DOJ Files Lawsuit Against SpaceX for Not Hiring Refugees

The Department of Justice (DOJ) has filed a lawsuit against Elon Musk’s company, SpaceX, claiming their hiring policies discriminate against refugees and asylees.

The lawsuit, filed on Thursday, alleges that “from at least September 2018 to May 2022, SpaceX routinely discouraged asylees and refugees from applying and refused to hire or consider them, because of their citizenship status, in violation of the Immigration and Nationality Act (INA).”

The Department of Justice said in a press release, “In job postings and public statements over several years, SpaceX wrongly claimed that under federal regulations known as ‘export control laws,’ SpaceX could hire only U.S. citizens and lawful permanent residents, sometimes referred to as ‘green card holders.'”

“Export control laws impose no such hiring restrictions,” the press release continued. “Moreover, asylees’ and refugees’ permission to live and work in the United States does not expire, and they stand on equal footing with U.S. citizens and lawful permanent residents under export control laws. Under these laws, companies like SpaceX can hire asylees and refugees for the same positions they would hire U.S. citizens and lawful permanent residents. And once hired, asylees and refugees can access export-controlled information and materials without additional government approval, just like U.S. citizens and lawful permanent residents.”

The agency claims that SpaceX “discouraged asylees and refugees from applying for open positions, through public announcements, job applications and other online recruiting communications that excluded asylees and refugees,” “failed to fairly consider applications submitted by asylees and refugees,” and “refused to hire qualified asylee and refugee applicants and repeatedly rejected asylee and refugee applicants because of their citizenship status.”

The press release states, “SpaceX hired only U.S. citizens and lawful permanent residents, from September 2018 to September 2020.”

“Our investigation found that SpaceX failed to fairly consider or hire asylees and refugees because of their citizenship status and imposed what amounted to a ban on their hire regardless of their qualification, in violation of federal law,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division. “Our investigation also found that SpaceX recruiters and high-level officials took actions that actively discouraged asylees and refugees from seeking work opportunities at the company. Asylees and refugees have overcome many obstacles in their lives, and unlawful employment discrimination based on their citizenship status should not be one of them. Through this lawsuit we will hold SpaceX accountable for its illegal employment practices and seek relief that allows asylees and refugees to fairly compete for job opportunities and contribute their talents to SpaceX’s workforce.”

It seems as though the government is once again putting the wants and needs of foreigners over those of American citizens.

The lawsuit seeks “fair consideration and back pay for asylees and refugees who were deterred or denied employment at SpaceX due to the alleged discrimination” and “civil penalties in an amount to be determined by the court and policy changes to ensure it complies with the INA’s nondiscrimination mandate going forward.”

The department is seeking foreigners rejected for jobs at SpaceX or “discouraged from applying” because they “were not a U.S. citizen or lawful permanent resident.”

The fed government has all businesses by the short hairs. Especially if they are employers.

Employers not only employ people but they also are solely responsible and mandated to collect and match income taxes, and other insurances, like UI and workers comp. Plus pay huge liability policies and keep lawers, and CPAs contracted to help keep them legal and legit.

So not only do employers pay to collect taxes and regulations, insurances and liabilities, but do it for free.

So for every employee there's at least a invisible and imaginary emoyee called the united states treasury, state comp, state UI and the insurance brokers. Who gets paid the same, but doesn't do anything other than be a mandated liability.

So yeah Elon is going to have to cave and do what ever the corrupted DOJ says to do. He can fight it, but in the end, nope.

With time, even the smug hubris of the FUSA will develop more cracks in the façade. This is especially the case with such harebrained morons masquerading as leaders although the closest thing they've ever experienced to a strategic thought during their university pampering was which rich sucker was providing the liquor at the frat house this weekend, and was juicy Lucy planning to be there.

Elon should pull up stakes and move to someplace where his company (and he himself) are wanted. Maybe Shaoxing in China (a city on the outskirts of Shanghai selected randomly), or even Taipei, or a city in India. Buy the whole city (or province if necessary), build world-class facilities and dedicated universities providing the best physics, engineering, computer sciences, astronomy - you name it. Governments will fall all over themselves to subsidize him (just like the US has).

Maybe the Russians would like him to move to the cosmodrome in Kazakhstan.

gee thats funny as i have worked at an itar registered facility and the signs right on the entryway door state that only legal citizens maybe employed in such a facility ..and with just a fast google search the company stated publicly that they follow itar (international traffic in Arms regulations ) laws ..

I have to wonder how many of those "asylees and refugees" still have friends and family in the PRC, Russia, North Korea, or Iran?.......
How many can get a security clearance? Answer is ZERO. Kinda a requirement to have a clearance since SpaceX handles DOD, NSA and NRO missions. Musk should take a copy of those agencies' contracts with that stipulation highlighted and shove it down DOJ's throat.

I have no answer for her . . . .
Maybe that's where these folks fit in.

It's not as if it's rocket science or anything, is it? Even a sterile facility has to have some janitors.
But in facilities that do classified missions, even the janitors need security clearances. And illegals and asylum seekers can not get a security clearance. Citizens and green card holders can. Simple as that.

SpaceX specifically says they only hire US Citizens or Permanent Residents. It's not about color/race, it's legal status.

One major point IMHO that is being overlooked is,......are they qualified?

I mean just because you're from Sub-Saharan Africa doesn't mean you know spit about rockets or satellites.

Start hiring people because of their color you'll have a lot more rockets blowing up. Just look at our Vice President.
