POL CPS Complaint Filed Against Texas Judge Over Daughter and Potential Ebola Exposure

DALLAS, Texas -- Breitbart Texas has learned a complaint was filed with Texas Department of Family and Protective Services, also known as CPS. The complaint was filed on Sunday morning by a concerned Dallas citizen who read about Dallas County Judge Clay Jenkins going into the apartment where Ebola patient, Thomas Eric Duncan, lived while he was sick. He was in the apartment with four people who had been directly exposed by Duncan to the Ebola virus. Jenkins said, in a subsequent press conference that he was going home to his wife and nine-year-old daughter after he discussed being in the apartment again and driving the exposed family to their new home -- a forty-five minute drive. At no point did Jenkins appear to wear any protective clothing.

The concerned citizen reached out to Breitbart Texas in a phone interview and provided information about his complaint to CPS. He told Brietbart Texas he wanted to remain anonymous because he is a business owner and is concerned about retaliation. He said he felt Jenkins’ conduct was inappropriate and unnecessarily exposed his child to potential danger. “I am doing this because I am concerned about the child,” the complainant said, “and I am concerned for the children in her school who might become exposed if the virus were to spread.”

“There seems to be a lot of dispute about how the disease is transmitted,” he continued. “I was very concerned that he would take this unnecessary risk with his own daughter for what appears to be his own political purposes.”

CBSNews reported today that "an infectious disease expert at the National Institutes of Health says it is 'absolutely' possible that one of Duncan's contacts will get sick in the coming days"

"I would not be surprised if one of the people who came into direct contact with Mr. Duncan when he was ill will get Ebola. You can't say. You can't put a number on it. It's impossible to do that. But there certainly is a risk," Dr. Anthony Fauci who heads up the Allergy and Infectious Diseases Institutes at the National Institutes of Health (NIH), said on CBS' "Face the Nation" Sunday.

Breitbart Texas previously reported that Jenkins had been seen several times on Thursday and Friday entering the apartment where Duncan lived while he was ill for at least two days. On Thursday night Jenkins shocked the Dallas press corps when he and two women were seen entering the quarantined apartment while not wearing any protective clothing. Hazmat experts entered the apartment on Friday wearing Tyvek hazmat protective suits. Friday afternoon late, Jenkins was seen entering the apartment again and on the front balcony with several of the exposed minors who were in close proximity to Jenkins.

Breitbart Texas legal analyst Lana Shadwick, who also previously served the State of Texas as an associate family court judge and a CPS attorney said these types of reports are treated confidentially by CPS. “Both the report and the reportee are kept confidential and are not subject to open record act requests,” Shadwick said. “If the report is made in good faith, the reportee is also immune from any civil and criminal action.”

“Even suspicions of abuse or neglectful behavior are protected,” Shadwick continued. “Texas Family Code 161.001(1) (D) and (E) cover endangering conduct of a parent that can lead to possible termination of their parental rights.”

“I am very concerned that Clay Jenkins may have exposed his daughter to the deadly Ebola virus,” the complainant said in an email where he provided screenshots of his complaint filing. “The media reported that, after he went into the apartment and drove them around, he went home in the same shirt and exposed his daughter to this deadly virus.”

Duncan remains in critical condition at Texas Health Presbyterian Hospital.

I wondered about that myself. He showed gross neglect for his own family by exposing himself and his clothing to a hot zone of contagious deadly disease without layered protection, and then bringing the exposed surfaces home.

He is either an absolute moron and a danger to his family or a careless maniac which still makes him a danger to everyone.

Maybe someone could open a CPS case against 0 since his refusal to close our borders has endangered ALL children in this country.

So the guy is worried about the judges daughter but not about the 13 yr old boy left in a disease ridden apt for 6 days shouldnt there be a case against that and the county itself for forcing it on the family they put that child at direct risk for all that time.

If I was this guy's wife, he'd have more to fear than whether he was going to contract Ebola.

Apparently you believe in the efficiency and competency of government. I don't share that opinion personally.

Because a Level 4 pathogen like Ebola is not treated this way.

Sure it's treated that way. Everyone is taking their cue from the 'experts' which is the CDC. All these subordinate agencies and entities
are told that as long as there is no direct contact [i.e. exchange of body fluids] between you and someone who has Ebola that there is no threat.
Therefore the kids are allowed to go to school because nobody there has Ebola and nobody can infect someone else until they are visibly sick [so
the CDC tells them] so there is no threat to the kids. The ambulance just had the standard type wipe down that all ambulances had between
calls as at the time the patient was transported EMS had no reason to believe that the patient was any different than a dozen other calls a day
where people are puking, ect. And not to mention the big one that this CDC can't account for vials of smallpox that are just left lying around
for years on end. A lot of these people are political appointees and not because they are actually experts. I have no doubt that this patient had
Ebola and it will spread because of idiots who are playing politics. Read what one of our own doctors here had to say about this whole mess in
the B.S.

It is beginning to look more and more like that. The only other explanations are stupidity for votes or there is no Ebola. You don't play games with class IV pathogens. They will kill you and those around you.

more than likely this guy has a kid that goes to school with the judge's kid so he's not worried about an older kid.

I would like to know just what the guy wants cps to do with the judge's kid. make her leave her home and put her in foster care where she can expose more people?

What we tend to forget is Joe Sixpack and politicians ARE often clueless. I can guarantee that 99% of the general public including politicians do not have the level of knowledge and the research into the various POSSIBLE (but not necessarily probable) aspects of this thing that we on this board have.

There is a b.s. thread that mentions this, but from the sound of the mention, I doubt a lowly political scumbag like Jenkins would have access if there are any, only higher up political scumbags.

I saw a blurb on the news this morning, either BBC or ABC, that they had found a homeless man yesterday who was transported in the ambulance after Duncan had ridden in it. They have him on their "watch list" for any signs of ebola.

Voicing a complaint about one incident hardly proves that this is the only thing bothering the guy.

My question is : Why isn't the CDC all over this guy?

CDC has been talking (and doing) out of both sides of their mouth during this whole thing.

- Visitors and food delivery and local politicians coming and going in plain clothes.
- Apartment cleanup team in full PPE.
- Duncan fine in any hospital as any hospital in the US is capable of handling Ebola cases.
- NBC cameraman, like Brantly, Writebol, Sacra, et al, is sent to a BSL-4 facility.

No consistent actions or messages....
