Mexico for the lower cost-of-living and better lifestyle. We’ve seen a similar exodus of the lawful from cities including Baltimore, Minneapolis, and Portland.

Shouldn’t these trends be setting off some alarm bells for our elected leaders? And if not, shouldn’t these stories be waking up the voters to the fact that those elected leaders are asleep at the switch and not doing their jobs?

America used to be a place that people from the poorer, less developed nations aspired to come to. (Why do you think we have such massive numbers of illegal immigrants lining up to get in?) And many parts of America are still full of opportunity and hope. But you really can’t say that for many of our larger cities these days. I have friends who live or lived in big cities just this year who have either already moved or announced their plans to move to England, Scotland and Ireland.

I wish all the best to Jose Alba in the Dominican Republic. It’s a shame to see him leave, particularly under these circumstances, but I suppose I really can’t blame him.

I can't blame him either, and the US loses the sort of legal immigrants they really want to have - hard-working, responsible and quick thinking in a crisis. This man was betrayed by the system that was supposed to protect him, his employer, and their property. I hope he's earned enough to open a nice retirement shop in his home country, and I wish him all the best.

A judge on Tuesday dismissed the murder charge against a 61-year-old Manhattan bodega clerk accused of killing a man who first attacked him, ending a brief case that sparked outcry in New York City and across the country.

Tuesday's hearing for Jose Alba proceeded quickly and with little fanfare. He had not been expected to attend.

It was called after the Manhattan district attorney's office filed a motion to dismiss the second-degree murder charge against Alba in Austin Simon's July 1 stabbing death at the Blue Moon Convenience Store on Broadway, near 139th Street.

The assistant district attorney said the office couldn't prove behind a reasonable doubt that Alba's use of deadly force was unjustified and thus would not present the case to a grand jury. It came after loudening cries to drop the case.

Much of the outcry stemmed from surveillance video that shows the 35-year-old Simon storm behind the counter and attack Alba. A fight breaks out moments later and Alba grabs a knife. He stabs Simon three times -- in the heart, lung and jugular vein, according to the prosecutors' motion. Simon was pronounced dead at a hospital a short time later.

According to Tuesday's court filing, the stabbing stemmed from a physical confrontation that Simon started because he felt that Alba had treated his friend's 10-year-old daughter harshly. It says Alba pulled a snack out of the girl's hand when Simon's girlfriend couldn't buy it because her EBT card malfunctioned. Minutes after the girlfriend stormed out of the store, Simon returned, went into an employees-only area and shoved Alba into a wall of shelves, according to prosecutors.
