WROL, legal and illegal become vague concepts of a system used to oppress people that disagree on a point of view.

When you can lock up political opponents like Jan 6th people but provide bail for pedophile mass murderers, then laws mean nothing. It is a matter of finding the right politically appointed judge.

Issuing a decree that says an unconstitutional act will not be allowed is like passing a law declaring something that was against the law already will not be allowed.

If a major pushback does not occur, those pushing unconstitutional acts will probably succeed.

I believe the finding is correct in and of itself. The stumbling block will still be health care, though. Any organization which gets a lot of its funding from federal sources (read Medicare & Medicaid although I confess ignorance as to how Medicaid operates wrt state and federal funding) could be legally freed but its money supply would be dried up. No-win situation for them.

Adding this to the conversation. Monday restrictions were lifted in nursing home facilities in Missouri. Anyone vaccinated or unvaccinated can freely go into residents rooms, no appointments, nada. I actually walked right in to one today to do a ladies hair. All they required was me taking my own temp and signing in to say who I was visiting. No one was there to intimidate you. Signing in has always been required when visiting anyway. I was surprised to see staff not dressed in PPE, some not even in masks. It was pretty much like it was before Covid.

Yes, family members and friends can visit residents now. But the staff has to be vaccinated or have an exemption from the vaccine. But on the other hand the state auditors don’t have to be challenged about whether or not they’re vaccinated. Tell me again what this is about?

I worked with a couple of RN’s at nursing homes in MO. The staffing is so poor that the facilities have not mentioned a mandate to be vaccinated to them. One nurse told me the home (private pay) she works at literally hired a heroin addict and meth addict, who do nothing, to get “warm bodies in for when state inspects them”. She said the administrator has suggested to be vaccinated, but winks her eye at the same time. There’s a lot less people vaccinated at these places than we are led to believe.

Will be appealed up to a higher Missouri court. Cole county I think would be the lowest level judicial a circuit court. Then appealed to Missouri’s appellate court system. Then up to the Supreme court of Missouri. Good ruling just not enough teeth in it to flaunt Federal system overreach yet.

Most places get CMS funding in the neighborhood of 50-110% depending upon area/market/need. Basically the fed requirements are business model killers for most entities.

There is a flip side and one that they will not see coming. If you do not accept that funding, you are no longer subject to federal mandates. But you also run into issues with insurance companies not wanting to certify you as a place to do business with.

This creates a true conundrum. Places will go to a cash only basis. All of the free care many were accustomed to will no longer occur. Want help, gotta pay. This will create substantial safety issues to a point that security will be worse than fort knox in super low income areas to a point more will be harmed that are refused care as they get violent.

This is not a case of optics anyone really want to have happen. They are hoping everyone plays along. Something in the middle will unfold, I am just not sure what that will be yet.

That's what happened in Detroit: all of the grocery store chains left downtown because of all the shoplifting. I can see that happening in Portland, OR: no food or care downtown, a total wasteland.

I actually envisioned a change in store layout. Entry/exit corridors with AI controlled ingress/egress mechanism. Runs your id before you enter, and gets a debit/credit card number and auto charges you for anything ai cameras picked up you took but did not pay for. Or it detects shop lifting and knockout gas is administered to all in the corridor and either robotic assistants clamp the guilty parties in place for police pickup, or workers have to take the knocked out patrons into a demobilization station for authorities to sort stuff out...

AI is very efficient if if robbed of any external bias/inputs.

I suspect that a compromise will be made to support inner city grocery stores and provide immunity against more stringent measures.
