Two top Democrats backed on Sunday the theory that former President Donald Trump could be disqualified from running under the 14th Amendment, Axios reported.

Democratic Representatives Adam Schiff of California and Tim Kaine of Virginia backed the idea that Trump could be blocked from the 2024 ballot under Section 3 of the 14th Amendment, which maintains that anyone who “engaged in insurrection” cannot hold elected office, according to Axios. Free Speech For People, a Democratic-aligned group, also sent letters to secretaries of state in key 2024 states last week claiming Trump should be removed from the ballot.

Shiff said Sunday on MSNBC’s “Inside with Jen Psaki” that the disqualification “fits Donald Trump to a T.”

“If you engage in acts of insurrection or rebellion against the government, or you give aid and comfort to those who do, you are disqualified from running,” Schiff said. “It doesn’t require that you be convicted of insurrection. It just requires that you have engaged in these acts.”

Kaine told ABC News there is “a powerful argument to be made” for disqualification.

“In my view, the attack on the Capitol that day was designed for particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power as is laid out in the Constitution,” he said, noting that “it’s probably going to get resolved in the courts.”

George Washington University law professor Jonathan Turley called the idea of disqualifying Trump under the 14th Amendment “the single most dangerous constitutional theory I have seen pop up in decades” during a Fox News segment on Aug. 22.

Hans von Spakovsky, Election Law Reform Initiative manager and senior legal fellow for The Heritage Foundation, previously told the Daily Caller News Foundation that Section 3 of the amendment “is no longer in effect because Congress passed two amnesty acts in 1872 and 1898 as it is allowed to do under that Section to remove the disabilities imposed by Section 3.”

“Moreover, Donald Trump has never been convicted of ‘insurrection or rebellion’ by any court and not by Congress either in the impeachment proceedings that were attempted against him,” Spakovsky said. “These attempts to disqualify him from the ballot are unconstitutional.”

Cornell Law School professor William A. Jacobson previously told the DCNF that allowing state officials to determine what constitutes insurrection on their own would “wreak havoc on our constitutional presidential electoral system.”

What makes Schiff and Kaine, "TOP Democrats?" Haven't heard much about Kaine in a while so that doesn't put him a the "Top" of the dem list, and Schiff is just a blackmailed, psycho pedophile, but he's not "Top." "Top" dems to me would be Schumer, Obama, Sanders, Kuhn, maybe Scott.

I was reading the Declaration of Independence just the other day and this paragraph prompted me to have the grandgirls I homeschool start copying the Declaration.

With regard to the use of the 14th Amendment, here is an article from "The Hill" reporting on the Arizona Supreme Court putting the kibosh on that move. The inapplicability of the 14th amendment does rely on their being no legislation in place to enforce it, which makes one wonder if the anti-Trump legislatures can get their acts together in time to overcome that hurdle. Although, it is still the case, that it would be hard to exclude someone under the 14th if he had not yet been found guilty in a court of law. In other slightly hopeful, good news, dutchman over at the theconservativetreehouse makes this observation:

If the Az. Supreme Court says there is no statutory authority to enforce Article 14,…than there isn’t.
And not just for cartel lawyer selected as A.G. for Az. but for ANY State A.G. wanting to try it.
They already TRIED, in a couple of cases literally tried in a court of law, to prevent 6 members of Congress from running, using the 14th, and J6 as the predicate, and lost on all 6 cases.
Marc Elias made the attempt, most of the cases were dismissed, a couple actually went to trial, like MTG in Georgia, and the court ruled in her favor.
The desperation, the flop sweat is getting disgusting.

Arizona Secretary of State Adrian Fontes (D) said he does not have the ability to bar former President Donald Trump from running for president in his state Wednesday.
There have been calls to bar the former president from being able to run in 2024 related to language in the 14th amendment where it states those who “have engaged in insurrection or rebellion” against the government cannot hold office. Fontes said despite those claims, he cannot do so by way of a previous Arizona Supreme Court case.
“Now, the Arizona Supreme Court said that because there’s no statutory process in federal law to enforce Section 3 of the 14th amendment, you can’t enforce it,” Fontes said on “The Gaggle” podcast by The Arizona Republic and azcentral.com.
“That’s what the Arizona Supreme Court said, so that’s the state of the law in Arizona. Now, do I agree with that? No, that’s stupid,” Fontes continued.

Fontes said despite his dislike of what the Arizona Supreme Court has decided, he will still follow it because it is Arizona law.
“What I’m saying is I’m going to follow the law,” Fontes said. “And the law in Arizona is what the law in Arizona is. Whether I like it or not, is irrelevant.”

(I really don't think a lawyer should call the judges on his state supreme court stupid. Fellow members of the bar take serious umbrage at such shows of disrespect - of course that just might be Delaware - maybe Arizona is still the wild west.)

it would be hard to exclude someone under the 14th if he had not yet been found guilty in a court of law.
And even if Trump is convicted in the Kangaroo Court - he will certainly appeal it to a higher court, possibly the SCOTUS.

And would the lower court finding be binding pending appeal? Probably not.

But who knows in Biden-Land.

The final tipping point for the first U.S. Civil War was the results of a presidential election and this could happen again here if the Dems try to play this card here next year.

I cannot claim to understand it. I like him.
He is a threat to their existence. They know it. They don't like it and are doing what they can to avoid their end.

They won't, of course, be successful. Devolution ensures that.
