Ohio Secretary of State Frank LaRose warned Ohio Democrat Chairwoman Liz Walters that Joe Biden may have trouble getting on Ohio’s general election ballot.

In a letter sent to Liz Walters, the Ohio Secretary of State warned that Joe Biden may be non-compliant because the DNC convention will take place after the state’s deadline to certify a presidential candidate.

Frank LaRose said either the Democrat party can move up its DNC convention or the Ohio state legislature must act by May 9.

“I am left to conclude that the Democratic National Committee must either move up its nominating convention or the Ohio General Assembly must act by May 9, 2024 (90 days prior to a new law’s effective date) to create an exception to this statutory requirement,” legal counsel Paul Disantis wrote in a letter to Ohio Democrat chairwoman Liz Walters obtained by ABC News.

There could be potential general election ballot access concerns for President Joe Biden in Ohio, the state’s Secretary of State’s office said in a letter to Ohio Democratic Chair Liz Walters on Friday.

In the letter, obtained by ABC News, legal counsel for Secretary of State Frank LaRose sought clarification for “an apparent conflict in Ohio law” between the Democratic National Committee’s nominating process and the deadline by which the party’s presidential nominee must be certified to the Secretary of State’s office.

The Democratic National Convention is scheduled to convene on Aug. 19, which will take place more than a week after the Aug. 7 deadline to certify a presidential candidate in Ohio, the office flagged according to state code, which would create a problem for Biden’s eligibility.

Trump won Ohio in 2016 by an 11-point margin – 500,000 votes – against Hillary Clinton.

Trump won Ohio in 2020 by 8 points – 475,669 votes – against Joe Biden.

Ohio AG shuts down Democrat proposal that would skirt election deadline to get Biden on ballots​


Ohio Attorney General Dave Yost's office rejected an effort by state Democrats to circumvent a key election deadline to allow President Biden on state ballots this week, according to documents obtained by Fox News Digital.
The documents show correspondence from Yost's office and Ohio Secretary of State Frank LaRose, as well as attorney Donald McTigue, who is representing Democrats on the matter.

LaRose, a Republican, had notified state Democrats earlier this month that the Democratic National Convention would not occur until more than a week after Ohio's Aug. 7 deadline for certifying presidential candidates. LaRose warned that either the Ohio assembly would have to vote to change the law, or Democrats would have to move up their plans for certifying Biden and Vice President Kamala Harris.
McTigue responded in an April 9 letter, arguing the Secretary of State had the authority to accept a provisional certification of Biden and Harris' nominations prior to the official certification at the party's convention.

He claimed Ohio law allows for a provisional move because Biden and Harris "have secured the pledged delegates necessary to become the party's nominees."

LaRose then consulted with Yost's office about the proposed solution, but the attorney general shot down the plan in a statement on Monday.
"The Democratic Party’s notion of providing a ‘provisional certification’ by the statutory deadline simply is not provided for by law," Yost's office said. "Instead, the law mandates the Democratic Party to actually certify its president and vice-president candidates on or before August 7, 2024. No alternative process is permitted."

"Thus, the Secretary of State lacks authority to accept ‘provisional certifications’ from the Democratic Party pursuant to [the law]. The Democratic Party must actually certify its presidential candidates on or before August 7, 2024 to be placed on the 2024 General Election ballot," the statement continued.
McTigue has yet to offer a response to the attorney general's office, and he did not immediately respond to a request for comment from Fox News Digital.

Meanwhile, Biden's campaign continues to insist that he will be on the ballot in "all 50 states."

So, what changed since previous elections? Are the Demoncrats so stupid that they chose the date without double checking the nomination deadline did Ohio change the deadline? This really is banana republic stuff...

Off topic but the people on this thread are probably best-suited anyway to answer. Assume FJB or DJT isn't on a state or two's ballot for President.

Are there any immediate implications affecting the Nation's survival as an entity?

The Dims want to say we will give a "provisional" certification and that is fine.......

No the law says you must certify and not provisionally......

From what I read prior Ohio has not changed anything.
The demorats are trying to push everything to the last minute.

I'm assuming they are still banking on trump being tied up in lawfare garbage and at what point they are going to replace slow joe and the hoe on the ballot.
