Anti-Gunners' Lawsuit Against Smith & Wesson Dismissed​


A lawsuit brought against Smith & Wesson by anti-gun shareholders within the company was dismissed Monday in Nevada’s Clark
County District Court.

On December 5, 2023, Breitbart News noted that shareholders disgruntled over Smith & Wesson’s continued manufacture of AR-15 platform rifles had filed the lawsuit.
Plaintiffs in the case included the Adrian Dominican Sisters, Sisters of Bon Secours USA, Sisters of St. Francis of Philadelphia, and Sisters of the Holy Names of Jesus & Mary. Their suit claims that the defendants, who are Smith & Wesson board members and the company’s senior management team, “knowingly allowed the Company to become exposed to significant liability for intentionally violating federal, state, and local laws through its manufacturing, marketing, and sales of AR-15 style rifles and similar semiautomatic firearms.”

The plaintiffs acknowledged the lawsuit protection provided to firearm companies via the Protection of Lawful Commerce in Arms Act (PLCAA). However, they claimed Smith & Wesson had foregone such protections by continuing to manufacture AR-15s after a Smith & Wesson AR-15 was used in a mass shooting.

On March 13, 2024, Breitbart News reported that Nevada’s Clark County District Court signaled no “substantial likelihood” Smith & Wesson would be found liable, saying the activist shareholders appear not to be aligned with the company’s best interest and requiring them to post a half-million-dollar bond to continue their suit.

The plaintiffs were instructed to post the bond by April 23, 2024, but they did not.
On May 6, 2024, Judge Joe Hardy pointed to their failure to post the bond as ordered and dismissed the lawsuit against Smith & Wesson.

The suit is Adrian Dominican Sisters v. Smith & Wesson Brands, Inc., No. A-23-882774-B in the District Court of Clark County, Nevada.

Just kidding- but not really. Bought my first two S&W this year. Yeah, I'm surprised too! One is a lightweight hammerless .38spc with laser grips I got a scream on for the Mrs' at $400. Came with 5 boxes of ammo, the $300 laser grips, shoulder holster, inside the belt holster. She needed a hammerless for purse & pocket carry (imo) and the lightweight was about the best deal. Charter arms makes one around $350, no laser, no kit... so the S&W was a great deal. It retails at $550 by itself! :-O

Then I bought me a "Lemon Squeezer" circa 1906 .38s&w (not spc) 5 shot hammerless with a grip safety...break-open... for a yard & walk gun..at a gun show $90. Couldn't leave it there!! 3 minute run time. Mine has a shorty barrel.

I figure these deals, and buying them used, one before the 'deal with the devil" made it ok, as long as I continue to talk emphasize how thoroughly they screwed the pooch and milked the glands of billy jeff all while alienating the customer base and emboldening the leftist hag brady. We own several Smith & Wesson revolvers and I just bought a Commander-size, Smith & Wesson Scandium 1911. Oh, did I mention my S&W AR-15?

As you may have guessed, I'm partial to the brand.

If the old guns could talk, eh? I don't know if you reload or not, but you probably already know that it can be somewhat difficult to find .38 S&W ammo. You can sometimes reload .38 S&W with .38 Spl. dies, though you'll have to bell the mouth of the case more than normal. I think Lee still makes bullet molds for the .38 S&W.

The first pistol I ever purchased was a S&W Sigma .380. Great, reliable, simple little pistol. I traded it in years later but have since acquired a couple of their M&P series pieces. Glad the company came out on top in this fight.

That be some crooked dip sticks right there. If you don't like the guns they are making don't fund it, or better yet make money from it.

Kind of like "Die America" and at the same time benefitting from the "free" stuff, shear stupidity.

I own one of the dreaded S&W ARs but mine must be better behave.

It's never tried to sneak out w/ a bunch of those "high capacity" magazines and cause untold injury and mayhem like the dems claim.
I've never felt any urges to assist said AR in such a plot so it seems the SJW-Dem pronouncements of such evil seductions are like most of their Anti-2A Propaganda - pure bull shit.

This lawsuit should be unlawful to begin with.
As a stock/share owner you "have" to do whats right for the value of the company.
There has got to be some sort of SEC violation here that SW could counter sue them with.
