*Grants Pass, OR. – For the past several years, the miners from the Galice Mining District, about 30 minutes west of Grants Pass, Oregon, have been arguing over who has the rights to the minerals in the ground around Galice Creek. The Galice mining district is compiled of a number of claims, owners and miners and has been in continuous operation since the early 1870’s, which makes it one of the longest running operations in the US. This specific operation predates the BLM bureaucracy by many decades in fact.

The area in question has produced in excess of 10 million ounces of gold since its conception, and geologists estimate that only 10% of the gold in the ground has been removed, which makes this area highly sought after by any standard. It is said that children find gold with their hands in the creeks to this day.

BLM has made several attempts to disband the operation through violations that claim improper paperwork filing, ruling changes over time, and other unsubstantiated claims. The miners of this district have spend tens of thousands of dollars to date to fighting the BLM in the courts and other avenues. The district has made requests to produce the official rulings that show they are in violation which have gone unanswered. They simple reason given by the BLM is that “they say so”.

The BLM claims that the mine has no surface rights to the area and in turn says that all structures and equipment need to be removed. The BLM also claims that this violation is grounds for the operation to cease and tunnels filled in. The mine predates more recent rulings about surface rights so the sugar pine feels that the new ruling is not applicable to this specific situation.

Late last week, BLM officials accompanied by Josephine County Sheriff deputies issues a cease and desist order to the district without any official ruling by the courts. Specifically, the issue is not even scheduled to be heard in court until later in the year. The order has given the miners until April 25th to remove all equipment, buildings and supplies from the mine. Local BLM officials have threatened to burn the buildings down if they are not removed by the date.

The owners of the sugar pine have stated that they will fully disobey the order as they claim that it is illegal and invalid. A call for assistance to the Oath Keeper’s and other State Militia groups has been made and there is no intention to leave the area by the deadline.

This issue has far reaching implications. The outcome from this issue and the court ruling to come will effect all of America. The issue at hand is not just about the Galice Miners and the gold in the ground, but more about what the government says you can do with the ground in your control. These miners have the rights to the minerals in the ground and the government wants that changed. What comes next could effect every American. What if your backyard has a specific mineral that the government values. By any means, can come in and tell you that you can not grow your broccoli on your land because it absorbs this “special” mineral? The bigger picture would effect farmers. What if gold, oil, or something like uranium was found under a farmer’s corn crop. Does the government have the right to those minerals and have the ability to over ride your use of your own land? This issue will have the ability dictate the future use of our public and private lands.

We spent 2 years on the other side of the Rogue River on the coast. Greatest ppl. in the world are in Southern Oregon. I hope this blows up in the face of the BLM. They need to leave people the he&& alone!

*NEAR MERLIN, Ore. — Law enforcement authorities responded to what Josephine County Oath Keepers are calling the “Sugar Pine Mine Security Operation.”

According to the Bureau of Land Management (BLM), they recently found out about the mining operation around Galice Creek. Officials with the BLM said they served a notice to the miners that they were out of compliance.

The Oath Keepers of Josephine County said at the request of the Sugar Pine Mining Claim owners their mission is to ensure the Fourth Amendment Constitutional Right to Due Process is not being violated by the Bureau of Land Management.

Officials with the BLM said they have spoken with the lawyer representing the miners, and have reason to believe they are planning to make an appeal.

People in the Merlin area reported SWAT vehicles on the roads outside of Merlin. Tune in tonight on NewsWatch12 at 5 and 6 o’clock for more on this developing story.

UPDATE 4:00 P.M. - The Josephine County Sheriff's Department has released a statement regarding this incident:

"Sheriff Daniel in an attempt to mediate this conflict has contacted and met with the Coordinator of the Oath Keepers and the Assistant Special Agent in Charge of the Bureau of Land Management out of Eugene. This was done to ensure the claim owner’s right to due process and avoid confrontation in the region.

The Josephine County Sheriff’s Office was informed by the BLM that no enforcement action would be taken by their organization and the claim owner is guaranteed his right to due process. Further the BLM has met with the claim owner’s attorney to ensure the appeal process.

The Josephine County Sheriff’s Office wishes to express its intention to uphold the Constitution of the United States and the Constitution of the State of Oregon to ensure the rights of all persons within Josephine County."

6)The mining district has set up a parking lot away from the mine. Parking lot possibly could hold 200 people. Parking lot for people they are turning away from the mine that we are unable to stop.
7)The mining district wants to thank everyone for your diligent effort to help control this.
8)Mining district said they will attempt to keep us updated at least once every day.

Militias took on the Bureau of Land Management once again, except this time
it was in Oregon on behalf of gold miners who had been ordered off of their land.

For several years, the miners of Galice Mining District have been locked
in a dispute with the BLM over who owns the rights to the gold that is found
in heavy concentration in the area. Miners at Galice Mining District have
collected over 10 million ounces of gold since the 1870’s and geologists
estimate that only 10% of the gold in the area has been collected.

Earlier this month, the miners were served with a cease and desist order
by BLM officials who were accompanied by Josephine County Sheriff
deputies, despite the fact that the case is not due to be presented
in court until later this year.


According to the paperwork, the miners had until April 25, to clear the land
of themselves, all building, and equipment. The miners claimed that
the BLM had threatened to burn down the buildings if they do not meet
the deadline.

“If you are a true Militia, true III%, Oathkeeper etc. then you are needed.

If you can get away from home to help, NOW IS THE TIME,” a call-to-action
sent out stated. “Just like Bundy ranch, the BLM is out of order!
SHUT DOWN THE FOREIGN CORPORATION NOW! The miners need you!!”

A call was issued for at least 50 volunteers to descend upon the mining
district and prepare for at least seven days in the rough terrain.

The government seemed to be gearing up for battle as well, with SWAT
vehicles being spotted in the area on Tuesday.

“We intend to take BLM fully to task and will not feel sorry for any civil
or criminal consequences that may be leveled upon any BLM employees
who are found to be negligent of wrong-doing. We are actively pursuing
these individuals through a wide range of tactics with the intent to reign
in these wrong doers,” said the statement posted by the miners.


Around 4 pm on Tuesday, The Josephine County Sheriff’s Department
released a statement asserting that they had met with representatives
of the Oath Keepers as well as the Bureau of Land Management.

"Sheriff Daniel in an attempt to mediate this conflict has contacted and met
with the Coordinator of the Oath Keepers and the Assistant Special Agent
in Charge of the Bureau of Land Management out of Eugene.

This was done to ensure the claim owner’s right to due process and avoid
confrontation in the region. The Josephine County Sheriff’s Office was

Constitutional activists staging to protect Galice mining operation on BLM's radar screen

MERLIN -- Saying they do not want a repeat of last year’s Bundy Ranch standoff in Nevada, a group of constitutional activists are staging in Merlin to protect a nearby mining operation they say is under threat from the Bureau of Land Management.

As of 3 p.m. Tuesday, about a dozen people, some of them dressed in military gear, had gathered at the staging area in the 2400 block of Camp Joy Road in Merlin.

The “mine security operation” was called by the local chapter of Oath Keepers, a constitutional watchdog that bills itself as an organization of present and former military and law-enforcement personnel who say there are some government orders they won’t follow.

Organizers on Monday called on people from “all over the country” to help them protect the constitutional rights of a small-scale gold mining operation near Galice called Sugar Pine Mine that the Bureau of Land Management says is in violation of federal rules.

Mary Emerick, a spokeswoman for the group, said there were also “some” Oath Keepers at the mine site, but didn’t say how many. The mining claim is located in the Galice Creek drainage accessed by Peavine-Serpentine Springs Road, about 35 miles northwest of Grants Pass.

Organizers took pains to say they were hoping to avoid a repeat of the Bundy Ranch standoff last summer, when a decades-old dispute over unpaid grazing fees on federally owned land in southern Nevada degenerated into an armed confrontation between protesters and law enforcement.







“This is NOT a standoff with BLM. We are NOT promoting any confrontation with BLM. This is a security operation for the protection of Constitutional Rights,” the organization posted on its web site.

However, the call to action appeared to elicit a stir on social media such as Facebook and youtube, where several people posted they were on their way to Oregon for a “standoff” with the BLM.

“We don’t allow our neighbors to be enslaved or beaten or tortured by government jackboots because they want to steal our land and our resources to keep us under our thumb,” one man said in a video posted on youtube.

That person identified himself as a member of “Arizona state militia” and said he and a friend had been driving all night to get to Oregon. The video was posted from a moving vehicle and referenced “security teams” and even some “heavy hitters” on their way to Grants Pass.

“We are standing off with the BLM in Oregon!” the man exclaimed.
In a news release Tuesday, Josephine County Sheriff Dave Daniel said he has been working to avoid a showdown.

He suggested the “security operation” was sparked by a visit to the mining site last week by a BLM agent and one of his deputies. During the visit, the claim owner was provided a Notice of Noncompliance and paperwork to file an appeal by the BLM Ranger.

Daniel said he has since met with an regional BLM representative in Eugene as well as with Joseph Rice, head of the local Oath Keepers chapter. According to Daniel, the BLM told him that no enforcement action would be taken by federal authorities and that the claim owner is guaranteed his right to due process.

When asked how and why Oath Keepers got involved, Rice said Tuesday morning:

“The mine owners came to our meeting last week and requested our assistance. We are ensuring their due process is not violated.”

He declined to elaborate how their operation would work.

In an email to North Valley Community Watch, Rice warned of the potential influx of people.

“Within the next 48 hours we will have tactical, medical, communication and logistical support teams moving into the area from around the country,” the email said.

The BLM, which visited the mine in January, doesn't appear to be headed back any time soon.

The agency sent letters to the claim owners on March 25, explaining that people may not stay, or live, on public lands more than two weeks at a time. The letters also informed that the mining operation was not in compliance, and gave a 30-day deadline to begin the plan of operation application process or appeal, said Jim Whittington, spokesman for the Medford District BLM.

Whittington said Tuesday morning that the BLM has no plans to return to the mine until it hears more from the miners’ attorney.

Whittington said when two BLM employees went to the mine in January they found heavy equipment, a water pipe system, one large structure and several smaller ones, with evidence someone was living there.

“There’s a fairly big footprint to it,” Whittington said. “There is no plan of operation that would cover the level of work they are doing there.”

The BLM requires plans of operations for mining on valid claims, beyond “minor exploratory stuff.”

“For something as intense as we’re seeing out there, they’re going to need a plan of operation,” he said.

One of the mining claim owners is Rick Barclay of Applegate, chairman of the Galice Mining District, and the other is George Backes of Grants Pass.

The Oath Keepers of Josephine County are gathering at a piece of property near Merlin. They're in the process of setting up a staging area, in order to step in if they are needed by the Sugar Pine miners.

“Because we are constitutional group,” said Mary Emerick with Oath Keepers. “We defend the Constitution… And we are here just to make sure that they receive their Fifth Amendment rights which is due process.”

The owners called them in to help protect the property that they have mined for more than 100 years. The miners say documents they have grandfathered-in their surface rights to the property.

But the BLM says the documents are outdated, and at some point, the property has changed hands which cancels out the grandfather process. Now, the BLM says the miners have to tone down their mining operation to stay in line with the regulations.

“We’ve sent them those letters,” said BLM’s Jim Whittington. “They also have the right to appeal our notice, that it requires either a plan of operation or notice, and some informal contacts with their lawyer…it sounds like they may appeal. So if they appeal, that starts another administrative appeal process.”

The BLM says they have no intention of stepping in and that it will be a process before any action is taken. But even so, the Oath Keepers are going to make sure of that in the interest of protecting the miner's constitutional rights.

“Sometimes that's going to take days or even weeks, and we are preparing for this to potentially last that long,” said Emerick.

Josephine County Sheriff Dave Daniel also says he has been acting as a mediator between the land owners and the BLM. At this point, the only reason the Sheriff's Office would step in would be for public safety if the situation escalated.

Property changed hands? What does that mean? And the county sheriff was facilitating cease and desist orders from what I read, and that the BLM also threatened to destroy all equipment and buildings. Too bad news is written by fools/dupes/bad actors/idiots....

One of the not to be forgotten tactics when a lot of people turn out to protest is for the government to "appears" to surrender, say "You win! We give up!", then after everyone goes back home and the hoopla dies down they do what they wanted to in the first place. I noticed this tactic first used years ago in Annapolis, MD. There was a bridge that many of the local people vehemently did not want built. After everyone went home elated after their hard won victory the construction began and they could not martial the resources and people for another fight.

The moral of the story is; it isn't over till its over. This isn't over by a long shot. The government is desperate for money, its life blood. How can it liquidate the Public Lands (renamed Federal Lands by them) and other public assets that they are entrusted to administer for the benefit of the American people if pesky ranchers, miners, hikers and campers insist on using them per their honest ownership rights? Are those militias ready to hunker down for the long haul? They leave, the alternative press takes their eyes off the mine for even a day and how long do you think it will be before the mine and any other facility on or near public land is under new ownership? Anyone else notice this is not even a blip on national news? This is huge! If we truly had a free press they would be all over this.

Don't you like the government tactics? The miners bought the claims that have been worked since the 1800's but since they "changed hands" they don't own them? Does than sound like out right theft of property to anyone else? If that doesn't work they go to their hold card, "You're out of compliance". as vague and contradictory as government laws and regulations are that could mean anything they want it to these days. It surprising they haven't screamed "environment!" yet. Isn't there an endangered flesh eating, disease carrying zombie slug in the area?

Amazing how fast OKs and militias managed a response so quickly, and how fast the BLM-pukes and sheriff (Barney Fife?) backed down when OKs and militias started to show up. Looks like we have a good example of how .gov overreach can be slowed and/or stopped. Obozo and the boys don't seem to have the stomach for an all-out showdown quite yet. The OKs and militias bought all of us a bit more time to organize.

It may mean that the mine claim became the property of another operator. I'm not sure, because the writing is truly bad, owing mostly to its apparent intent on whipping up the "Citizens vs. BLM" fervor.

In any event, I wouldn't expect any article written about this to adequately deal with the facts and the law involved. I would guess that somebody ("The Righteous Citizens") is mining a claim on public land that the BLM ("The Evil Government") regards as having lapsed or expired long ago, and the BLM is asking them to remove themselves and their equipment. But it's hard to tell.
