Australia – Northern Territory Chief Minister Michael Gunner this week announced the strictest vaccine mandate yet for frontline workers: Get the jab by November 13 or lose your job and face a $5,000 fine.

Sky News Australia reported:
Chief Minister Michael Gunner has made it mandatory for all frontline workers to be vaccinated in the Northern Territory.

Workers have until November 13 to get vaccinated, or they will not be able to continue working. They will also risk a fine.

“You must receive the vaccine if in the course of your work you come into contact with vulnerable people, your workplace has a high risk of infection, or you perform maintenance of essential infrastructure or logistics in the territory,” Mr Gunner said.
“Not wanting a vaccine is not a sufficient reason,” Gunner said.

Jen Psaki Accidentally Confirms That No Biden Federal Vaccine Mandate Actually Exists

White House Press Secretary Jen Psaki made the surreal argument on Tuesday that Florida Governor Ron DeSantis and Texas Governor Greg Abbott are “putting politics ahead of public health” by protecting citizens’ fundamental freedom of choice on Covid-19 vaccines.

In the course of her diatribe, however, Psaki admitted something that has been bubbling on the media backburners for some time: Biden’s vaccine mandate currently doesn’t even exist. Watch:

Rumble video on website 1:05 min

“His requirements are promulgated by a federal law,” Psaki claimed. “So, when the President announced his vaccine mandates for businesses, that, of course, we’re waiting on OSHA regulations as far as the next step.”

As earlier reported on Becker News, Biden’s federal vaccine mandate was announced over a month ago. The OSHA directive that would be the enforcement mechanism for the executive order, however, has not been issued.

Legal analysts expect that such a directive would likely be struck down in court, as 24 state attorneys general explained in a letter to the Biden administration.

“That was pursuant to federal law and the implementation of federal law, because it’s an executive order,” Psaki continued. “So, our intention is to implement and continue to work to implement these requirements across the country, including in the states where there are attempts to oppose them.”

The most recent example of state opposition has been Texas, where Governor Greg Abbott on Monday issued an executive order forbidding the enforcement of any vaccine mandates in the state. Florida and Montana are also strongly opposed to vaccine mandates, while 21 states have banned vaccine passports.

“I will say, since you gave me the opportunity, Governor Abbott’s executive order banning mandates, and I would also note announcement by Governor DeSantis this morning essentially banning the implementation of mandates, fit a familiar pattern that we’ve seen of putting politics ahead of public health,” the devilishly dressed Psaki claimed. “Over 700,000 American lives have been lost due to Covid-19, including more than 56,000 in Florida and over 68,000 in Texas. And every leader should be focused on supporting efforts to save lives and end the pandemic.”

On Tuesday, Southwest’s CEO announced that “we are not going to fire any employees” over the company’s vaccine mandate, and pointed to the Biden policy as the reason for the mandate’s issuance. However, the Southwest Pilots Association on Friday filed a lawsuit against Southwest ahead of a weekend of massive operational disruption; the lawsuit was filed in U.S. District Court in Dallas, Texas.

In a court battle that has been described as a ‘test case’ for the Biden federal vaccine mandate, a federal judge has halted the enforcement of New York’s vaccine mandate on equal protection and First Amendment grounds. Thus, employers who are complying with the currently non-existent mandate are doing the Biden regime’s ‘dirty work.’ Despite an expected legal defeat for the Biden administration, they are carrying out mass firings of employees ahead of the holidays.

If the state court cases and the brewing federal court battles are any indication, it makes sense why the Biden administration would wait over a month to actually issue its federal vaccine mandate: The White House fully expects to lose in court.

Because so many Americans are willing to comply with unlawful orders, the Biden regime went ahead and announced it was issuing a ‘mandate’ anyway.

[COMMENT: An Executive Order is not a law. Only the legislature passes laws. The agencies then promulgate regulations according to the law to implement it. This is a long process requiring cost benefit and other analysis, as well as public comment. These steps re all posted in the federal register.

An EO is supposed to be a statement of internal policy to the agencies. However, the Department Heads are accountable to Congressional oversight in the implementation of the law.

We are a nation governed by laws and due process, not imperial dictates.]

Go Fund Me Takes Down Fundraising Campaign For Litigation Over Vaccine Mandate

WEDNESDAY, OCT 13, 2021 - 01:33 PM
Authored by Jonathan Turley,

We previously discussed how GoFundMe has joined social media sites in censoring opposing viewpoints on subjects from critical race theory to vaccines to election fraud.

The site once offered a neutral site for those seeking to support others with similar views or interests.

The company now insists that it will only allow people to gather on the site if it believes their views are true and correct.

However, it was still surprising to see the site take down a fundraising account for litigation against vaccine mandates.

The effort of former nurse Jennifer Bridges was simply to get such matters before the courts, which can be the ultimate authority on what is “misinformation.”

GoFundMe however blocked people from contributing to the litigation.

Bridges is a former registered nurse at Houston Methodist hospital who was fired after refusing to comply with the hospital’s vaccine requirement. She raised more than $180,000 for her lawsuit before being shutdown under the company’s “misinformation” policy. Heidi Hagberg, a spokesperson for GoFundMe, said in a statement to Business Insider that “when our team initially reviewed the fundraiser, it was within our terms of service as the funds were for legal fees to fight vaccine mandates. The fundraiser has since been updated to include misinformation which violates our terms of service.”

What is striking about this latest ban is that the courts are the place for such claims to be weighed in a neutral and dispassionate forum. “Misinformation” can be addressed by judges after both sides are allowed to present evidence. Bridges’ lawsuit was dismissed in June, Bridges’ attorneys appealed the decision. We should all favor such reviews. Indeed, if GoFundMe believes that Bridges is wrong, it should invite further judicial review to established a clear record on such issues.

GoFundMe admits to have taken down “hundreds” of fundraisers that included statements of “misinformation related to vaccines.”

I do not agree with the arguments against the vaccine. I and my family are vaccinated. However, I am equally concerned with avoiding the growing virus of censorship. In the last few years, we have seen an increasing call for private censorship from Democratic politicians and liberal commentators. Faculty and editors are now actively supporting modern versions of book-burning with blacklists and bans for those with opposing political views. The most chilling aspect of this story is how many on the left applaud such censorship. A new poll shows roughly half of the public supporting not just corporate censorship but government censorship of anything deemed “misinformation.”

Free speech can be its own disinfectant for bad speech.

GoFundMe is a private company and can impose such rules on users. However, it is an act of censorship and it is a denial of free speech by a corporation.

In this case, the company is preventing its site from being used to raise money to allow courts to review the factual and legal basis for these claims — a curious effort for a company that claims to be fighting “misinformation.”

Approved Version Of Pfizer's COVID-19 Vaccine Still Not Available In US

WEDNESDAY, OCT 13, 2021 - 10:50 AM
Authored by Zachary Stieber and Meiling Lee via The Epoch Times,

The approved version of the Pfizer-BioNTech COVID-19 vaccine is not available in the United States more than a month after drug regulators approved it, The Epoch Times has found.

Officials in 19 states confirmed this week they have not received the approved version, known as Cominarty. So did pharmacies in New York, California, and Missouri.

A Pfizer spokesperson told The Epoch Times in an email that there are no doses of Cominarty in the United States as of Oct. 12.

The lack of availability means vaccine mandates based on the Food and Drug Administration (FDA) approval are unlawful, lawyers representing clients challenging the requirements say.
“Under the emergency use authorization, everyone has an option to accept or refuse the product. And that means every person, military and civilian. So this is critical. All of the mandates, from the military to the civilian population, are violating federal law,” Mathew Staver, chairman of Liberty Counsel, a Christian legal group, told The Epoch Times.
The situation would be different if Cominarty was available, he said.

Contact with state and federal officials and pharmacies revealed widespread confusion regarding the differences between the approved Pfizer-BioNTech vaccine and the version that received emergency use authorization (EUA) in December 2020 and continues to be administered under EUA now.

A number of officials were unaware of any differences and others insisted they were the same for all intents and purposes, including several officials with the Department of Health and Human Services (HHS), which handles distribution of COVID-19 vaccines.

“It’s the same thing,” an HHS official told The Epoch Times.

That’s a different message than that being sent to states, some of which have been told by federal officials not to expect doses of Comirnaty for a while.
“The CDC anticipates that Comirnaty will begin to ship some time in November at the earliest,” a spokesman for the Arizona Department of Health told The Epoch Times in an email, referring to the Centers for Disease Control and Prevention.

“The Maryland Department of Health has been told by the CDC that Comirnaty will not ship until the end of October/beginning of November,” a spokesman with the Maryland Department of Health told The Epoch Times in an email.

“According to the latest update DOH has received from the CDC, shipments of Comirnaty likely won’t begin until next month,” a spokeswoman with the Washington State Department of Health told The Epoch Times in an email.
“We don’t expect vials with the brand name ‘Comirnaty’ affixed to them to be delivered until later in the year,” a spokesman with the Idaho Department of Health told The Epoch Times in an email.
A spokeswoman for the Tennessee Health Department said that the federal government still has a large amount of the authorized doses and there is no timeline on when Comirnaty will be shipped.

The only state expecting doses soon is Delaware. Officials there were told 5,850 doses manufactured after the Aug. 23 approval date should arrive this week, a spokeswoman for the Delaware Department of Health said.

The FDA referred questions to the CDC and HHS. The CDC did not respond to repeated queries. The HHS official who wasn’t aware of the differences alleged approved doses were available, but said she was “puzzled” by followup questions on when they started being available and how many are available and ultimately referred questions to the FDA. A different HHS official indicated the agency is not tracking when approved doses enter the distribution system.

The FDA approved the Pfizer-BioNTech vaccine on Aug. 23. On the same day, the drug regulator extended the EUA for existing doses and for children between 12 and 15.

The approval triggered vaccine mandates across the country, including for the Department of Defense. Many officials said they were waiting for the approval to impose mandates.

In the letter extending the EUA, Denise Hinton, the FDA’s chief scientist, said the vaccines are “legally distinct with certain differences that do not impact safety or effectiveness.” The letter is no longer available on the FDA’s website, though the same language is used in an FAQ on the approved vaccine, known as Comirnaty.

The FDA has declined to say what the differences are. Pfizer told The Epoch Times previously that they refer to certain manufacturing processes.

Signage is seen outside of the Food and Drug Administration (FDA) headquarters in White Oak, Md., on Aug. 29, 2020. (Andrew Kelly/Reuters)

In a followup missive on Sept. 22, Hinton wrote that the authorized and approved versions have “the same formulation” and that the products “can be used interchangeably to provide the vaccination series without presenting any safety or effectiveness concerns.”

Staver said that’s not accurate.
“You cannot interchange BioNTech’s Cominarty with Pfizer’s [shot] from a legal standpoint. They are legally distinct,” he said.
“The FDA-approved Comirnaty and the EUA-authorized Pfizer-BioNTech COVID-19 vaccine have the same formulation and, according to the FDA labeling, can be used interchangeably to provide the COVID-19 vaccination series,” a Pfizer spokesman told The Epoch Times.

Federal agencies in various documents have indicated recently there is little or no Comirnaty supply in the country.

Both of Hinton’s letters stated that there is an insufficient supply of Comirnaty in the United States to distribute to the U.S. population in its entirety.

A document posted by the CDC last month said Pfizer “does not plan to produce any product” with new labeling, referring to Comirnaty, “over the next few months while EUA authorized product is still available and being made available for U.S. distribution.”

Sen. Ron Johnson (R-Wis.) has questioned (pdf) why the existing doses were not approved and, given the lack of Comirnaty supply, whether the FDA was “de facto endorsing vaccine mandates utilizing EUA vaccines?”

The FDA declined to answer questions on the approval process. Several experts told The Epoch Times that federal law appears to preclude approving existing authorized products.

To cast a wider net on the matter, The Epoch Times also contacted 12 private companies, mostly pharmacies involved in vaccine administration.

Walgreens, Kroger, H-E-B Pharmacy, Publix Pharmacy, Thrifty White Pharmacy, the Mayo Clinic, and Novant Health did not respond to requests for comment.

CVS referred questions to the federal government. Northwell Health, a New York health care system, declined to comment.

The Legacy Specialty Pharmacy in Queens, New York said they do not have Comirnaty doses. A pharmacist at Lorena Pharmacy said he was not aware of any differences and thought the approval in August was only for booster doses, indicating they do not have Comirnaty. A pharmacist at Kilgore’s Medical Pharmacy in Missouri said they only get Moderna vaccine doses.

FDA Says No Need For Boosters As Moderna, J&J Plead Case

WEDNESDAY, OCT 13, 2021 - 07:00 AM

After a detailed review, the FDA's scientists have decided to hold off on approving Moderna's vaccine for a booster jab, the latest bad news for the company's bottom line. Documents published Tuesday show that Moderna's two-dose vaccine course generates enough immunity from the virus and the delta variant that a third dose is "unnecessary".

The decision creates the possibility that the agency could approve Pfizer for a booster jab but not Moderna.

1634169965824.png

Modern submitted its data to the FDA's Vaccines and Related Biological Products Advisory Committee asking for approval of a booster jab for most adults. The biotech upstart, which rose to prominence thanks to its mRNA technology that undergirds the most popular COVID jabs, argued that immunity provided by its jabs wanes over time, with some studies showing immunity starts to wane at around the six month mark. Some studies have suggested that natural immunity is more effective than immunity from the jabs.

In the report, the FDA said "... data indicate that currently US-licensed or authorized COVID-19 vaccines still afford protection against severe COVID-19 disease and death in the United States. There are many potentially relevant studies, but FDA has not independently reviewed or verified the underlying data or their conclusions."

After detailing all the studies undertaken to try and assess the safety of the booster jab, namely whether it would increase the risk of dangerous heart inflammation in men, a rare side effect that has been documented in the mRNA jabs, the FDA said it believes a booster is safe.
"In adults 18 through 64 years of age, with the exception of axillary swelling or tenderness of the vaccination arm (indicating lymphadenopathy), solicited safety data do not show evidence of increased frequency or severity of local or systemic reactions after the booster dose..."
While the documents released by the FDA on Tuesday show that the agency is likely holding off on recommending a booster jab - for now, at least - the advisory committee will still meet to discuss the proposal on Thursday.

In September, the FDA granted emergency clearance for a third booster dose of the Pfizer-BioNTech two-shot vaccine for older people, as well as patients at particularly high risk, or who are at risk because of their job.

But the news isn't all bad for Moderna: Earlier this month, an EU drug regulator signed off on booster jabs of Moderna's vaccine, as well as Pfizer's two-dose shot, for vulnerable patients, although the EU based the decision on patients who have weakened immunity due to having had an organ transplant.

J&J also just asked the FDA for approval of a booster jab for adults 18 and older, and both Moderna and J&J insist that they've gathered enough data showing that a booster jab should be justified for the general population.

That would be the best outcome for them, at least.

Australia Building Quarantine Camps For "Ongoing Operations"

WEDNESDAY, OCT 13, 2021 - 03:30 AM
Authored by Paul Joseph Watson via Summit News,

Despite some states tentatively beginning to lift lockdown restrictions, Australian authorities are building quarantine camps that won’t be completed until next year in order to prepare for “ongoing operations” and to house those “who have not had access to vaccination.”

According to ABC Australia, one such 1,000-bed quarantine facility at Wellcamp Airport outside Toowoomba will be fully completed by the end of March 2022.
“At this stage, the cabins will be used by domestic travellers returning from COVID hotspots,” states the report.
However, it also makes clear that the camp will be used for “ongoing operations” and will be a source of employment for the local area.

The camps is split into different zones and accommodates singles, doubles, and family rooms while being patrolled by police and security guards 24/7.

1634170558580.png

Citing new strains of COVID and people “who have not had access to vaccination,” Queensland Deputy Premier Steven Miles told the media outlet, “We anticipate there to be a continuing need for quarantine facilities.”

The government is leasing the land on which the camp is being built from the Wagner Corporation for 12 months with an option for a further 12 months after that.

Another 1,000-bed quarantine facility is also being built on a 30-hectare Army barracks site in the industrial area of Pinkenba, near Brisbane Airport.

“Why anyone who had left Australia would come back again is unclear,” writes Dave Blount. “It is possibly the most repressive country in the world regarding Covid tyranny.”

As we previously highlighted, state authorities in America are also constructing new “quarantine facilities” for Americans who are “unable to quarantine at home.”

As we reported last year, Authorities in Quebec City, Canada announced they will isolate “uncooperative” citizens in a coronavirus facility, the location of which remains a secret.

New Zealand also announced plans to place COVID infectees and their family members in “quarantine facilities.”

Back in January, German authorities also announced they would hold COVID dissidents who repeatedly fail to properly follow the rules in what was described as a ‘detention camp’ located in Dresden.

Military Archbishop Says Vaccine Mandate Could Violate ‘Conscience’

KRISTINA WONG13 Oct 202130

Archbishop for the Military Services, USA Reverend Timothy P. Broglio said Tuesday that while the Catholic Church has deemed coronavirus vaccines morally permissible, that does not preclude a service member from believing they would violate their conscience.

Broglio said in a statement:
Earlier this year, I affirmed that the Archdiocese for the Military Services, USA (AMS), clearly encourages the faithful entrusted to her care to follow the guidance of the Holy See and the United States Conference of Catholic Bishops (USCCB) with regard to COVID-19 vaccines.

The Congregation for the Doctrine of the Faith, which is the Church’s highest doctrinal authority, speaking for the Bishop of Rome, has made clear its position on the vaccines available to mitigate the Coronavirus pandemic. The USCCB Committees on Doctrine and on Pro-Life Activities have stated that it is morally permissible to receive the COVID-19 vaccinations currently available in the United States.

On 24 August 2021, the Secretary of Defense issued a memorandum directing the mandatory vaccination of all services members against COVID-19. Since then, some service members have refused to take the vaccine and have requested a religious accommodation through the Religious Freedom Restoration Act.

This circumstance raises the question of whether the vaccine’s moral permissibility precludes an individual from forming a sincerely held religious belief that receiving the vaccine would violate his conscience. It does not. [Emphasis added]
The military archdiocese also weighed in on which vaccines were more morally acceptable. Broglio said the Pfizer and Moderna coronavirus vaccines were tested using an “abortion-derived cell line,” which for centuries has been considered “remote” material cooperation with evil and “is never sinful.”

However, he said said the Johnson & Johnson vaccine was not only tested but developed and produced with abortion-derived cell lines, which is “more problematic.”

“If it were the only vaccine available, it would be morally permissible, but the faithful Catholic is to make known his or her preference for a more morally acceptable treatment,” Broglio said.

Broglio said that while the Congregation for the Doctrine of the Faith examined these moral concerns and judged that receiving these vaccines “does not constitute formal cooperation with the abortion,” and is therefore not sinful, “the Church treasures her teaching on the sanctity of conscience.”

“Conscience is the most secret core and sanctuary of a man. There he is alone with God, Whose voice echoes in his depths,” he wrote, adding:
St. Paul VI wrote:

In all his activity a man is bound to follow his conscience in order that he may come to God, the end and purpose of life. It follows that he is not to be forced to act in a manner contrary to his conscience. Nor, on the other hand, is he to be restrained from acting in accordance with his conscience, especially in matters religious.
“Accordingly, no one should be forced to receive a COVID-19 vaccine if it would violate the sanctity of his or her conscience,” Broglio said.

He added that individuals also possess the “civil right not to be hindered in leading their lives in accordance with their consciences.'”

“Even if an individual’s decision seems erroneous or inconsistent to others, conscience does not lose its dignity. This belief permeates Catholic moral theology as well as First Amendment jurisprudence. As stated by the United States Supreme Court, ‘[R]eligious beliefs need not be acceptable, logical, consistent, or comprehensible to others in order to merit First Amendment protection,'” he said.

He called denial of religious accommodations or punitive or adverse personnel actions taken against those who raise “earnest, conscience-based objections, would be contrary to federal law and morally reprehensible.”

However, he urged those refusing the vaccine to “act in charity” for their neighbors and for the common good by undertaking means to mitigate the spread of the coronavirus through wearing face coverings, social distancing, undergoing routine testing, quarantining, and remaining open to receiving treatment should one become available that is not derived from, or tested with abortion-derived cell lines.

NIH-Backed Study Finds Moderna, Pfizer Boosters Work Best

WEDNESDAY, OCT 13, 2021 - 09:05 PM

After months of dithering about the potential safety risks of mixing and matching various approved COVID vaccines, a long-running NIH-sponsored study has found that patients can safely and effectively receive booster shots from any of the major approved vaccines, even as the FDA's vaccine advisory committee has sounded lukewarm about the prospect of approving booster jabs for all adults over the age of 18.

According to Bloomberg, the complicated 9-arm trial involved over 450 people and measured the effects from giving a booster shot of the Moderna, Pfizer, BioNTech or J&J vaccines to those who had originally gotten a different vaccine. The data showed that the new jabs increased patients' levels of neutralizing antibodies, sometimes by more than would be expected if they received a third jab of the same vaccine they had received initially.
"These data suggest that if a vaccine is approved or authorized as a booster, an immune response will be generated regardless of the primary Covid-19 vaccination regimen," the researchers said in their conclusion.
In the abstract from the preprint of the study (which can be found on medrxiv.org) the researchers claimed they were embarking on this research because of the persistent breakthrough infections that continue to occur in some patients. While "homologous" mRNA booster jabs have received approval in some jurisdictions (Israel, and now the EUA, are now allowing some patients to receive a third dose of whatever initial jab they received)

In total, 458 individuals were enrolled: 154 received mRNA-1273 (Moderna), 150 received Ad26.CoV2.S (J&J), and 154 received BNT162b2 (Pfizer) booster vaccines. The study was sponsored and primarily funded by the NIH.

Participants were divided into nine groups with roughly 50 volunteers in each. Those who initially got the two-dose Moderna vaccine got either another Moderna shot, a Pfizer shot or a J&J shot as a booster four to six months after their primary immunization.

People who got the two-dose Pfizer vaccine got either another Pfizer shot or a Moderna or J&J booster. And people who got the one-shot J&J vaccine, either got another J&J shot, or a Moderna or Pfizer booster. Antibody levels were then measured at two weeks and four weeks after the booster dose.

Data showed that homologous boosters increased neutralizing antibodies by 4.2-20-fold while heterologous boosters created an increase of 6.2-76-fold.

The conclusion: Conclusion: "Homologous and heterologous booster vaccinations were well-tolerated and immunogenic in adults who completed a primary Covid-19 vaccine regimen at least 12 weeks earlier."

Notably, the study found that for patients who initially received the J&J jab, switching to an mRNA jab (Pfizer's or Moderna') for the booster dose might afford them better protection. Regardless of the initial jab, Pfizer and Moderna boosters appeared to work best.

More detail about the study are expected Friday afternoon during a meeting of an FDA advisory panel, where researchers conducting the trial are scheduled to give a presentation on their early findings. A panel will also meet Thursday to deliberate over Moderna's application for booster-jab approval.

New Zealand Forces Vaccination Mandate On All Education, Health-Care Workers

WEDNESDAY, OCT 13, 2021 - 07:45 PM

New Zealand announced late Monday that it would join the growing list of developed nations forcing workers - or at least certain workers - to choose: either accept the jab, or lose your job.

One week after Canada adopted mandatory vaccination rules for federal workers and travelers, New Zealand has announced its own vaccine mandates for most teachers and health care workers.

Per NZ's Liberal-led government, doctors, nurses and other health-care workers must be fully vaxxed by Dec. 1, while everyone working in education who has contact with students must be vaccinated by Jan. 1.
"We can’t leave anything to chance so that's why we are making it mandatory," said COVID Response Minister Chris Hipkins, who is also the country's education minister.
"Vaccination remains our strongest and most effective tool to protect against infection and disease," Hipkins said.
New Zealand briefly enjoyed COVID-free status after the initial global outbreak, but the country's "drawbridge" strategy was unable to keep out the delta variant, imposing a lockdown in Auckland, the country's largest city after confirming just a single case. As cases spread despite the tightening restrictions, the government was forced to finally abandon its "COVIDZero" strategy.

New Zealand PM Jacinda Ardern said the highly transmissible delta variant had proved a "game-changer" that can't be easily eliminated.

As kiwis confront the new system, the Guardian is reporting that New Zealand's epidemiology "experts" were taken by surprise when Ardern abandoned "COVIDZero". They said they weren't consulted about the government's new system, which will lessen restrictions in three stages.
“We were obviously surprised on Monday last week when the government seemed to say that we were moving away from elimination,” said prof Michael Baker, one of the country’s most prominent pandemic communicators and a member of the ministry’s Covid-19 Technical Advisory group. “A decision of that size – changing your major strategy – you’d think you would consult with [the] quite small batch of scientists and other advisers who work very hard to support the government … explaining things to the public.”
“That was very unusual. I think the government’s done a great job generally with consultation and getting us all to at least understand the rationale for change.”
Others insisted that the only way out for the country is full vaccination.

Now, keep in mind, New Zealand has confirmed fewer than 5K cases and fewer than 30 deaths.

Exclusive: Pfizer’s Nervousness About Its COVID Vaccine’s Origins Conceals a Horror Story

By Assistant Editor
Published October 13, 2021 at 7:16pm
pfizer-shots.jpg

That story, mostly unknown until now, should at an absolute minimum require the approval of any employee’s request for conscience-based religious exemptions from employer or government vaccination mandates.

On October 6, with the help of James O’Keefe’s Project Veritas (PV), a whistleblower at Pfizer revealed, in leaked internal emails, that company executives have been, in PV’s words, “telling staff to be secretive about the use of human fetal tissue in laboratory testing of the COVID vaccine.”

The video cites an email from the company’s senior director of worldwide research admitting that “One or more cell lines with an origin that can be traced back to human fetal tissue has been used in laboratory tests associated with the vaccine program.” The firm’s chief scientific officer specifically identifies the cell line involved as “HEK293T cells … (which) are ultimately derived from an aborted fetus.”

Pfizer’s resistance to disclosing the roots of its vaccine’s origins seems inexplicable for at least three reasons.

First, In December, the Catholic Church’s Congregation for the Doctrine of the Faith, in light of the degree of perceived emergency presented by the COVID-19 pandemic, indicated that “it is morally acceptable to receive Covid-19 vaccines that have used cell lines from aborted fetuses in their research and production process.” In non-emergency circumstances, such an action would be considered mortally sinful “cooperation in evil,” but the Congregation indicated that Pope Francis “examined” their work and “ordered its publication.”

Second, human fetal tissue research, though controversial (as just noted), has been conducted since the 1930s, and is said to have “helped to develop vaccines for a wide range of diseases, including polio, measles, mumps, rubella, hepatitis A and B, shingles and rabies.”

Third, HEK293, the cell line Pfizer cited, has existed for nearly a half-century, and has been widely used. To cite just one of many examples, HEK293 cells are credited with “many of the antipsychotic drugs used to treat mental illnesses like schizophrenia and bipolar disorder.”

One would think that these three factors, especially the Pontiff’s de facto blessing, would have caused Pfizer to promote, or at least strongly defend, its use of the HEK293 cell line as another shining example of scientific advancement resulting from human fetal tissue research.

The details of HEK293’s brutal – and from all appearances, until very recently, largely undisclosed – origins explain the company’s deep discomfort. Contrary to nearly a half-century of misrepresentation and obfuscation, HEK293’s creation did NOT arise from an “abortion” as everyday people understand it.

A very recent development serves to confirm this.

In August, the University of Pittsburgh effectively made a horrifying admission.

The Center for Medical Progress, which had to enlist the help of Judicial Watch before the university would respond to its Freedom of Information Act request, explained that the school’s GUDMAP program (full name: GenitoUrinary Development Molecular Anatomy Project), with the help of area Planned Parenthood abortion providers, was “allowing babies, some of the age of viability, to be delivered alive, and then killing them by cutting their kidneys out.”

Everyone reading this article should surely agree that once a baby is delivered alive, killing it should no longer be considered an abortion. Killing a delivered-alive baby is textbook infanticide.

Pitt’s researchers and Planned Parenthood had to resort to this gruesome butchery because it is the best and likely the only way to harvest certain usable body parts, particularly kidneys. Harvesting viable kidneys requires continuous blood flow, which in turn requires a beating heart, which in turn requires that the baby be alive (or at the very least almost always) outside the womb when the kidneys are removed.

The HEK293 line was created in the early 1970s. Months before the University of Pittsburgh’s admissions, AnnaMaria Cardinalli, an extraordinarily perceptive and conscientious writer, detailed the damning truth about its origins at Crisis Magazine in January:

… To harvest a viable embryonic kidney … sufficiently healthy children old enough to have adequately-developed kidneys must be removed from the womb, alive, typically by cesarean section, and have their kidneys cut out.

This must take place without anesthesia for the child, which would lessen the viability of the organs.

… The deliberate killing of an unwanted child (a little girl, in the case of HEK 293) took place in the tortuous manner it did precisely to obtain her organs for research. The harvest of her organs was the direct cause of her death, prior to which, she was a living child, outside the womb.

In email correspondence, Ms. Cardinalli indicated, based on her own discussions with medical experts and “the test of reason,” that in her view, “we are genuinely speaking of clear infanticide, not abortion.” In her article, she also indicated that she fears that “Pope Francis and Pope Emeritus Benedict may not have had this information when they received the vaccines.”

In the decades since HEK293’s creation, its two most directly involved scientists, Drs. Alex van der Eb and Franklin Graham, have been vague in explaining the cell line’s origins.

As seen in a draft transcript from a 2006 FDA conference (on Page 81), Dr. van der Eb claims that “The kidney of the fetus was obtained in 1972, probably. The precise data is not known anymore. The fetus, as far as I can remember, was completely normal. Nothing was wrong. The reasons for the abortion were unknown to me. I probably knew it at the time, but it got lost, all this information.”

Graham says that “the exact origin of the HEK293 fetal cells is unclear. They could have come from either a spontaneous miscarriage or an elective abortion.”

Cardinalli, who was not aware of Graham’s possible “miscarriage” speculation when she wrote her article, asserted that “There is no way that a spontaneous abortion could result in the cell line (as the kidneys cannot remain viable past the brief window in which they must be harvested).” It’s quite revealing that Dr. Graham speculated about something which seems so clearly impossible.

Regardless of whether either scientist’s memory improves, it’s hard to imagine how they would be able to describe their work as anything other than what Cardinalli described, and what the University of Pittsburgh’s statement confirmed.

They are, of course, welcome to try.

In the meantime, it’s indefensible that an employer or government entity should attempt to force individuals to get jabbed or lose their jobs or forfeit other privileges based on a vaccine whose development originated in infanticide.

Dr. Bridle: “We Made a Big Mistake…We’re Inoculating a Poison”
By
M. Dowling
-October 13, 2021

Research obtained by a group of scientists shows the COVID vaccine spike protein can travel from the injection site and accumulate in organs and tissues including the spleen, bone marrow, the liver, adrenal glands and in “quite high concentrations” in the ovaries.

This is what Dr. Robert Malone, inventor of the mRNA technology warned about.

The spike proteins are not staying at the injection site and they are dangerous.

Protein in the blood can be very dangerous.

A Canadian cancer vaccine researcher said last week, “We made a big mistake.

We didn’t realize it until now,” said Byram Bridle, a viral immunologist and associate professor at University of Guelph, Ontario. “We thought the spike protein was a great target antigen, we never knew the spike protein itself was a toxin and was a pathogenic protein. So by vaccinating people we are inadvertently inoculating them with a toxin,” the Defender reports.
There was a peer-reviewed study…the spike protein that the vaccine causes our body to manufacture…gets distributed throughout the blood system, but probably even greater concern for is this evidence that the vaccine itself — that carries the little blueprint for the spike protein coronavirus — goes throughout the body and seeds all kinds of tissues including at quite high concentrations…un, the ovaries…
~ Dr. Byram Bridle
THE STORY
Dr. Bridle had filed a request for information from the Japanese regulatory agency to get access to Pfizer’s “biodistribution study.” That type of study helps determine where an injected compound travels in the body and which tissues or organs it accumulates in.

“It’s the first time ever scientists have been privy to seeing where these messenger RNA [mRNA] vaccines go after vaccination,” Bridle said in an interview with Alex Pierson where he first disclosed the data. “Is it a safe assumption that it stays in the shoulder muscle? The short answer is: absolutely not. It’s very disconcerting.”

“The Sars-CoV-2 has a spike protein on its surface. That spike protein is what allows it to infect our bodies,” Bridle explained. “That is why we have been using the spike protein in our vaccines,” Bridle said. “The vaccines we’re using get the cells in our bodies to manufacture that protein. If we can mount an immune response against that protein, in theory we could prevent this virus from infecting the body. That is the theory behind the vaccine.”

“However, when studying the severe COVID-19, […] heart problems, lots of problems with the cardiovascular system, bleeding and clotting, are all associated with COVID-19,” he added. “In doing that research, what has been discovered by the scientific community, the spike protein on its own is almost entirely responsible for the damage to the cardiovascular system, if it gets into circulation.”

When the purified spike protein is injected into the blood of research animals, they experience damage to the cardiovascular system and the protein can cross the blood-brain barrier and cause damage to the brain, Bridle explained.

The biodistribution study obtained by Bridle shows the COVID spike protein gets into the blood where it circulates for several days post-vaccination and then accumulates in organs and tissues including the spleen, bone marrow, the liver, adrenal glands and in “quite high concentrations” in the ovaries.

“We have known for a long time that the spike protein is a pathogenic protein, Bridle said. “It is a toxin. It can cause damage in our body if it gets into circulation.”

A large number of studies have shown the most severe effects of SARS-CoV-2, the virus that causes COVID, such as blood clotting and bleeding, are due to the effects of the spike protein of the virus itself.

He is most worried that the message it carries goes with it and seeds all kinds of tissues, he explained on The Ingraham Angle.

Open Letter from Southwest Airlines Employee to CEO Gary Kelly is a MUST READ
Open Letter from Southwest Airlines Employee to CEO Gary Kelly is a MUST READ

by JD RUCKER
October 13, 2021

It’s a shame that Facebook is such a sham of a company that it’s impossible to locate a source for the letter below. We found a secondary source that reposted the letter, but the identity of the original poster is a mystery.

This crossed my desk through a Tweet by Representative Chip Roy. Sadly, the comments to the thread focused on the anonymity of the poster rather than the message itself. This is a shame because the content of the post is rock-solid. It doesn’t matter that we do not know who wrote it. It really doesn’t even matter if it was truly written by a Southwest Airlines employee or not. The message to CEO Gary Kelly is crystal clear and 100% spot on. Whether he was handed the letter, finds it on Facebook or Twitter, or reads it here, the truth of this letter is undeniable.

1634185565480.png

Reports indicate Southwest Airlines, which has been plagued with flight cancellations due to “weather” (aka employee protests), has essentially bowed to the Biden-Harris regime and their pseudo-mandate for medical tyranny intended to force as many Americans as possible to “choose” to be vaccinated for Covid-19 if they want to continue to operate in society. The letter to the CEO offers an alternative path in which the company joins patriotic Americans in fighting the mandates.

If someone wants to get vaccinated or not, it should be their choice. The narrative that this is a “pandemic of the unvaccinated” is demonstrably false as mountains of data indicate the vaccines neither protect people from getting infected nor do they prevent people from infecting others. They may be viable as a mitigating factor against severity of one’s illness, but even if that’s true it belies the predicate for a mandate.

Vaccinated or not, anyone can contract Covid-19, Vaccinated or not, anyone can spread Covid-19. The mandates are authoritarian plays that will not prevent or even slow the spread of the disease. This is about segregation and pressuring people who do not want to be jabbed for whatever reason. That is an unAmerican notion prima facie.

Here is the letter. Again, I don’t care who wrote it. The only thing that matters is who reads it, and the leadership of Southwest Airlines must be among those who take the message to heart…

The Big Choice
It’s time to embrace the national discussion instead of finger-pointing who’s to blame over last weekend’s meltdown. The elephant in the room IS the mandate and the termination of thousands of employees and disruption of air travel after Nov 24th.

Amazingly, Southwest Airlines finds itself at the center of what is likely one of the most pivotal moments of our lifetimes and nation! There is no going back to “normal” or whatever you want to call pre-Oct 4th when the mandate was announced. There are two paths. Two choices, that senior leaders can embrace as a company.

Choice 1: “There’s nothing we can do about the mandate”
We continue to uphold and force compliance with the mandate. Thousands of employees will make their stand, lose their jobs or be sidelined by exemptions across all departments. Our holiday schedule will be a complete disaster and make last weekend or any other operational meltdown seem insignificant in comparison. Those that remain will bear the brunt of endless JAs, passenger furor, and what remains of the Southwest Airlines brand will be utterly destroyed in a matter of months.

An emboldened Federal Government WILL pass laws requiring all passengers to be vaccinated for air travel. As of Oct 11th, according to the Mayo Clinic, 56.6% of the country is fully vaccinated. A struggling recovery will be decimated as a significant percentage of our customers, the unvaccinated, are sidelined due to continued government overreach. All of Southwest’s plans for next year – new hires, new aircraft, route expansion – come to a screeching halt as the company tries to remain viable. Too harsh? Maybe… but not unrealistic in the slightest.

Choice 2: “We reject the lie that there is nothing we can do about the mandate”
We stand united in opposition of the mandate and drive change in our government.

There is a great awakening taking place across this country to the dangers posed by tyrannical mandates and the American public is rallying to our cause. No one should be faced with the loss of their career and economic destruction over a mandate. This is America, we do not have a king. We are a nation with a government purposefully encumbered with checks and balances. That system is in peril.

Humorously enough, we are the company of flag ties, “Freedom One”, and pride ourselves on the type of principled people with a “Warrior Spirit” that we hire. We had an entire ad campaign with the tagline “you are now FREE to move about the country”. Perhaps it’s not by accident that our company, of all companies, now finds itself at the center of national discussion on the right and the freedom to choose. How ironic is it that our employees are willing to stand up and face termination for the very values and principles they were hired for and this company supposedly embraces?!

Choose to make a stand for all of our employees and re-engage with the White House on the contract terms or scrap it altogether. Our business will grow exponentially as millions of Americans who have rallied to our cause scramble to fly on the “freedom airline”. We will not have enough airplanes and crews to keep up with demand. The nation is rooting for us to get this right — to win this battle before it comes to their doorstep and they are faced with the same terrible choice. Ed Bastian is watching. Doug Parker is watching. The politicians in DC and the President of the United States are watching. This is our chance to truly become the world’s most loved, most flown, and most profitable airline. This is a historic moment — what will your legacy be Mr. Kelly?

How Americans can resist coronavirus shot mandates – a comprehensive guide
Here is a comprehensive list of resources, including sample exemption letters, for Americans seeking relief from forced coronavirus injections.

Fri Sep 10, 2021 - 4:52 pm EDT

(LifeSiteNews) – Americans in many different fields of work are suddenly having to choose between taking an abortion-tainted, poorly tested, and dangerous coronavirus injection or being fired from their jobs. Students are also having their educational opportunities denied without proof of COVID-19 vaccination. As many conservative commentators on Twitter are pointing out, over the course of 18 months, “15 days to slow the spread” turned into “two shots to feed your family.”

President Joe Biden’s September 9 announcement, that all employers with over 100 employees will soon be required to force those employees to receive coronavirus injections or submit to weekly testing, will impact an estimated 80 million Americans. The edict is stricter for federal employees and contractors, and healthcare workers at facilities that receive Medicaid or Medicare: they must submit to the vaccine and there is no testing opt-out option. It does appear that religious and medical exemptions will be accepted by the government.

Most of the below exemption resources can be used by physicians, nurses, students, or employees of any company. Most are not specific to any field.

Read this resource carefully and fully to determine the best letter for your situation. Obtaining an exemption is not overly complicated.

Notice to readers: If you are aware of any additional resources that have been missed in this document, please click here and choose “Submit a News Tip” to send your information. This document will be updated as additional information is received and verified. Obviously, nothing in this article is meant to constitute legal advice.

MILITARY
The exception to the above note about the ease with which exemptions can be obtained is the military.

Here is what Children of God for Life says about military vaccine exemptions:
Military personnel in active duty may or may not be allowed an exemption depending on permission granted by the Commanding Officer. (Read the story of one US Coast Guard officer who fought and won.) However, military dependents are allowed religious exemptions.
Military matters are further complicated because active-duty military personnel essentially give up some of their basic rights upon joining the armed forces. The military even has its own legal system through which members can be court-martialed. “The application of military law to members of the military reflects a recognition that such individuals are subject to different duties and expectations than civilian citizens,” Justia explains.

This is the only sample language for requesting a religious accommodation or exemption for members of the military of which LifeSiteNews is aware.

Service members should also carefully read this primer from Children’s Health Defense on religious liberty and vaccine exemptions in the military.

PRIESTS
Biden’s mandate that all employers with over 100 workers force their employees to be injected will impact every diocese and likely almost every Catholic university in the U.S. How strictly the vaccine will be forced upon priests and laity employed by Catholic institutions will depend on how far left the diocese or school is. Catholics who can’t get a medical exemption may well need to find another job. Priests are in a particularly difficult situation. Priests can contact LifeSiteNews or attempt to use one of the below resources if they are trying to avoid being jabbed.

OPTIONS FOR MOST PEOPLE

Options for avoiding an employer- or university- mandated vaccine are: obtain a medical exemption, obtain a religious exemption, ask for accommodation (like being allowed to work from home if one works for a small company), or sue.

US Canada Catholic

State law matters: Employees will have much recourse if they live in a state like Florida, rather than New York, Oregon, or California. Fourteen Republican governors have said they will push back against Biden’s vaccine edict.

Meanwhile, Montana law actually prohibits proof of coronavirus vaccination as a condition of employment. How will that work for huge companies like Amazon or Walmart?

Thomas More Society, a not-for-profit, national public interest law firm dedicated to restoring respect in law for life, family, and religious liberty, has published guidelines for those seeking exemption to the COVID vaccine mandates.

MEDICAL EXEMPTIONS
If you have a contraindication to the coronavirus vaccine or are seeking a medical exemption based on previous infection and thus natural immunity to the coronavirus, the easiest way to file a medical exemption is by getting a trusted doctor to write one for you.

Pregnant women, those with allergies to vaccine ingredients, people who went into anaphylactic shock or had a similar adverse reaction after their first coronavirus vaccine dose are also likely to seek medical exemptions.

Screen-Shot-2021-09-10-at-12.41.57-PM.png

RELIGIOUS EXEMPTIONS
Many Christians oppose the taking of vaccines that were tested on or contain body parts of aborted babies (a full chart showing which vaccines in use in the U.S. – and not just those for COVID-19 – were created unethically and which were created ethically can be accessed HERE). Others oppose vaccination for other reasons.

As numerous Catholic bishops have explained, the moral teaching of the Catholic Church holds that “a person may be required to refuse a medical intervention, including a vaccination, if his or her conscience comes to this judgment.”

Recent documents and statements from the Vatican, the Pontifical Academy for Life, United States Conference of Catholic Bishops, and modern catechetical teachings note that although the Church allows Catholics to take abortion-tainted vaccines or medicines if no other options are available and the intent is to preserve life, vaccination itself must be voluntary.

Catholics opposed to taking the coronavirus vaccine needn’t necessarily submit a Catholic-specific letter but can use a more general Christian letter that does not contradict Catholic teaching. Given the divide amongst U.S. bishops and in the hierarchy in general about the vaccine, this may be wise.

Part 2 of 2

Liberty Council has a sample letter for Christians who do not want to take the coronavirus vaccines for religious reasons.

“In order for an employee or student to prevail under a claim for a religious exemption, whether based on pro-life or other religious beliefs, religious beliefs must be sincerely held, and the requested accommodation must be ‘reasonable,’ and not constitute an undue hardship on the employer or institution,” Liberty Council explains. “The manner in which the employer or institution continued its operations in 2020, prior to the availability of the COVID shots, establishes a baseline of treatment of employees or students that is not an ‘undue hardship.’ It will NEVER be an ‘undue hardship’ for the entity to allow the employee or student to continue doing what was considered ‘safe and effective’ or ‘mitigating’ in the absence of the vaccine.”

The eminent legal group continues, “However, such treatment may become discriminatory, if novel or additional restrictions or requirements are applied to the person who should otherwise be exempt. If the COVID shots work, those people who have received them are protected, and it is not an undue hardship for individuals who have religious objections to not receive such shots.”

Liberty Council also provides a sample “pastor verification letter.” Such a letter “is beneficial to proving the sincerity of the belief, but is not legally required. It is nonetheless very helpful in substantiating a claim that one’s belief is religious in nature, and that it is sincere.”

Liberty Council urges people not to copy the text of their sample letters verbatim but let them serve as a “guide only.”

Liberty Council has a simple process on their website that anyone seeking a religious exemption can follow:
  1. Watch Vaccine Exemption Guide Video with Mat Staver
  2. Fill out our legal help form
  3. Ask employer for a religious exemption – Sample Letters
Liberty Counsel Sample
– PERSONAL
– CLERGY
Liberty Council also has a huge trove of legal and medical information about coronavirus vaccines on this page, which they regularly update.

America’s Frontline Doctors has a list of statements from different faith leaders (Catholic, Jewish, Evangelical/Non-denominational Christian) about the coronavirus vaccines that can be used to support religious exemptions or help formulate a person’s exemption.

Although, as noted above, it is not generally legal for employers to demand verification from a religious leader of a person’s deeply held beliefs, it can be beneficial.

The Catholic bishops of Colorado have a letter template that Catholics can have their pastors sign when seeking a religious exemption from a vaccine mandate.

Another option for Catholics is to join the Confraternity of Our Lady of Fatima. Members or those wanting to become members can follow the simple process outlined on this page to request a personally signed letter from Bishop Athanasius Schneider. His Excellency will attest to a person’s membership in a Catholic organization, namely the Confraternity of Our Lady of Fatima, that holds that abortion-tainted vaccines are gravely immoral.

The Confraternity of Our Lady of Fatima also provides the following religious exemption letter template which can be downloaded and modified.

“It has been reviewed by trusted legal counsel,” the Confraternity says. “However, it is not legal advice and it does not guarantee you will receive an
accommodation. You should carefully review this language and confirm that it accurately reflects your individual beliefs and objections.” The Confraternity also notes that the Thomas More Society accepts requests for legal help via this form.

First Liberty
has produced a very easy-to-read pamphlet on religious liberty and vaccines that includes sample language for requesting a religious accommodation or exemption. The samples are:
  • A general request for a religious accommodation based on Christianity.
  • A request for an accommodation focused on the teachings of the Catholic Church, which includes an accompanying essay by Father Kevin Flannery, S.J., “Avoiding Illicit Involvement with Evil.”
  • A request for an accommodation focused on the teachings of Islam provided to us by Dr. Abdullah bin Hamid Ali, Associate Professor of Islamic Law at Zaytuna College.
  • A military exemption request for religious accommodation form. (LifeSiteNews is not aware of any military-specific sample religious exemption letters other than this one.)
Personhood Alliance also provides a sample religious exemption letter that can be printed and signed.

Richmond, Virginia-based Founding Freedoms Law Center provides via its website sample religious exemption request letters for employees and college students. It also provides a sample Virginia certificate of religious exemption for all childhood vaccinations typically required for school attendance, and exemption letters related to face masks.

Children of God for Life provides a sample Catholic religious exemption here. The group provides more information about religious exemptions to vaccines here.

Advocates for Faith & Freedom has a form through which people can request a religious exemption letter template.

Andrew Torba of Gab has posted a sample religious exemption template for college students that addresses the fact that many students entering college in the U.S. will have received childhood vaccinations that were unethically made or to which they may not necessarily have been able to consent.

Lawyer Robert Barnes has posted at this link a sample religious exemption letter.

The above resources are free. For anywhere from $59 to $175, TheHealthyAmerican.org will provide religious exemption consulting and the option to mail forms to a pastor to be signed. The group also provides a fact sheet about religious exemptions.

For approximately $1,400 (the cost varies based on the situation), the lawyers at the high-powered law firm Siri & Glimstad will provide individualized assistance with preparing, filing, and obtaining medical or religious exemptions. Their intake form is available here.

SUING

The Republican National Committee has already announced it is suing Biden over his employer vaccine mandate.

“Like many Americans, I am pro-vaccine and anti-mandate,” said RNC Chairwoman Ronna McDaniel. “Many small businesses and workers do not have the money or legal resources to fight Biden’s unconstitutional actions and authoritarian decrees, but when his decree goes into effect, the RNC will sue the administration to protect Americans and their liberties.”

The Daily Wire has also retained legal counsel and will not comply with the mandate.

Liberty Council lists instructions at the bottom of this page for nursing students, students, and employees whose requests for religious exemptions to the vaccine have been denied. Nursing students, students, and employees seeking legal help can follow those instructions to contact Liberty Council about next legal steps.

America’s Frontline Doctors has a form through which you can contact them if you are looking for an attorney in your state to help if your employer is attempting to force you to take the vaccine.

Anyone wishing to make his or her employer aware of possible liabilities of mandating the coronavirus vaccines can give his or her employer this form (provided by America’s Frontline Doctors) and ask that the employer fill it out.

(The form is also available here.) He or she can then go to this link and click “vaccine public letter,” edit the parts in red, and deliver it to his or her employer.

The New Civil Liberties Alliance is representing people who have natural immunity to the coronavirus in their legal battle against Michigan State University’s vaccine mandate. Their website does not advertise that they are taking new clients, but their legal reasoning may be useful to any attorneys with which you are working.

Roger Severino, the former Director of the Office of Civil Rights at the U.S. Department of Health and Human Services (HHS), has noted that it is against the Americans with Disabilities Act (ADA) to force unvaccinated employees to be tested for the coronavirus. Forcing employees to submit to medical tests is technically against the ADA, but LifeSiteNews is not aware of any lawsuits that address this yet.

The “vax-or-test” schemes that the federal government has mandated for private employers with over 100 workers appear to violate the ADA and could easily be challenged in court.

“Some argue that even if irrational or retaliatory, forced COVID testing does not impose a big enough indignity to sue over,” Severino wrote on July 30, 2021.

“Let’s not be naïve. The DOJ memo and yesterday’s announcement are merely dress rehearsals for the ultimate goal of imposing a national vaccine mandate.”

“When asked…about whether he has the power to do such a thing, Biden said it is still an open question,” he warned. “In truth, the answer comes down to one thing — whether or not Biden thinks he can get away with it. Like the proverbial slow-boiling frog, if there is not a strong reaction now, we’ll all be cooked soon.”

As evidenced by yesterday’s vaccine mandate announcement, Biden apparently does indeed think he has the power to impose what essentially amounts to a national vaccine mandate. It’s now up to regular Americans who don’t want the federal government dictating their deeply personal and consequential medical decisions to stand up and fight back in every way possible.

White House on Vaccine Mandates: ‘Federal Law Overrides State Law’

By Nick Ciolino
October 13, 2021 Updated: October 13, 2021

The White House says recent actions taken by Republican governors, to oppose forthcoming federal COVID-19 vaccine mandates for private businesses, will be overridden.

President Joe Biden’s executive order, announced Sept. 9, is set to require all workers at private businesses with 100 employees or more to be vaccinated against the CCP virus, which causes the disease COVID-19, or show a weekly negative test.

An Emergency Temporary Standard (ETS) from the Occupational Safety and Health Administration (OSHA) implementing the order is expected in the coming weeks.

In an act of opposition, Texas Gov. Greg Abbott issued his own executive order banning Texas businesses from requiring vaccines for employees, or customers.

And the Florida Department of Health released a list of businesses under investigation for requiring vaccination—a move in line with Florida Gov. Ron DeSantis’ threats to impose a $5,000 fine per violation to local governments, schools, and businesses that impose mandates.

At Monday’s White House briefing, press secretary Jen Psaki said the actions taken by the governors “fit a familiar pattern that we’ve seen of putting politics ahead public health.”

“Over 700,000 American lives have been lost to COVID-19, including more than 56,000 in Florida and over 68,000 in Texas,” Psaki added. “Every leader should be focused on supporting efforts to save lives and end the pandemic. Why would you be taking steps that prevent the saving of lives, that make it more difficult to save lives across the country, or in any state.”

Psaki also says the health administration rule will override Abbott’s executive order.

“We know that federal law overrides state law,” she said. “I would note that earlier when we put out our guidance on the president’s announcement about mandates several weeks ago, it made clear that … requirements are promulgated pursuant to federal law and supersede any contrary state, or local law or ordinance.”

At least one Texas law expert agrees with Psaki.

“I think that, yes, when OSHA promulgates [the ETS] it will preempt Abbot’s order to the extent that OSHA holds jurisdiction,” Professor of Law at the University of Texas at Austin Tom McGarity told The Epoch Times.

McGarity adds that while a number of Republican state attorneys general have vowed to challenge the temporary standard when it comes out, he thinks they will lose in court.

“My view is that it’s probably authorized by the Occupational Safety and Health Act, because I think that there is a grave danger in workplaces that is posed by COVID, and that’s what OSHA needs to find is there a grave danger,’ said McGarity.

The OSHA law on ETS states: “Under certain limited conditions, OSHA is authorized to set emergency temporary standards that take effect immediately and are in effect until superseded by a permanent standard. OSHA must determine that workers are in grave danger due to exposure to toxic substances, or agents, determined to be toxic, or physically harmful, or to new hazards and that an emergency standard is needed to protect them.”

I watched the video referenced in this article. If true it's obviously incredibly disturbing that they are firing unvaxxed healthcare providers and replacing them with possibly UNVAXXED workers from FEMA, but like all things you find on the internet, how do you verify it? So take it for what it's worth....

Bombshell: UNVaxxed FEMA Nurses Replacing Texas Nurses Who Refused Vaxx (Video)
Tim Brown
October 12, 2021

A Texas woman dropped a bombshell this week when she took to social media to recount an encounter she had at a local Texas hospital. While nurses and doctors are being mandated to take an experimental COVID shot or lose their jobs, all in violation of the Nuremberg Code, federal and state laws, the unconstitutional Federal Emergency Management Agency (FEMA) is busing in their own “unvaccinated” nurses and doctors to replace them.

Andie Collard is a swim coach of over 25 years in McKinney, Texas who had the encounter and spoke about it on her Facebook page.

Collard claims to have gone to Medical City in Texas to visit a friend. While there, she and her friends noticed a large charter bus outside the hospital. So, they approached a woman who was standing outside the charter bus to see what was going on.

The woman they spoke to was wearing scrubs and had a mask on and claimed to be a nurse. The woman then said she was from Wisconsin and the several nurses had been bused in to replace the nurses who would not take the experimental COVID shot.

At this point, the woman was asked why she and others were bused in to which she responded that doctors and nurses were leaving.

When asked why they were bused in when there were plenty of doctors and nurses available in the area, the woman declared it was because of the “COVID search.” [MY COMMENT: surge, not search]

Mrs. Collard recounted last year they claimed the hospital was full of COVID patients but the reality was that there were only about 15% of the beds assigned for the alleged COVID patients.

She then asked if most people, which is questionable, are “vaccinated,” then why is there a “COVID search”?

The response from the woman, after stepping back a bit, was “I can’t say.”

While the woman would not acknowledge why doctors and nurses were leaving, she did acknowledge that all employees of the hospital were mandated to get the shots or lose their jobs.

However, when the woman was asked what hospital she was from, she said that she was not from a hospital but from FEMA and so were all the other nurses on the bus.

When asked if FEMA required all their nurses to be “vaccinated,” the woman said that they were not required and that it was a choice.

So, get this, these federal lackeys are going to be paid to work in the same hospital, with the same patients, treating the same illnesses as those who are being forced to get a shot, which they refuse. These FEMA nurses and doctors are actually taking the jobs of those who are being unlawfully mandated to take and experimental poison into their bodies or lose their jobs.

Mrs. Collard then stated the obvious.

“The Obama administration, back in 2008, created a socialized healthcare system, Obamacare,” she said. “We are now seeing the effects of it.”

“When FEMA comes in, which is a governmental program,” she continued. “They’ve defunded our hospitals with the doctors and the nurses requiring them… those hospitals have literally decided their employees need to get vaxxed or they can leave, but it’s not about that It has nothing to do with that.”

Collard said, “This is a government takeover of our hospital.”

She then calls out the obvious double standard, and I would add that it’s a violation of the Constitution’s protections of equal protection under the law found in the Fourteenth Amendment, Section 1.

She then nails it about what socialized medicine really is and that is government sanctioned, controlled and mandated death care.

Collard called on others to band together to put a stop to this.

She wondered what the unions were saying about this, if they even knew.

Texas Governor Greg Abbott is right in there with it all in his shirking his actual duties as governor to play healthcare CEO in Texas.

In fact, he has been a part of banning local Texas nurses from quitting to work FEMA crisis contracts in the state, but he’s allowing FEMA doctors and nurses from all over the country to come in and steal the jobs of Texas healthcare workers faced with an unlawful mandate.

What’s even more interesting is the entire predictive programming that we have been witnessing for several years now. In this instance, take a listen to this clip from X-Files: Fight the Future, in which a “virus” will be unleashed and the “secret government” will take over. And what is that “secret government”? FEMA.

Don’t worry, it’s just a conspiracy theory, right?

Federal law does override conflicting state law if the federal law is within the legitimate scope of jurisdiction and authority. The courts try to read both state and federal law to accomodate both, however, if federal law occupies the entire field, state law cannot enter:

Here is a case that explains how it works:

CALIFORNIA COASTAL COMM'N v. GRANITE ROCK CO.(1987)

No. 85-1200
Argued: December 2, 1986Decided: March 24, 1987

To answer this question we follow the pre-emption analysis by which the Court has been guided on numerous occasions:
  • "State law can be pre-empted in either of two general ways. If Congress evidences an intent to occupy a given field, any state law falling within that field is pre-empted. [Pacific Gas & Electric Co. v. State Energy Resources Conservation & Development Comm'n, 461 U.S. 190 ,] 203-204 [(1983)]; Fidelity Federal Savings & Loan Assn. v. De la Cuesta, 458 U.S. 141, 153 (1982); Rice v. Santa Fe Elevator Corp., 331 U.S. 218, 230 (1947). If Congress has not entirely displaced state regulation over the matter in question, state law is still pre-empted to the extent it actually conflicts with federal law, that is, when it is impossible to comply with both state and federal law, Florida Lime & Avocado Growers, Inc. v. Paul, 373 U.S. 132, 142 -143 (1963), or where the state law stands as an obstacle to the accomplishment of the full purposes and objectives of Congress, Hines v. Davidowitz, 312 U.S. 52, 67 (1941)." John Catanzara, the head of Chicago’s police union, advised police officers NOT to comply with the city’s COVID-19 mandatory vaccine and reporting requirements.

Catanzara told fellow officers to openly defy Mayor Lori Lightfoot’s vaccine deadline.

The Chicago Tribune reported:
The head of Chicago’s police union has advised officers not to comply with the city’s COVID-19 vaccine reporting requirement and says members should be willing to be sent home without pay rather than submit to the shot mandate for city workers.

With city employees’ vaccine status deadline Friday, Fraternal Order of Police Local 7 President John Catanzara also said in a video posted Tuesday that the union has filed a labor grievance against the city and plans to pursue legal action to fight the mandate.

Mayor Lori Lightfoot, asked about his comments at an unrelated news conference Wednesday, said: “He’s threatening litigation. I say, bring it.”
Read the rest here.

For Chicago Public Schools, employees who are not fully vaccinated against COVID-19 by Friday’s deadline will still be able to work Monday, but they will have to undergo weekly testing at their schools, the district’s CEO said Wednesday.

John Catanzara announced he will go into a no pay status tonight following the deadline.

Biden Walks Away AGAIN without Taking Questions After Falsely Claiming Vaccine Mandates Had Nothing to do with Southwest Airlines’ Flight Cancelations (VIDEO)

Joe Biden on Thursday delivered remarks on his administration’s Covid vaccination efforts.

“Let’s be clear. Vaccination requirements should not be another issue that divides us,” Biden said as he announced the Labor Department will issue an emergency rule for companies with 100 or more employees to implement vaccination requirements.

Biden also said Covid vaccines for children ages 5-11 will likely be approved soon.

“If authorized, we are ready. We have purchased enough vaccines…Families will be able to sleep easier at night knowing their kids are protected as well,” he said.

Biden lied about Southwest Airlines and said the thousands of canceled flights had nothing to do with pilots boycotting his Covid vaccine mandate.

“We continue to battle the misinformation that’s out there…and companies are stepping up as well to combat this misinformation,” said Biden. “Southwest Airlines and its CEO dismissed critics who claim vaccination mandates contributed to flight disruptions…”

After lying for 10 minutes and struggling to read his teleprompter, Biden pivoted and shuffled away from the lectern.

Joe Biden once again refused to answer questions from reporters.
